Guidelines on determining the agencies and units to verify assets and income for National Assembly elections

Pursuant to the Anti-Corruption Law 2005; Pursuant to Article 20 and Article 36 of Decree No. 37/2007/NĐ-CP dated March 9, 2007 of the Government on asset and income transparency;

The Government Audit Office, Ministry of Home Affairs, and Central Inspection Commission provide guidelines on determining the agencies and units to verify assets and income for National Assembly elections and the election and approval of positions at the National Assembly as follows:
These guidelines regulate the determination of agencies and units to verify assets and income, and the coordination among competent agencies and units to verify assets and income for National Assembly elections and the election and approval of positions at the National Assembly.
These guidelines apply to agencies and organizations with authority to request verification of assets and income; heads of agencies and organizations with authority to issue decisions to verify assets and income; agencies and units conducting verification of assets and income; and individuals whose assets and income are being verified for National Assembly elections and the election and approval of positions at the National Assembly.
I. GENERAL PROVISIONS
1. In cases where the individual subject to verification of assets and income is a cadre under the management of the Party's Central Committee or Secretariat, the agency responsible for verifying assets and income shall be determined as follows:

The Central Inspection Commission shall conduct the verification if the individual subject to verification of assets and income is a cadre under the management of the Political Bureau, Secretariat of the Central Party Committee, or working in central Party agencies. If necessary, the Central Inspection Commission may mobilize officials from the Government Audit Office to participate in the verification process.
II. SPECIFIC PROVISIONS
1. The Provincial Party Committee Inspection Commission, Municipal Party Committee Inspection Commission, or Directly Affiliated Party Committee Inspection Commission shall conduct the verification if the individual subject to verification of assets and income is a cadre under the management of the Provincial Party Committee Standing Committee, Municipal Party Committee Standing Committee, Directly Affiliated Party Committee Standing Committee, County Party Committee Standing Committee, District Party Committee Standing Committee, Town Party Committee Standing Committee, County Party Committee Standing Committee, or working in local Party agencies. If necessary, the Inspection Commission may mobilize officials from the Ministry's Audit Office, Provincial Audit Office, County Inspection Commission, County Party Committee Inspection Commission, County Audit Office, or Department Audit Office to participate in the verification process.

In cases where the individual subject to verification of assets and income is not a cadre managed by the Party Committee Standing Committee and is working in state agencies, political-social organizations, people's armed forces units, public institutions, state-owned enterprises, or other agencies, organizations, or units using state budget funds or state assets, the agency responsible for verifying assets and income shall be determined as follows:
1. 2. The Ministry's Audit Office or the Personnel Department, Cadre Organization Department of the agency, organization, or unit at the central level shall conduct the verification if the individual subject to verification is working in that agency, organization, or unit.
2. The Provincial Audit Office shall conduct the verification if the individual subject to verification is working in an agency, organization, or unit at the local level (provincial, county, and commune levels). If necessary, the Provincial Audit Office may take the lead, coordinate, and mobilize officials from the Provincial Department of Home Affairs, County Audit Office, or Department Audit Office to participate in the verification process.
2.1. The Provincial Audit Office where the individual subject to verification of assets and income is running for election shall decide to verify and conduct the verification if the individual subject to verification of assets and income does not work in a state agency, political organization, political-social organization, people's armed forces unit, public institution, state-owned enterprise, or other agency, organization, or unit using state budget funds or state assets. If necessary, the Provincial Audit Office may mobilize officials from the County Audit Office or Department Audit Office to participate in the verification process. The verification conclusion shall be sent to the Provincial Election Commission for public disclosure, and the Provincial Audit Office shall report the verification results to the Government Audit Office and bear responsibility for the accuracy, honesty, and objectivity of the report.
2.2. During the verification process of assets and income, any issues encountered should be reported to the Government Audit Office for coordination with the Central Inspection Commission and the Ministry of Home Affairs to study and resolve.
