Pursuant to the Law on Protection and Development of Forests;
Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities of state management of ministries and ministerial-level agencies;
AT THE REQUEST OF THE DIRECTOR OF THE FOREST INSPECTION CIRCULAR
DECISION:
Article 1.
NOW, THE MINISTER ISSUES DECISION TO SUPPLEMENT AND AMEND ARTICLE 3 OF THE REGULATIONS ON MANAGEMENT AND PROTECTION OF FORESTS IN THE INDUSTRIAL RAW MATERIAL REGION AS ISSUED ACCOMPANIED WITH DECISION NO. 98/QĐ-KL DATED MARCH 15, 1991 AS FOLLOWS:
"ARTICLE 3. FORESTS FOR INDUSTRIAL RAW MATERIALS MAY BE HARVESTED ONLY WHEN THEY HAVE REACHED THE TECHNICAL MATURITY AGE.
FOR STATE FOREST ENTERPRISES, HARVESTING OF FORESTS MUST BE APPROVED BY THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT THROUGH THE REVIEW OF THE HARVESTING DESIGN AND THE ISSUE OF THE FOREST OPENING ORDER.
FOR ORGANIZATIONS, COOPERATIVES, COLLECTIVES, AND HOUSEHOLDS, WHEN HARVESTING CONCENTRATED FORESTS (ONE HECTARE OR MORE), THEY MUST HAVE A HARVESTING DESIGN.
IF THE FOREST IS FUNDED BY THE ASSOCIATION OF ENTERPRISES, THE ASSOCIATION MUST PREPARE THE HARVESTING DESIGN, SUBMIT IT TO THE MINISTRY FOR REVIEW, AND OBTAIN THE FOREST OPENING ORDER.
IF THE FOREST IS FUNDED BY OTHER SOURCES, THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT MUST PREPARE THE HARVESTING DESIGN, SUBMIT IT TO THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT FOR REVIEW, AND OBTAIN THE FOREST OPENING ORDER.
THE PROVINCE LEVEL FOREST INSPECTION AUTHORITY SHALL ISSUE THE HARVESTING LICENSE, MONITOR THE HARVESTING ACTIVITY, AND PROCESS THE WOOD TRANSPORTATION DOCUMENTS."
Article 2.
THE ABOVE SUPPLEMENT AND AMENDMENT SHALL TAKE EFFECT FROM THE DATE OF ISSUANCE OF THIS DECISION.
Article 3.MR. CHIEF OF THE MINISTRY'S OFFICE, DIRECTOR OF THE FOREST INSPECTION CIRCULAR, HEADS OF DEPARTMENTS AND INSTITUTES INVOLVED, GENERAL DIRECTORS OF THE ASSOCIATION OF ENTERPRISES FOR PAPER RAW MATERIALS VINHPHU, DIRECTORS OF THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT, AND DIRECTORS OF PROVINCE LEVEL FOREST INSPECTION BRANCHES IN THE CENTRAL NORTH INDUSTRIAL RAW MATERIAL REGION ARE RESPONSIBLE FOR IMPLEMENTING THIS DECISION.
