Decision No. 53/2001/QĐ-BCN on issuing the model contract for the sale and purchase of electricity for domestic use

purchase and sale of electricity for domestic use

Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Decree No. 45/2001/NĐ-CP dated August 2, 2001 of the Government on electricity activities and electricity usage;

At the proposal of the Director of the Legal Department, the Director of the Technical Safety Inspection and Supervision Bureau.

Article 1. This Decision annexes the Model Electricity Supply Contract for Residential Use applicable to organizations and individuals purchasing and selling electricity for residential purposes.

Article 2. Organizations and individuals purchasing and selling electricity for residential use when signing new contracts or renewing existing contracts must comply with the model contract stipulated in this Decision.

The seller of electricity is responsible for organizing the renewal of the electricity supply contract for residential use (signed before the effective date of this Decision) and completing it by December 31, 2002. In cases where the buyer of electricity requests to renew the contract earlier than the schedule set by the seller, the seller must carry out the renewal of the contract. During the period before the contract is renewed, both parties must continue to comply with the provisions set forth in Decree No. 45/2001/NĐ-CP.

Article 3. The seller of electricity organizes the printing of the electricity supply contract for residential use according to this model and publicly notifies the buyer of electricity at the seller's transaction office.

Article 4. This Decision takes effect from January 1, 2002.

Article 5. The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments and Bureaus under the Ministry, the General Directors of Vietnam Electricity Corporation, the Directors of Industry Departments of provinces and centrally-administered cities, and the Heads of relevant agencies and units are responsible for implementing this Decision.
