WHEREAS, Decree No. 187/2007/ND-CP dated December 25, 2007 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
WHEREAS, Decision No. 39/2007/QD-TTg dated March 21, 2007 of the Prime Minister on managing postal and telecommunications service rates;
WHEREAS, at the request of the Director of the Telecommunications Department,
DECISION:
Article 1. ISSUES CONNECTION FEES FOR TELEPHONE COMMUNICATIONS FROM FIXED TELECOMMUNICATION NETWORKS WITHIN THE SAME PROVINCE (HEREINAFTER REFERRED TO AS THE FIXED NETWORK) TO THE NATIONAL MOBILE TELEPHONE NETWORK (HEREINAFTER REFERRED TO AS THE MOBILE NETWORK) AS FOLLOWS:
1. IN CASE THE FIXED NETWORK CONNECTS DIRECTLY TO THE MOBILE NETWORK, THE FIXED NETWORK CHARGES CUSTOMERS AND PAYS THE MOBILE NETWORK (IRRESPECTIVE OF WHETHER THE MOBILE NETWORK HAS A DOMINANT MARKET SHARE OR NOT) A CONNECTION FEE OF 425 DONG PER MINUTE;
2. IN CASE THE FIXED NETWORK CONNECTS TO THE MOBILE NETWORK THROUGH THE PSTN OR LONG-DISTANCE VOIP NETWORK, THE FIXED NETWORK CHARGES CUSTOMERS AND PAYS THE CONNECTION FEE AS FOLLOWS:
2.1. PAYS THE MOBILE NETWORK AT THE END OF THE CALL (IRRESPECTIVE OF WHETHER THE MOBILE NETWORK HAS A DOMINANT MARKET SHARE OR NOT) A CONNECTION FEE OF 425 DONG PER MINUTE;
2.2. IN CASE THE FIXED NETWORK CONNECTS THROUGH THE LONG-DISTANCE PSTN NETWORK TO TRANSFER THE CALL TO THE MOBILE NETWORK, THE FIXED NETWORK PAYS THE LONG-DISTANCE PSTN NETWORK THE CONNECTION FEE AS FOLLOWS:
- IN CASE THE LONG-DISTANCE EXCHANGE (TOLL), LOCAL EXCHANGE (TANDEM) OR HOST WITH TANDEM FUNCTION AND MOBILE EXCHANGE (MSC) ARE IN THE SAME PROVINCE OR CITY, THE CONNECTION FEE IS 100 DONG PER MINUTE;
- IN CASE THE LONG-DISTANCE EXCHANGE (TOLL), LOCAL EXCHANGE (TANDEM) OR HOST WITH TANDEM FUNCTION AND MOBILE EXCHANGE (MSC) ARE NOT IN THE SAME PROVINCE OR CITY:
+ IN CASE THE LONG-DISTANCE PSTN NETWORK CONNECTS TO ONE MSC PORT OF THE REGION, THE CONNECTION FEE IS 300 DONG PER MINUTE;
+ IN CASE THE LONG-DISTANCE PSTN NETWORK CONNECTS TO TWO MSC PORTS OF THE REGION, THE CONNECTION FEE IS 250 DONG PER MINUTE;
+ IN CASE THE LONG-DISTANCE PSTN NETWORK CONNECTS TO THREE MSC PORTS OF THE REGION, THE CONNECTION FEE IS 200 DONG PER MINUTE.
2.3. IN CASE THE FIXED NETWORK CONNECTS THROUGH THE LONG-DISTANCE VOIP NETWORK TO TRANSFER THE CALL TO THE MOBILE NETWORK, THE CONNECTION FEE PAID TO THE LONG-DISTANCE VOIP NETWORK SHALL BE AGREED UPON BY ENTERPRISES BUT SHALL NOT EXCEED THE CONNECTION FEE WHEN CONNECTING TO THE LONG-DISTANCE PSTN NETWORK AND SHALL NOT DISCRIMINATE BETWEEN ENTERPRISES.
Article 2. THE CONNECTION FEES STATED IN THIS DECISION APPLY TO BOTH LOW-TRAFFIC PERIOD COMMUNICATIONS AND DO NOT INCLUDE VALUE ADDED TAX.
Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE. ALL PREVIOUS REGULATIONS CONTRARY TO THIS DECISION SHALL BE ABROGATED.
Article 4. THE HEAD OF THE MINISTRY’S OFFICE, THE DIRECTOR OF THE TELECOMMUNICATION DEPARTMENT, THE HEADS OF MINISTRY OF INFORMATION AND COMMUNICATIONS’ SUBORDINATE UNITS, AND TELECOMMUNICATION SERVICE PROVIDING ENTERPRISES SHALL BE RESPONSIBLE FOR IMPLEMENTING THIS DECISION./.
