CIRCULAR
GUIDELINES FOR IMPLEMENTING THE NOTIFICATION OF DECISIONS ON CONSCRIPTION AND CONSCRIPTION ORDERS, ASSEMBLING, TRANSPORTING, RECEIVING AND DELIVERING RESERVE PERSONNEL
CONSCRIPTION AND CONCENTRATION,
TRANSPORTATION, RECEIVING AND DELIVERING
RESERVE PERSONNEL
- BASED ON Articles 12, 13, 14, 15, 16, and 17 of Decree No. 39/CP dated April 28, 1997 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Reserve Personnel;
- TO UNIFY THE NOTIFICATION OF CONSCRIPTION DECISIONS AND CONSCRIPTION ORDERS, ASSEMBLING, TRANSPORTATION, RECEIVING AND DELIVERING OF RESERVE PERSONNEL IN CASES OF GENERAL CONSCRIPTION ORDER OR PARTIAL CONSCRIPTION ORDER AND IN WAR;
AND The Ministry of National Defense guides the implementation as follows:
I. NOTIFICATION OF CONSCRIPTION DECISIONS AND CONSCRIPTION ORDERS
RESERVE PERSONNEL:
1. For Ministries, agencies equivalent to Ministries, agencies under the Government, People's Committees at provincial and centrally governed city levels, People's Committees at district, town, and city levels under provinces:
- Upon receiving the conscription order from the Minister of National Defense regarding the mobilization of reserve personnel units (DBDV) under Ministries, agencies equivalent to Ministries, agencies under the Government (hereinafter referred to collectively as Ministries and sectors), provinces, centrally governed cities (hereinafter referred to collectively as provinces), the Chief of the General Staff (CTGS) directs the combat duty shift of the CTGS to notify by encrypted telegraph to the heads of Ministries and sectors (or authorized persons), Chairpersons of Provincial People's Committees (PPCs) (or authorized persons).
In case the combat duty shift of the CTGS cannot notify the Chairperson of the PPC of a province, the notification to the Chairperson of the PPC shall be carried out through the Military Region Command.
- Heads of Ministries and sectors, Chairpersons of PPCs (or authorized persons) proceed as follows:
+ Issue an order to open the envelope (which contains the conscription order for reserve personnel DBDV already prepared) with a code corresponding to the signal of the notification telegram and record the date, month, year according to the telegram on that order.
- Directly study and thoroughly understand the content of the conscription decision and conscription order for reserve personnel DBDV.
+ Clearly record the time of receipt of the conscription decision and conscription order and sign.
+ Based on the conscription decision for reserve personnel DBDV from superiors, promptly issue the conscription decision within their authority for localities and subordinate establishments.
+ Direct staff members of the office or responsible personnel on duty to notify relevant agencies, units, subordinate establishments, and agencies and units related to the conscription task.
+ Organize a meeting of heads of Ministries and sectors, PPCs, to notify the conscription decision and conscription order for reserve personnel DBDV from superiors; convey tasks, discuss measures to implement.
+ Assign tasks to departments and sectors to direct subordinates to carry out the notification task and practice conscription of reserve personnel DBDV. PPCs direct local military offices (QSDP) and related agencies to implement tasks according to plans.
- After completing the notification process, office staff or responsible personnel on duty compile a report to the head of the Ministry or sector, Chairperson of the PPC (or authorized person) on the implementation of the notification at their level, results of notifications received from subordinates and related agencies and units.
- Heads of Ministries and sectors, Chairpersons of PPCs report the results of the notification to the Ministry of National Defense (through the combat duty shift of the CTGS).
- Offices of Ministries and sectors, PPCs notify their subordinates who have received the notification to implement and report to the head of the Ministry or Chairperson of the PPC on the implementation as above. Specifically for districts, towns, and cities under provinces (hereinafter referred to collectively as districts), the transfer of orders to communes, wards, towns (hereinafter referred to collectively as communes) and political organizations, economic organizations, social organizations... (hereinafter referred to collectively as establishments) is carried out by express transportation forces (organized into notification teams).
2. For military units:
- When there is an order from the Minister of National Defense regarding the mobilization of reserve personnel units, the Office of the Ministry of National Defense notifies the CTGS; simultaneously sends the document of the Ministry of National Defense to report to the General Secretary and the Chairman of the National Assembly on the implementation of the conscription decision of the Government.
- According to the order of the head of the CTGS, the combat duty shift of the CTGS issues the signal to notify the conscription order for reserve personnel DBDV of the Minister of National Defense to subordinate agencies and units of the Ministry of National Defense, Ministries and sectors, PPCs. At the same time, use the joint information network to notify relevant state Ministries and sectors to coordinate in implementing the mobilization plan for reserve personnel DBDV.
At all levels upon receiving the signal notifying the conscription order for reserve personnel DBDV, proceed with the following contents:
- The combat duty shift checks the signal again, records it in the logbook and reports to the duty commander about the received signal.
- The duty commander issues an order to verify the received signal, then directly opens the envelope to study and thoroughly understand the content of the document, clearly records the time and signs the order; reports to superiors the result of receiving the signal.
- Based on the scale and time of mobilization, the duty commander notifies the Command Board and issues an order to issue the appropriate signal for the scale to subordinate agencies and units, while coordinating with related localities.
- Hold a command board meeting to convey tasks, determine immediate actions. Hold a Party Committee (Standing Committee) meeting to convey tasks; discuss leadership measures; Implement the organization and execution of the notification order and practice mobilization of reserve personnel DBDV.
- Hold an agency meeting to convey tasks and instruct matters to be implemented.
- Military offices outside of these contents must also report to the local Party Committee and government about the received conscription order; advise the local Party Committee and government on leadership and management, and organize the implementation of this task.
The Military District Command proceeds to implement specific tasks as follows:
+ Record the time and location of assembly in the call-up order for new recruits, the order to mobilize technical equipment (PTKT).
When recording time, it is necessary to determine a reasonable presence time for each unit to concentrate, transport, and hand over without congestion while still completing within the prescribed deadline.
+ Concentrate teams to report, check personnel strength and equipment used to transmit orders.
+ After recording the order, seal the order according to each commune, facility, and military district commander (or authorized person) assigns tasks to the reporting teams to transfer to the assigned communes and facilities.
+ Monitor and manage the transmission of orders by the reporting teams to ensure compliance with the planned schedule. Direct the reporting teams to utilize communication means at the facilities to promptly report the results of order transmission to the military district command.
3- For communes, wards, towns, political organizations, economic organizations, social organizations:
- Upon receiving the mobilization order notification from the county's reporting force, the People's Committee of the commune and the responsible persons of the facilities assign tasks to the order-reporting teams to deliver the mobilization order to each reserve soldier (RS) and each head of the Public Transport and Communication Team (PTKT); simultaneously specify the time, place for concentration at the commune or facility to organize movement to the RS and PTKT concentration station of the county.
For RS working in agencies, economic, political, and social organizations, issue two call-up orders at two places: one call-up order at the workplace, one call-up order at the residence. - When delivering the order, the notifier requires the RS and PTKT head to sign on the call-up order and record the receipt time. The notifier cuts off the signed part of the call-up order (stub) and returns it to the commune People's Committee (or the responsible person of the facility) to report the implementation results.
The commune People's Committee (or the responsible person of the facility) compiles the notification results of their locality and facility and bring the stubs back to report to the county military authority.
- In case the RS or PTKT head is absent, the person tasked with delivering the order must notify the family representative (father, mother, wife...) or the head of the agency where the RS or PTKT head works. The representative signs for the order and takes all measures to notify the mobilized person to return and accept the task. If all measures fail to notify the RS or PTKT head, the representative reports to the immediate superior who notified them.
- RS holding command positions in reserve units, in addition to complying with the call-up order, also participate alongside commune officials in notifying the RS under their jurisdiction within the same area.
II- IMPLEMENTATION OF CONCENTRATION STATIONS AND RECEPTION STATIONS FOR RESERVE FORCES.
DBĐV.
1. Implementation of concentration stations:
- At the county level, organize and implement from 1 to 3 RS concentration stations (each station concentrating about 2000-2500 people) and implement 1 PTKT concentration station. Members of the station include some military personnel from the military office and some cadres and staff from relevant departments and associations of the county.
(Organization, arrangement, and operation of the RS concentration station according to Appendix No. 1).
The PTKT concentration station is organized flexibly depending on the number of PTKT to be concentrated; it can be organized into three groups (one group checking files, one group conducting preliminary technical checks, one group organizing transportation for handover).
- Reserve specialized units (RSU) built by localities are organized and implemented by the provincial level. Members of the station include some military personnel from the military office and some cadres and staff from departments and bureaus responsible for building RSUs of the province.
- Reserve units of State Ministries and Departments with mobilization quotas for RSUs are organized and implemented at their own bases. Station members are selected by that base.
- RS concentration stations and PTKT concentration stations must ensure secrecy, safety, mobility, have primary and backup locations, guarantee smooth communication systems; they must have full plans to avoid enemy aircraft and artillery attacks.
- Upon receiving the order to implement RS concentration stations and PTKT concentration stations, the station leaders convene their members, check personnel strength, brief on tasks, assign teams to deploy according to the arranged positions, and prepare to operate.
- Logistics forces organize the transportation of materials and equipment of the station to the designated location. Prepare food supplies for station cadres and staff and coordinate with relevant facilities to provide food for RS.
- After completion, the station leader reports to the county military command on the implementation results.
2- Implementation of reception stations:
- RS reception stations are organized and implemented by brigade, regiment, or equivalent levels. Reception stations for RS of subordinate units of divisions, Provincial Military Command (BCHQS) are organized and implemented by cadre frameworks of those units together with some cadres and staff from division headquarters and BCHQS.
- Battalions and companies under the County Military Command do not organize reception stations but may combine reception directly at the county concentration station.
- Units without permanent frameworks, formed from reserve forces detached from permanent units, implement reception stations. Each brigade framework implements one reception station.
- PTKT reception stations are organized and implemented by infantry divisions, regiments, battalion branches, and Provincial Military Commands. (Provisions for support work and procedures for implementing reception stations are carried out similarly to the deployment of concentration stations mentioned above).
III- CONCENTRATION AND TRANSPORTATION OF RESERVE FORCES.
1- CONCENTRATION:
a- CONCENTRATION OF RS:
- Each commune and facility organizes the concentration of RS at their respective locations, specifically identifying each RS present according to the call-up order, checking the preparation of each individual, then assigning someone in charge to escort them to the county concentration station for handover.
- RS holding command positions at various levels in reserve units are responsible for urging RS under their command to concentrate according to the call-up order for enlistment and managing their units from the moment of concentration at the commune or facility (if within the same area).
- At each commune and facility and at the RS concentration station, levels proceed with concentration according to units already established during peacetime. In cases where RS are mobilized individually, they are combined into separate units for easier management.
- At the centralized station for Mobilized Personnel (QNDB), staff members check the headcount, complete procedural documentation, and gather each unit of Mobilized Personnel to transfer them to military units according to plan.
- Mobilized Personnel from the first reinforcement force are prioritized for concentration and transfer ahead of other units as per the plan.
- Mobilized Personnel designated as reserves are managed by the Military Command Board of the district, ready to be supplemented or replaced when necessary.
- The district level must ensure food supply for Mobilized Personnel during the concentration and transportation process until they are fully transferred to regular military units.
b- Concentration of Civilian Transport and Technical Equipment (PTKT):
- Upon receiving the mobilization order for PTKT, the owners of road transport vehicles, construction machinery, road-building equipment, loading/unloading machines... shall directly organize the delivery of their equipment to the centralized station for PTKT. Waterway transport means and communication equipment... shall be delivered to the agreed location for handover.
Prior to concentration, all transport vehicles, construction machinery... must be fueled sufficiently to reach the reception station of the regular military unit.
- Staff at the centralized station for PTKT shall inspect documentation, verify quantities, conduct preliminary technical checks on each piece of equipment, and organize their transfer to military units.
(PTKT subject to requisition will have separate guidance documents).
2- Transportation:
a- Transportation of Mobilized Personnel:
To timely transfer Mobilized Personnel to regular military units, local People's Committees should utilize all available means permitted for mobilization service or combine with additional mobilized automobiles to transport troops. If the receiving unit is located near the centralized station, marching on foot may be considered but must ensure compliance with the planned schedule.
- Strictly organize command, ensuring safety and secrecy during movement.
b- Transportation of PTKT:
For PTKT consisting of road transport vehicles, construction machinery... the current users shall directly control these means to the centralized station of the locality before transferring them to the military unit's reception station. Other PTKT shall be transported using mobilized transport means as stipulated by the Law on Civil Defense and Disaster Relief Forces and Decree 39-CP, or through contracts arranged by local military authorities.
IV- HANDOVER OF DEFENSE AND POPULARIZATION FORCES:
1 - Handover:
a- Method of Handover:
- Mobilized Personnel and PTKT mobilized shall be handed over directly by representatives of the Military Command Board of the district (or representatives of affiliated agencies under Ministries or sectors) at the reception stations for Mobilized Personnel and PTKT of military units.
- Regular Militia Units shall be handed over entirely to military units (including personnel, PTKT, and facilities serving specialized tasks) as prescribed.
- PTKT not required to go through centralized stations (waterway transport, communication equipment...) shall be directly delivered by respective entities to the agreed reception points of military units, where representatives of the Military Command Board of the district (or Ministries/Sectors) will handle the handover procedures.
- Handover of Mobilized Personnel and PTKT shall be conducted by unit.
- Handover of defense and popularization units must include full individual and collective personnel files of Mobilized Personnel, and PTKT files.
b- Documents and Files to be Handovered:
- Individual files of Mobilized Personnel include:
1- Call-up Order for National Service;
2- Appointment Decision;
3- Mobilized Personnel Registration Form;
4- Party Activity Introduction File (if a Party member);
5- Youth League Activity Introduction File (if a Youth League member).
- Collective files of defense and popularization units and Party/Youth League organizations include:
1- Summary list of Mobilized Personnel by squad;
2- Collective Party Activity Introduction Letter; List of Party Members; Proposed Party Committee (if organized);
3- Collective Youth League Activity Introduction Letter; List of Youth League Members; Proposed Youth League Committee (if organized).
- PTKT files include:
1- PTKT Registration Form (equipment profile);
2- PTKT Mobilization Order.
2- Reception:
a- Reception of Mobilized Personnel:
- Peace-time units that are understaffed, such as skeleton battalions of local forces... which receive small numbers of Mobilized Personnel shall organize a single reception without dividing it into phases.
- Peace-time units that are skeleton battalions which receive large numbers of Mobilized Personnel shall organize reception in two phases:
+ Phase 1: Reception of initial reinforcements (first reinforcement). Includes units of local forces (platoons, companies) in transportation, engineering, communications, air defense, guard, technical services, and some officers and staff (about 10%-15% of total personnel) as determined in the plan and agreed with the locality. The regular military unit shall receive each platoon promptly within its permanent garrison area, carried out by a part of the skeleton cadre. Once a unit is received, it shall be immediately utilized together with the skeleton cadre to implement protection, open up material resources, and transport technical equipment to the basic reinforcement reception station and the concentrated area.
+ Phase 2: Reception of basic reinforcements:
At the reception station, staff shall conduct headcounts for each company and receive each battalion (or equivalent). Once a battalion is received, uniforms shall be issued and the battalion shall be immediately relocated to its assigned position for weapons and equipment distribution.
During reception, timely verification and adjustment must be made to ensure consistency between the roster and actual presence of Mobilized Personnel.
In case the reception station is identified as potentially exposed or targeted, immediate relocation to a backup position and prompt coordination with the locality to follow the agreed contingency plan shall be executed.
When transitioning combat readiness status from regular to full alert or from reinforcement to full alert, the reception of Mobilized Personnel and PTKT shall occur at a new location outside the concentrated area. The regular unit must have a pre-established plan and coordinate promptly with the locality upon encountering such situations.
(Organization, deployment, and operation of the reception station for Mobilized Personnel are detailed in Appendix 2).
- Units on permanent duty organize the reception of road transport vehicles, road construction equipment, loading and unloading equipment... at the PTKT reception station; Receive inland waterway transport vehicles, communication equipment... at another location agreed upon by both parties.
- PTKT belonging to the establishment of the CMDB unit shall be received together with the CMDB unit at the same location.
- Personnel of the PTKT reception station check the documents, quantity, and quality of PTKT. For PTKT meeting the conditions for reception, promptly complete the procedures and immediately supplement the units according to the plan.
(Organization, arrangement, and operation of the PTKT reception station according to Appendix No. 3).
After reaching agreement on the quantity, quality of QNDB; the mobilization force unit; the quantity, quality, type of PTKT and the procedural documents, representatives of the local military authority (or Ministry, Sector) and representatives of the permanent military unit sign the handover record. The units promptly stabilize their organizational establishment and prepare to accept subsequent tasks.
V. IMPLEMENTATION:
1- This Circular takes effect 15 days from the date of signature.
2- Previous regulations regarding the notification of mobilization decisions and mobilization orders, concentration of transportation and handover of mobilization forces that conflict with this Circular are hereby abolished. In the course of implementation, any difficulties should be promptly reported to the Ministry of National Defense for study and resolution by relevant ministries, agencies equivalent to ministries, government agencies, provincial/municipal people's committees directly under the central government, and military agencies and units.
