Amending and supplementing Circular No. 14/2011/TT-BNNPTNT dated March 29, 2011 on inspection and evaluation of agricultural input production and business establishments and forestry and aquatic products.

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government;
Pursuant to the Law on Product Quality and Commodities adopted by the National Assembly on November 21, 2007 and the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008 detailing the implementation of certain provisions of the Law on Product Quality and Commodities;
Pursuant to the Law on Technical Standards and Regulations adopted by the National Assembly on June 29, 2006 and the Government's Decree No. 127/2007/NĐ-CP dated August 1, 2007 detailing the implementation of certain provisions of the Law on Technical Standards and Regulations;
Pursuant to the Food Safety Law adopted by the National Assembly on June 17, 2010,
The Ministry of Agriculture and Rural Development amends and supplements Circular No. 14/2011/TT-BNNPTNT dated March 29, 2011 as follows:
Article 1. Supplementing Circular No. 14/2011/TT-BNNPTNT dated March 29, 2011 of the Ministry of Agriculture and Rural Development on inspection and evaluation of production and business establishments of agricultural inputs and forestry and aquatic products (hereinafter referred to as Circular No. 14/2011/TT-BNNPTNT).
1. Clause 2, Article 5 shall be supplemented with point d as follows:
a) Central level: the General Departments and specialized management agencies assigned and delegated by the Ministry of Agriculture and Rural Development.
2. Local inspection agencies include:
d) Based on actual conditions, in cases where local inspection agencies at the district and commune levels do not have the capacity to perform the tasks specified in points b and c of Clause 2, Article 5 of Circular No. 14, the agency assigned by the Department of Agriculture and Rural Development to carry out inspection duties shall be responsible for performing the corresponding tasks assigned to the district and commune level inspection agencies."
2. Article 16 shall be supplemented with Clause 3 as follows:
"Article 16. Departments of Agriculture and Rural Development of provinces and centrally governed cities
3. Direct the agency assigned inspection tasks to perform the tasks specified in points b and c of Clause 2, Article 5 of Circular No. 14 in cases where the district and commune level inspection agencies do not have the capacity to perform them; provide guidance and support to enhance the capacity of district and commune level inspection agencies and transfer tasks immediately after they acquire the necessary capacity."
Article 2. Replacing, amending, and supplementing some inspection and evaluation guidelines and forms for classifying quality assurance and food safety conditions of production and business establishments of agricultural inputs and forestry and aquatic products according to industry groups specified in the Appendix attached to this Circular.
Article 3. Effectiveness
This Circular takes effect forty-five days from the date of issuance.
Article 4. Responsibilities for Implementation
The Director of the Ministry's Office, the Director of the Directorate of Quality Assurance of Forestry and Aquatic Products, heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular./.
