CIRCULAR

Issuing model minutes and model decisions on administrative offenses

in the civil aviation sector

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;

Pursuant to the Law on Handling Administrative Offenses dated June 20, 2012;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 81/2013/NĐ-CP dated July 19, 2013 of the Government detailing certain provisions and measures for implementing the Law on Handling Administrative Offenses;

Pursuant to Decree No. 147/2013/NĐ-CP dated October 30, 2013 of the Government regarding administrative penalties in the civil aviation sector;

At the proposal of the Director of the Department of Traffic Safety and the Director of the Civil Aviation Authority of Vietnam;

The Minister of Transport issues this Circular on model minutes and model decisions on administrative offenses in the civil aviation sector,

Article 1. Scope of application

This Circular promulgates models for minutes and decisions on administrative offenses in the civil aviation sector.

Article 2. Applicability

This Circular applies to individuals and organizations that commit administrative offenses in the civil aviation sector; persons authorized to issue violation reports and decisions on administrative penalties in the civil aviation sector, and individuals and organizations related to the handling of administrative offenses in the civil aviation sector.

Article 3. Models for minutes and decisions on administrative offenses in the civil aviation sector

1. This Circular annexes Model Forms for Minutes and Decisions on Administrative Offenses in the Civil Aviation Sector.

2. In addition to the models specified in Clause 1 of this Article, authorized persons may apply other model forms for minutes and decisions issued together with Decree No. 81/2013/NĐ-CP dated July 19, 2013 of the Government detailing certain provisions and measures for implementing the Law on Handling Administrative Offenses.

Article 4. Effective date

This Circular takes effect from December 13, 2013.

Article 5. Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, the Directors of relevant Departments, the Director of the Civil Aviation Administration of Vietnam, and the heads of agencies, units, and individuals concerned are responsible for implementing this Circular./.
