RESOLUTION
On Simplifying Administrative Procedures within the Scope of Management Functions of the Ministry of Justice

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister, Head of the Government Office, and the Team Leader of the Task Force for Specialized Administrative Reform under the Prime Minister,
RESOLUTION:
Article 1. Approves the Plan to Simplify Administrative Procedures within the Scope of Management Functions of the Ministry of Justice attached hereto.
Article 2. Assigns the Ministry of Justice and relevant ministries and sectors within their respective authorities to implement the Plan to Simplify Administrative Procedures approved by the Government in Article 1 of this Resolution strictly in accordance with the content and deadlines set forth in the said Plan.
During the implementation process, the Ministry of Justice shall proactively identify and promptly amend, supplement, replace, or abolish regulations within its authority or submit written proposals to the Government Office regarding laws, ordinances, decrees issued by the Government, and decisions made by the Prime Minister concerning administrative procedures that need to be amended, supplemented, replaced, or abolished to implement the Plan to Simplify Administrative Procedures approved by the Government in Article 1 of this Resolution.
Article 3. Assigns the Minister of Justice, acting on behalf of the Prime Minister, to represent the Government and before December 31, 2010, compile proposals to amend, supplement, replace, or abolish laws and ordinances related to the Plan to Simplify Administrative Procedures mentioned in Article 1 of this Resolution to report to the Standing Committee of the National Assembly for the Government's request to allow the inclusion of draft laws and ordinances to implement the simplified administrative procedure plans approved by the Government in the legislative program for 2011 and 2012 through a single document amending multiple documents and applying the expedited procedures stipulated in the Law on Legislative Documents in 2008.
Based on the legislative program approved by the Standing Committee of the National Assembly, assigns the Ministry of Justice to coordinate with the Government Office to present to the Prime Minister for decision the deadline for drafting the aforementioned draft laws and ordinances and to take responsibility for compiling the contents to amend, supplement, replace, or abolish laws and ordinances to be submitted to the Government for consideration and decision.
Article 4. For administrative procedures prescribed in legislative documents within the authority to issue of the Government, the Prime Minister, Ministers, and Heads of agencies at the level of ministries, must amend, supplement, replace, or abolish them according to the Plan to Simplify Administrative Procedures mentioned in Article 1 of this Resolution. The Ministry of Justice shall apply the form of a single document amending multiple documents through expedited procedures to issue them within its authority or submit them to the Government or the Prime Minister for issuance. In cases where a single document is needed to amend another document, the Minister of Justice shall examine and decide.
Article 5. Assigns the People's Committees of provinces and centrally-administered cities to, based on the content of central agencies' legislative documents issued to implement the Plan to Simplify Administrative Procedures mentioned in Article 1 of this Resolution, promptly amend, supplement, replace, or abolish relevant provisions within their authority and issue them to ensure enforcement when the aforementioned central documents come into effect.
Article 6. Assigns the Government Office to monitor, urge implementation, and compile difficulties encountered by the Ministry of Justice, relevant ministries, sectors, and localities during the execution of the simplified administrative procedure plans approved by the Government in this Resolution to timely report to the Prime Minister for resolution.
Article 7. This Resolution takes effect from the date of signature.
The ministers, heads of agencies at the level of ministries, heads of government agencies, chairpersons of provincial and centrally-administered city people's committees, and related agencies are responsible for implementing this Resolution./.
