CIRCULAR
Regulations on Financial Provisions for Implementing Measures to Prevent and Control Rice Dwarf Disease, Rice Stripe Dwarf Disease, and Rice Black Streaked Dwarf Disease

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister on Support Policies for Preventing and Controlling Brown Planthopper Outbreaks and Rice Dwarf Disease and Rice Stripe Dwarf Disease in Southern Provinces (from Da Nang southward);
To implement the guidance of the Prime Minister in Circular No. 1486/TTg-KTN dated September 9, 2008 regarding adjustment of support levels for preventing and controlling brown planthopper outbreaks and rice dwarf disease and rice stripe dwarf disease, and Circular No. 291/TTg-KTN dated February 11, 2010 regarding support policies for preventing and controlling rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease, the Ministry of Finance hereby provides guidance as follows:
Article 1. Scope of application:
1. The State budget shall provide financial support for measures to prevent and control rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease for the following subjects:
a) Households of farmers whose rice areas are affected by rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease and must spray plant protection chemicals and destroy their crops according to regulations of the Ministry of Agriculture and Rural Development.
b) Forces participating in disease prevention and control and monitoring the destruction of infected rice areas.
2. The period during which the State budget provides financial support for measures to prevent and control rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease for the subjects mentioned in Clause 1, Article 1 of this Circular shall be from the date of the decision announcing the outbreak until the date of the decision declaring the end of the outbreak by the competent state authority.
Article 2. Content and Levels of Expenditure:
1. The State budget shall provide support for measures to prevent and control rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease as stipulated in Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister and Circular No. 1486/TTg-KTN dated September 9, 2008 of the Prime Minister regarding adjustments to support levels for preventing and controlling brown planthopper outbreaks and rice dwarf disease and rice stripe dwarf disease, including:
a) Funding for purchasing plant protection chemicals, guaranteed by the State budget or drawn from the National Reserve Fund to support households of farmers as specified in Point a, Clause 1, Article 1 of Decision No. 1459/QĐ-TTg dated November 7, 2006 of the Prime Minister. The area of rice that needs spraying with plant protection chemicals must be confirmed by the local state management agency responsible for plant protection and related units as the basis for purchasing chemicals or requesting support for plant protection chemicals from the national reserve fund.confirmation from the state management agency for plant protection at the local level and relevant units as the basis for purchasing pesticides or requesting support for pesticides from the national reserve.
b) Allowance for those directly involved in disease prevention and control and monitoring the destruction of infected rice areas at a maximum rate of VND 50,000 per person per working day and VND 100,000 per person per non-working day. Based on the actual situation in the locality, the Chairman of the People's Committee of the province or centrally-administered city shall decide on specific expenditure levels for individuals participating in disease prevention and control and monitoring the destruction of infected rice areas in the locality.
c) Training costs for those assigned to participate in disease prevention and control according to the provisions set out in Circular No. 23/2007/TT-BTC dated March 21, 2007 of the Ministry of Finance on travel expenses and costs for organizing meetings for state agencies and public service units, and Circular No. 127/2007/TT-BTC dated October 31, 2007 of the Ministry of Finance amending and supplementing Circular No. 23/2007/TT-BTC dated March 21, 2007 of the Ministry of Finance.
d) Costs for propaganda and directing the implementation of disease prevention and control: Based on the actual situation in the locality and current expenditure standards, the Chairman of the People's Committee of the province or centrally-administered city shall decide on specific recipients and expenditure levels and bear responsibility for such decisions.
2. Direct support for households of farmers whose rice areas are affected by rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease and must be destroyed according to guidelines of the Ministry of Agriculture and Rural Development at a rate of VND 4 million per hectare of destroyed rice.
The area of destroyed rice must be confirmed by the commune-level government, the local state management agency responsible for plant protection, and related units as the basis for reimbursement. Based on guidelines from the Ministry of Agriculture and Rural Development and the actual situation in the locality, the Chairman of the People's Committee of the province or centrally-administered city shall specify the responsibilities of entities involved in destroying infected rice areas.
3. Provide 12 kilograms of rice per person per month to alleviate hunger for households of farmers suffering losses due to rice dwarf disease, rice stripe dwarf disease, and rice black streaked dwarf disease; the support period shall not exceed six months. Based on the actual situation in the locality, the Chairman of the People's Committee of the province or centrally-administered city shall decide on specific recipients and support periods for households of farmers.
Article 3. Sources of funds to ensure work on preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease:
1. The central budget supplements targeted funds to the local budget to support 100% of the cost for purchasing plant protection chemicals to prevent and control rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease; and direct support costs for households with rice areas destroyed as specified in point a, clause 1 and clause 2, Article 2 of this Circular.
2. The local budget ensures:
a) Funding for organizing and directing implementation, propaganda, and training for those assigned to participate in prevention and control, eradication, and supervision of the destruction of infected rice areas, as stipulated in points b, c, and d, clause 1, Article 2 of this Circular.
b) Funding for purchasing rice to provide food aid to households affected by rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease as specified in clause 3, Article 2 of this Circular. In cases where the local budget faces difficulties, the Chairman of the People's Committee of the province or centrally governed city shall report to the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Agriculture and Rural Development for consideration.
3. Hanoi City and Ho Chi Minh City shall use their local budgets to ensure the implementation of tasks specified in clauses 1, 2, and 3, Article 2 of this Circular.
Article 4. Budget preparation, execution, and settlement:
The preparation of estimates, decisions, allocation of estimates, and settlement of funds to ensure work on preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease shall be carried out in accordance with the State Budget Law and guiding documents.
Article 5. Reporting System:
Monthly and at the end of each epidemic period, the Chairman of the Provincial People's Committee shall direct relevant agencies to compile the situation and results of prevention and control efforts; the amount of funds spent to ensure work on preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease (details according to sources, levels of expenditure, specific contents of expenditure according to the attached form), and report to the Ministry of Finance and the Ministry of Agriculture and Rural Development for consideration of support from the central budget for each province and centrally governed city, and to compile and report to the Prime Minister on the results of implementation.
Article 6. Implementation:
1. The provincial and centrally governed city People's Committees shall be responsible for:
a) Directing the Department of Finance to coordinate with the Department of Agriculture and Rural Development and relevant agencies to determine the funding needs to ensure work on preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease, and develop financial plans to implement them. At the same time, they shall report to the provincial or centrally governed city People's Committee to proactively use local government budgets and other lawful financial resources to promptly meet the funding requirements for preventing and controlling these diseases as stipulated in this Circular.
b) Directing the Department of Labor, Invalids and Social Affairs to take the lead in coordinating with relevant agencies and lower-level People's Committees to determine the number of households affected by rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease that need food aid, the duration of food aid, and the quantity of rice for food aid, and report to the provincial or centrally governed city People's Committee for consideration and decision.
c) Directing departments, sectors, and all levels of People's Committees to effectively carry out work on preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease; to use funds efficiently, for the intended purpose, and for the appropriate beneficiaries; directing lower-level People's Committees, especially village-level People's Committees, to cooperate with relevant agencies in the locality to publicly disclose state support policies; the quantity of plant protection chemicals used in the commune; the level of support for households with rice areas that must be destroyed before and after the competent authority's support decision is issued, on mass media, in the commune, in the village, posted at the People's Committee office in the commune, and in the village, in accordance with Circular No. 54/2006/TT-BTC dated June 19, 2006 of the Ministry of Finance guiding the implementation of regulations on publicizing direct support from the budget for individuals and communities.
2. This Circular takes effect from the date of signature. Support measures for preventing and controlling rice yellow dwarf disease, rice stripe dwarf disease, and rice black-streaked dwarf disease shall be implemented from January 1, 2010.
Repeal Circular No. 108/2006/TT-BTC dated November 21, 2006 of the Ministry of Finance guiding financial systems for preventing and controlling brown planthopper, rice yellow dwarf disease, and rice stripe dwarf disease in southern provinces (from Da Nang southward).
