ANNEXING THE SUSPENSION OF THE EFFECTIVE ENFORCEMENT OF CLAUSE 5, ARTICLE 6 OF CIRCULAR NO. 33/2017/TT-BTNMT DATED SEPTEMBER 29, 2017 ISSUED BY THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT DETAILING DECREE NO. 01/2017/NĐ-CP DATED JANUARY 6, 2017 OF THE GOVERNMENT AMENDING AND COMPLEMENTING SOME DECREES PROVIDING DETAILED REGULATIONS ON THE IMPLEMENTATION OF THE LAND LAW AND AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF GUIDELINE CIRCULARS FOR THE IMPLEMENTATION OF THE LAND LAW

BASED ON THE LAW ON THE ISSUANCE OF LEGAL DOCUMENTS ON JUNE 22, 2015;BASED ON DECREE NO. 43/2014/NĐ-CP DATED MAY 15, 2014 OF THE GOVERNMENT PROVIDING DETAILED REGULATIONS ON THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE LAND LAW;

Pursuant to the Law on Land dated November 29, 2013;

BASED ON DECREE NO. 01/2017/NĐ-CP DATED JANUARY 6, 2017 OF THE GOVERNMENT AMENDING AND COMPLEMENTING SOME DECREES PROVIDING DETAILED REGULATIONS ON THE IMPLEMENTATION OF THE LAND LAW;AT THE REQUEST OF THE DIRECTOR OF THE LAND ADMINISTRATION AGENCY AND THE HEAD OF THE LEGAL DEPARTMENTGovernment THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT ISSUES THIS CIRCULAR ANNEXING THE SUSPENSION OF THE EFFECTIVE ENFORCEMENT OF CLAUSE 5, ARTICLE 6 OF CIRCULAR NO. 33/2017/TT-BTNMT DATED SEPTEMBER 29, 2017 ISSUED BY THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT DETAILING DECREE NO. 01/2017/NĐ-CP DATED JANUARY 6, 2017 OF THE GOVERNMENT AMENDING AND COMPLEMENTING SOME DECREES PROVIDING DETAILED REGULATIONS ON THE IMPLEMENTATION OF THE LAND LAW AND AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF GUIDELINE CIRCULARS FOR THE IMPLEMENTATION OF THE LAND LAW SUSPEND THE EFFECTIVE ENFORCEMENT OF CLAUSE 5, ARTICLE 6 OF CIRCULAR NO. 33/2017/TT-BTNMT DATED SEPTEMBER 29, 2017 ISSUED BY THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT DETAILING DECREE NO. 01/2017/NĐ-CP DATED JANUARY 6, 2017 OF THE GOVERNMENT AMENDING AND COMPLEMENTING SOME DECREES PROVIDING DETAILED REGULATIONS ON THE IMPLEMENTATION OF THE LAND LAW AND AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF GUIDELINE CIRCULARS FOR THE IMPLEMENTATION OF THE LAND LAW FROM DECEMBER 5, 2017 UNTIL THE EFFECTIVE DATE OF THE NEW LEGAL DOCUMENT REGULATING THIS ISSUE.

THIS CIRCULAR SHALL TAKE EFFECT FROM DECEMBER 5, 2017.THE LAND ADMINISTRATION AGENCY IS RESPONSIBLE FOR GUIDING AND ORGANIZING THE IMPLEMENTATION OF THIS CIRCULAR. PEOPLE'S COMMITTEES AT ALL LEVELS, DEPARTMENTS OF NATURAL RESOURCES AND ENVIRONMENT OF PROVINCES AND MUNICIPALITIES UNDER THE CENTRAL GOVERNMENT AND ASSOCIATED ORGANIZATIONS AND INDIVIDUALS ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR.

On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the request of the Director General of the Land Administration General Department and the Head of the Legal Department,

of the Ministry of Natural Resources and Environment, the Minister of Natural Resources and Environment issues this Circular to annul the effect of Clause 5, Article 6 of Circular No. 33/2017/TT-BTNMT dated September 29, 2017 issued by the Minister of Natural Resources and Environment detailing Decree No. 01/2017/NĐ-CP dated January 6, 2017 of the Government amending and supplementing some Decrees detailing the implementation of the Land Law and amending and supplementing certain provisions of the Circulars guiding the implementation of the Land Law.year 06 month 01 year 2017 of the Government amending and supplementing some Decrees detailing the implementation of the Land Law and amending and supplementing some provisions of the Circulars guiding the implementation of the Land Law, Decree detailing the implementation of the Land Law and amending and supplementing some provisions of the Circulars guiding the implementation of the Land Law,Annul the effect of Clause 5, Article 6 of Circular No. 33/2017/TT-BTNMT dated September 29, 2017 issued by the Minister of Natural Resources and Environment detailing Decree No. 01/2017/NĐ-CP dated January 6, 2017 of the Government amending and supplementing some Decrees detailing the implementation of the Land Law and amending and supplementing some provisions of the Circulars guiding the implementation of the Land Law from December 5, 2017 until the effective date of the new regulatory legal document addressing this issue. This Circular takes effect from December 5, 2017.

Article 1. The Land Administration General Department shall be responsible for guiding and organizing the implementation of this Circular. People's Committees at all levels, Departments of Natural Resources and Environment of provinces and centrally governed cities, and relevant organizations and individuals shall be responsible for implementing this Circular.

Article 2. This Circular takes effect from December 5, 2017.

Article 3. The Land Administration General Department shall be responsible for guiding and organizing the implementation of this Circular. People's Committees at all levels, Provincial Departments of Natural Resources and Environment under the central government, and related organizations and individuals shall be responsible for implementing this Circular.

During the implementation process, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should promptly report them to the Ministry of Natural Resources and Environment for consideration and resolution./.
