Guidelines for determining the agencies and units to verify assets and income for the election of National Assembly deputies and the election and approval of positions at the National Assembly

Pursuant to the Anti-Corruption Law 2005;

Pursuant to Article 20 and Article 36 of Decree No. 37/2007/NĐ-CP dated March 9, 2007 of the Government on asset and income transparency.

The Government Audit Office, the Ministry of Home Affairs, and the Central Inspection Committee provide guidelines for determining the agencies and units to verify assets and income for the election of National Assembly deputies and the election and approval of positions at the National Assembly as follows:

I. GENERAL PROVISIONS

Clause 1. This Circular guides the determination of the agencies and units to verify assets and income, and the coordination among agencies and units with authority to verify assets and income for the election of National Assembly deputies and the election and approval of positions at the National Assembly.

Clause 2. This Circular applies to agencies and organizations with authority to request verification of assets and income; heads of agencies and organizations with authority to issue decisions to verify assets and income; agencies and units conducting verification of assets and income; and individuals subject to verification of assets and income for the election of National Assembly deputies and the election and approval of positions at the National Assembly.

II. SPECIFIC PROVISIONS

1. In cases where the individual subject to verification of assets and income is a cadre under the management of the Party's Central Committee, the Central Inspection Committee shall be responsible for verification as follows:

The Central Inspection Committee shall conduct verification if the individual subject to verification of assets and income is a cadre under the management of the Politburo, Secretariat of the Central Committee of the Communist Party of Vietnam, or working in central-level Party agencies. If necessary, the Central Inspection Committee may mobilize officials from the Government Audit Office to participate in the verification process;

The Provincial Party Inspection Committees, Municipal Party Inspection Committees, and Party Inspection Committees directly under the Central Committee shall conduct verification if the individual subject to verification of assets and income is a cadre under the management of the Provincial Party Standing Committee, Municipal Party Standing Committee, Party Standing Committee directly under the Central Committee, County Party Standing Committee, District Party Standing Committee, Town Party Standing Committee, City Party Standing Committee within the province, or Village Party Standing Committee, or working in local Party agencies. If necessary, the Party Inspection Committee may mobilize officials from the Government Audit Office, provincial Government Audit Office, Party Inspection Committees of County Party Committees, District Party Committees, Town Party Committees, City Party Committees within the province, and county Government Audit Offices, department Government Audit Offices to participate in the verification process.

2. In cases where the individual subject to verification of assets and income does not fall under the management of the Party Standing Committee and is working in state administrative agencies, political-social organizations, people's armed forces units, public service units, state-owned enterprises, or other agencies, organizations, and units using state budget funds or state assets, the agency responsible for verification of assets and income shall be determined as follows:

2. 1. The Government Audit Office or the Personnel Department, Organization and Cadre Bureau of the agency, organization, or unit at the central level shall conduct verification for individuals working in that agency, organization, or unit.

2. 2. The provincial Government Audit Office shall conduct verification for individuals working in agencies, organizations, or units at the local level (provincial, county, and village levels). If necessary, the provincial Government Audit Office may take the lead, coordinate, and mobilize officials from the provincial Department of Home Affairs, county Government Audit Offices, and department Government Audit Offices to participate in the verification process.

3. The provincial Government Audit Office where the individual subject to verification of assets and income is running for election shall issue a decision to verify and conduct verification if the individual is not working in a state administrative agency, political organization, political-social organization, people's armed forces unit, public service unit, state-owned enterprise, or other agency, organization, or unit using state budget funds or state assets. If necessary, the provincial Government Audit Office may mobilize officials from the county Government Audit Office, department Government Audit Offices to participate in the verification process. The verification conclusion shall be sent to the Provincial Election Committee for public disclosure, and the provincial Government Audit Office shall be responsible for reporting the verification results to the Government Audit Office and ensuring the accuracy, honesty, and objectivity of the report.

III. IMPLEMENTATION

1. This Circular takes effect from the date of signature.

Clause 2. During the verification process of assets and income, if there are any issues, they should be reported to the Government Audit Office for coordination with the Central Inspection Committee and the Ministry of Home Affairs to study and resolve them.
