On the matter of transferring local drug warehouses from supply system to business operation

________________________

MINISTRY OF FINANCE – MINISTRY OF HEALTH

Respectfully submitted to:

- Administrative Committee of Region, Province
- Department, Region, Bureau of Health
- Region, Bureau of Finance
- Central Drug Warehouse

Implementing Decree No. 392-BYT-NĐ dated April 26, 1956 of the Ministry of Health, the Joint Ministry of Health-Finance issues this Circular to explain the transfer of local drug warehouses from the supply system to the business operation.

I. - CONDITIONS FOR TRANSFER

The transfer of local drug warehouses to retail drug stores will be carried out according to one of the two conditions below:

a) Any drug warehouse that has been assessed as meeting all requirements and obtaining the consent of the Regional and Provincial Administrative Committees shall proceed with the transfer immediately in accordance with the spirit of the aforementioned Decree, after reporting to the Ministry and receiving its approval.

b) Any drug warehouse that has not yet met all requirements shall gradually complete the business operation regime. In the initial stage, these drug warehouses will still be under normal leadership on all aspects by the Provincial Administrative Committee and the Health Bureau.

The Central Drug Warehouse will send personnel to these drug warehouses together with the Provincial Administrative Committee and the Health Bureau to rectify all aspects (staff organization, books, accounting, inventory, work procedures, etc.). After a short period, the warehouses will fully transfer and become directly subordinate to the Central Drug Warehouse after reporting and receiving approval from the Ministry.

II. - AT THE TIME OF TRANSFER

1. - The aforementioned retail drug stores:

a) To the Central Drug Warehouse, they shall be subject to leadership on all aspects: storage, buying and selling, financial transactions, organization, management, accounting, etc.

b) To the local administrative committee, they shall be subject to political supervision (thoughts of cadres, workers, activities, study, etc.), financial oversight (checking funds spent, medicines to prevent corruption and waste), and regular reports to the Region and Bureau of Finance.

c) To the Region, Department, and Bureau of Health, they shall be subject to guidance, monitoring, and inspection in their professional duties.

Specifically:

- Retail drug stores must report monthly on the situation regarding imports, exports, stock levels, etc.

- Maintain close contact with the Region, Department, and Bureau of Health to understand the direction of health work for the upcoming month to prepare sufficient medicines.

Meanwhile, the Region and Bureau of Health have the responsibility to approve medicine needs, inspect pharmaceutical work (situation of toxic and strong medicines, storage conditions, bookkeeping according to professional regulations and rules).

2. - According to Circular No. 1511-LB dated March 2, 1956 of the Joint Ministries, the staffing of pharmacists and drug warehouses of the provincial bureaus averages one pharmacist, two pharmacy assistants, one worker, and one accountant. Now, this entire staffing will be transferred to the provincial retail drug store.

Pharmacists of the retail drug store, in addition to their main duty of managing the drug stores, also bear the responsibility of concurrently performing the pharmaceutical work of the Bureau under the control of the Director and Deputy Director of the Bureau.

Where there is no pharmacist, temporarily, a pharmacy assistant from the retail drug store will concurrently perform the pharmaceutical work of the Bureau. Later, the Ministry will negotiate with the Ministry of Interior and the Ministry of Finance to add one pharmacy assistant to the Bureau's office to handle the pharmaceutical work of the Bureau.

3. All current assets, medicines, equipment, and books of the local drug warehouse will be handed over to the provincial retail drug store.

4. Money, medicines, and equipment that agencies and customers still owe (purchased, borrowed, etc.) from the beginning of the year until the date of transfer, the Region, Department, and Bureau of Health have the responsibility to recover and settle for the retail drug store.

5. The construction of the provincial drug warehouse which was previously being carried out by the Health Bureau and had budgeted funds and materials, will now still be the responsibility of the local Health Bureau to ensure completion.

6. Remaining funds (including salaries of workers and staff) of the local drug warehouses that were budgeted beforehand will be transferred to the Central Drug Warehouse for use by the retail drug stores.

The management system for business operations will be detailed in a separate circular.

7. To carry out the handover process, a Handover Committee should be established consisting of:

- One representative of the local administrative committee.

- One representative of the Region and Bureau of Finance.

- One representative of the Region, Department, and Bureau of Health.

- One representative of the Central Drug Warehouse.

- One pharmacist or pharmacy assistant from the retail drug store.

- And some specialized staff to assist.

The Ministry requests the Regional and Provincial Administrative Committees, Health Departments, Regions, Bureaus of Finance, and the Central Drug Warehouse to develop specific plans to implement effectively.
