CIRCULAR
REGULATIONS ON CLASSIFICATION OF ROAD MOTOR VEHICLES AND IDENTIFICATION MARKS FOR MOTOR VEHICLES USING CLEAN ENERGY, GREEN ENERGY, AND ENVIRONMENTALLY FRIENDLY ENERGY
BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;
BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the proposal of the Director of the Science, Technology, and Environment Department and the Director of the Vietnam Registration Agency;
The Minister of Transport issues this Circular to regulate the classification of road motor vehicles and identification marks for motor vehicles using clean energy, green energy, and environmentally friendly energy.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the classification of road motor vehicles and identification marks for motor vehicles using clean energy, green energy, and environmentally friendly energy.
Article 2. Applicability
This Circular applies to organizations and individuals related to the classification of road motor vehicles and identification marks for motor vehicles using clean energy, green energy, and environmentally friendly energy.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. Electric powertrain is a system comprising one or more: electrical energy storage devices (batteries, capacitors, electro-mechanical flywheels or supercapacitors); electrical energy stabilizing devices; electrical devices used to convert stored electrical energy into mechanical energy transmitted to the wheels as the driving force for the vehicle's movement.
2. Pure electric vehicle (PEV - Pure electric vehicle or BEV - Battery electric vehicle) is a motor vehicle that uses an electric powertrain.
3. Pure fuel cell electric vehicle (PFCEV - Pure fuel cell electric vehicle or FCEV - Fuel cell electric vehicle) is an electric motor vehicle that uses pure fuel cells, where the fuel cell system is the sole source of energy on the vehicle for its propulsion system.
4. Hybrid electric powertrain is a drive system that consumes energy from both sources of energy stored on the vehicle, including fuel and electrical energy storage devices.
5. Hybrid electric vehicle (HEV - Hybrid electric vehicle) is a motor vehicle driven by a hybrid electric powertrain (including vehicles that use fuel solely to charge electrical energy storage devices), including:
a) Mild hybrid electric vehicle (MHEV - Mild hybrid electric vehicle) is a hybrid electric vehicle; the electric motor has the function of assisting the internal combustion engine in starting, accelerating, regenerative braking, and providing energy for auxiliary systems. Such a vehicle does not have the capability to charge from external electrical sources.
b) Full hybrid electric vehicle (FHEV - Full hybrid electric vehicle or SHEV - Strong hybrid electric vehicle) is a hybrid electric vehicle capable of moving entirely by electric energy under certain conditions (such as starting from a stationary position, moving at low speeds...). Such a vehicle does not have the capability to charge from external electrical sources.
A strong hybrid electric vehicle is a hybrid electric vehicle capable of moving entirely by electrical energy under certain conditions (such as starting from a stationary position, moving at low speeds...). The vehicle does not have the capability to charge from an external power source.
c) Plug-in hybrid electric vehicle (PHEV - Plug-in hybrid electric vehicle) is a hybrid electric vehicle capable of charging from external electrical sources.
Chapter II
CLASSIFICATION OF ROAD MOTOR VEHICLES BY PURPOSE
Article 4. Motor Vehicles
Motor vehicles as defined in Clause 1, Article 34 of the Road Traffic Safety Law include:
1. Passenger cars are classified as follows:
a) Passenger cars are types of cars primarily designed and equipped for carrying people and luggage. Passenger cars may also tow a trailer. Types of passenger cars include:
Passenger cars up to 08 seats (excluding the driver's seat) are specified in Appendix I attached hereto;
Passenger cars over 08 seats (excluding the driver's seat) are specified in Appendix II attached hereto;
Special purpose passenger cars are passenger cars with characteristics different from those mentioned above, designed and equipped to carry people under special conditions or with special arrangements, specified in Appendix III attached hereto;
b) Cargo trucks are types of cars primarily designed and equipped for carrying goods. Cargo trucks may be arranged with a maximum of two seats and carry no more than 06 people including the driver in the cab. Cargo trucks may also tow a trailer. Types of cargo trucks include:
General cargo trucks are specified in Appendix IV attached hereto;
Special purpose cargo trucks include cargo trucks designed and equipped to carry goods requiring special arrangements, specified in Appendix V attached hereto;
c) Special purpose vehicles are types of vehicles designed and equipped to perform special functions or purposes other than those mentioned in points a and b of this clause. Special purpose vehicles are specified in Appendix VI attached hereto;
d) Tractor units are vehicles designed to tow semi-trailers and equipped with: fifth-wheel coupling mechanism; connection and control mechanisms for the trailer's signal lights and brake system; may be equipped with cranes, generators, towing hooks (tow coupling, hook coupling) to tow trailers;
e) Trailer towing vehicles are vehicles specifically or mainly designed to tow trailers and equipped with: towing hooks (tow coupling, hook coupling); cargo bed or floor; connection and control mechanisms for the trailer's signal lights and brake system;
Trailer towing vehicles do not include: cargo trucks equipped with towing hooks; tractor units additionally equipped with towing hooks.
2. Trailers are classified according to the provisions set out in Appendix VII attached hereto.
3. Semi-trailers are classified according to the provisions set out in Appendix VIII attached hereto.
4. Four-wheeled passenger vehicles with engines are classified as follows:
a) Four-wheeled passenger vehicles with engines participating in public transportation are vehicles designed to operate on public roads;
b) Four-wheeled passenger vehicles with engines operating on dedicated or internal roads are vehicles designed to operate only on dedicated or internal roads.
5. Four-wheeled cargo vehicles with engines.
6. Motorcycles are classified as follows:
a) Two-wheeled motorcycles;
b) Three-wheeled motorcycles for passengers;
c) Three-wheeled motorcycles for cargo;
d) Three-wheeled motorcycles for disabled persons.
7. Motorized bicycles are classified as follows:
a) Two-wheeled motorized bicycles;
b) Three-wheeled motorized bicycles for passengers;
c) Three-wheeled motorized bicycles for cargo;
d) Three-wheeled motorized bicycles for disabled persons.
Article 5. Special-purpose motorcycles
Special-purpose motorcycles are classified as follows:
1. Construction motorcycles are classified according to the provisions set out in Appendix IX attached hereto;
2. Agricultural and forestry motorcycles are special-purpose motorcycles exclusively serving agriculture and forestry;
3. Tractors;
4. Trailers and semi-trailers pulled by tractors: Trailers and semi-trailers are designed and manufactured solely to be pulled by tractors;
5. Motorcycles performing special functions are classified according to the provisions set out in Appendix X attached hereto;
6. Special vehicles used for national defense and security purposes that participate in road traffic.
Article 6. Primitive Vehicles
Primitive vehicles include types of vehicles specified in Clause 2, Article 34 of the Road Traffic Safety Law.
Chapter III
CLASSIFICATION OF MOTOR VEHICLES BY LEVEL OF AUTOMATION
Article 7. Conventional Means of Transportation
Conventional means of transportation are motor vehicles where the driver performs all control tasks for vehicle movement even when assisted by active safety systems on the vehicle.
Article 8. Intelligent Means of Transportation
Intelligent means of transportation as defined in Clause 4, Article 34 of the Road Traffic Safety Law are classified based on the degree of partial or full automation of vehicle control operations, specifically as follows:
1. Motor vehicles allowing partial automation of control operations, route determination, and handling situations during road traffic are categorized as Level 1 (Category 1), Level 2 (Category 2), or Level 3 (Category 3) as defined and classified in the ISO/SAE PAS 22736:2021 standard on Taxonomy and Definitions for Terms Related to Driving Automation Systems for On-Road Motor Vehicles;
2. Motor vehicles allowing full automation of control operations, route determination, and handling situations during road traffic are categorized as Level 4 (Category 4) or Level 5 (Category 5) as defined and classified in the ISO/SAE PAS 22736:2021 standard on Taxonomy and Definitions for Terms Related to Driving Automation Systems for On-Road Motor Vehicles.
Chapter IV
CLASSIFICATION OF MOTOR VEHICLES BY ENERGY SOURCE AND REGULATIONS ON MARKINGS FOR ENVIRONMENTALLY FRIENDLY, GREEN, AND CLEAN ENERGY MOTOR VEHICLES
Article 9. Classification of Motor Vehicles by Energy Source
Based on the type of energy source used, motor vehicles (excluding trailers and semi-trailers) are classified as follows:
1. Motor vehicles with engines using gasoline or diesel fuel;
2. Environmentally friendly motor vehicles are those using energy or technology that reduces direct carbon emissions during operation compared to conventional motor vehicles mentioned in Clause 1 of this Article (such as CNG-fueled vehicles, mild hybrid electric vehicles (MHEV), full hybrid electric vehicles (FHEV or SHEV), plug-in hybrid electric vehicles (PHEV));
3. Motor vehicles using clean, green, and environmentally friendly energy are those not emitting carbon directly during operation (such as battery electric vehicles (BEV or PEV), pure fuel cell electric vehicles (PFCEV or FCEV), hydrogen-fueled vehicles).
Article 10. Provisions on identifying signs for motor vehicles using clean energy, green energy, and environmentally friendly vehicles
Motor vehicles using clean energy, green energy, and environmentally friendly vehicles are determined according to the provisions of Clause 3, Article 9 of this Circular. The identifying sign for motor vehicles using clean energy, green energy, and environmentally friendly vehicles when participating in traffic is recognized by a certification label with a green background. The detailed label model is specified in the Circular of the Minister of Transport regarding the procedures and formalities for inspection, exemption from initial inspection, modification of motor vehicles, special-purpose motorcycles; procedures and formalities for exhaust gas inspection of motorcycles and motorbikes.
Chapter V
IMPLEMENTING PROVISIONS
Article 11. Effective Date
1. This Circular takes effect from January 1, 2025.
2. In cases where the standards referred to in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replaced standards.
Article 12. Transitional Provisions
Road transport vehicles that have been classified and identified in the notification of exemption from quality safety technical inspection and environmental protection or certificate of quality safety technical inspection and environmental protection for imported motor vehicles; certificate of quality safety technical inspection and environmental protection for domestically produced and assembled motor vehicles; certificate of safety technical inspection and environmental protection for modified motor vehicles issued before the effective date of this Circular shall continue to be used to implement importation, production, assembly, modification, registration, and inspection procedures for vehicles.
