the roadmap for applying the blending ratio of biofuel with traditional fuel. lThis Decision stipulates the roadmap for applying the blending ratio of biofuel with traditional fuel used for gasoline engines and diesel engines of motor vehicles on roads.
Article 1. Scope of Regulation
This Decision applies to organizations and individuals producing, blending, distributing, and trading gasoline and diesel in Vietnam for use in gasoline engines and diesel engines of motor vehicles on roads, except special types of gasoline and diesel for military and police purposes for national defense and security as prescribed by the Ministry of Defense and the Ministry of Public Security.
Article 2. Applicability
Article 3. Blending Ratio of Biofuel
The blending ratio of biofuel with traditional fuel includes the following levels:
1. A mixture of unleaded gasoline and denatured ethanol fuel with an ethanol content from 4% to 5% by volume and called E5 gasoline.
2. A mixture of unleaded gasoline and denatured ethanol fuel with an ethanol content from 9% to 10% by volume and called E10 gasoline.
3. A mixture of diesel fuel and biodiesel base fuel with a fatty acid methyl ester (FAME) content from 4% to 5% by volume and called B5 diesel.
4. A mixture of diesel fuel and biodiesel base fuel with a fatty acid methyl ester (FAME) content from 9% to 10% by volume and called B10 diesel.
Article 4. Roadmap for Applying the Blending Ratio
The roadmap for implementing the blending ratio of biofuel with traditional fuel is as follows:
1. E5 Gasoline
a) As of December 1, 2014, gasoline produced, blended, and traded for use in motor vehicles on roads in the provinces and cities of Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, Can Tho, Quang Ngai, and Ba Ria-Vung Tau shall be E5 gasoline.
b) As of December 1, 2015, gasoline produced, blended, and traded for use in motor vehicles on roads nationwide shall be E5 gasoline.
2. E10 Gasoline
a) As of December 1, 2016, gasoline produced, blended, and traded for use in motor vehicles on roads in the provinces and cities of Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, Can Tho, Quang Ngai, and Ba Ria-Vung Tau shall be E10 gasoline.
b) As of December 1, 2017, gasoline produced, blended, and traded for use in motor vehicles on roads nationwide shall be E10 gasoline.
3. Encouragement for Application
During the period before implementing the blending ratio according to the roadmap, it is encouraged that organizations and individuals produce, blend, and trade E5, E10 gasoline, and B5, B10 diesel.
a) To take the lead and coordinate with ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government to implement this roadmap, and report annually to the Prime Minister.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. Ministry of Industry and Trade
b) To take the lead and coordinate with relevant ministries, sectors, and provincial people's committees under the central government to organize the development and inspection of sustainable raw material areas, production facilities, and distribution systems for biofuel products serving the roadmap.
c) To take the lead in developing and promulgating national technical standards related to storage, transportation, and distribution of biofuel products; coordinate with the Ministry of Science and Technology and relevant ministries and sectors and localities to direct the implementation of inspections and supervision to ensure the blending ratio and quality of biofuels according to national technical standards and announced standards applicable to biofuel production and distribution facilities.
d) To take the lead and coordinate with relevant ministries and sectors to strengthen communication activities and encourage the community to use biofuels.
đ) To take the lead and coordinate with the Ministry of Transport and localities to organize and implement projects promoting the use of biofuels in public transportation operations.
e) To take the lead and coordinate with relevant ministries and sectors to promote international cooperation to secure technical and technological resources to serve the implementation of the roadmap.
a) To take the lead and coordinate with relevant ministries, sectors, and localities to develop and ensure sustainable raw material areas for the biofuel production industry.
2. Ministry of Agriculture and Rural Development
b) To take the lead and coordinate with relevant ministries and sectors to develop and promulgate or submit to competent authorities for promulgation preferential policies and support for biomass production serving biofuel production.
c) To take the lead and coordinate with relevant ministries and sectors to promote research, import, and development of high-yield crop varieties and cultivation techniques suitable for biomass production for the biofuel production industry serving the roadmap.
a) To take the lead and coordinate with relevant ministries and sectors to review, develop, and promulgate national standards and national technical standards on biofuels serving the implementation of the roadmap.
3. The Ministry of Science and Technology
b) To direct strict inspections and certifications of measuring equipment in biofuel production and distribution to ensure the blending ratio and product quality according to national technical standards and announced standards applicable to biofuel products.
a) To take the lead and coordinate with relevant ministries and sectors to develop and promulgate or submit to competent authorities for promulgation preferential investment policies for biofuel production, blending, and distribution projects ensuring the implementation of the roadmap.
4. The Ministry of Planning and Investment
b) To study and propose appropriate preferential policies to encourage and invest in developing raw material areas for biofuel development.
b) Study and propose appropriate incentive policies to encourage investment in the development of raw material regions for the development of biofuels.
5. The Ministry of Finance
a) To take the lead and coordinate with relevant ministries and sectors to develop and promulgate, or submit to competent authorities for promulgation, preferential policies on import duties for equipment and spare parts that have not yet been produced domestically for projects developing blending, distribution, and biofuel product sales networks.
b) To take the lead and coordinate with relevant ministries and sectors to develop and promulgate, or submit to competent authorities for promulgation, preferential tax policies for biofuel products at each stage of the roadmap.
c) To take the lead and coordinate with relevant ministries and sectors to develop and promulgate, or submit to competent authorities for promulgation, regulations on taxes for raw materials used in the production of biofuels.
6. Provincial People's Committees under the Central Government
Shall proactively coordinate with the Ministry of Industry and Trade and relevant ministries and sectors to organize the development and monitor the implementation of regional raw material development plans, production facilities, and distribution systems for biofuel products serving the roadmap.
7. Responsibilities of enterprises producing and trading in biofuels
a) Investment projects for the production of fuel ethanol and biodiesel must have a plan for developing the project's raw material region to be eligible for investment permits.
b) Enterprises producing and trading in biofuels must comply with development plans, regulations ensuring mixing ratios and product quality according to national technical standards and standards announced for biofuel products.
Article 6. Effectiveness and Responsibility for Implementation
1. This Decision shall take effect from January 15, 2013.
2. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of provincial People's Committees under the Central Government, and related organizations and individuals shall be responsible for implementing this Decision./.
