DECREE

REGULATIONS ON THE BENEFITS AND POLICIES FOR THE RELATIVES OF NON-COMMISSIONED OFFICERS AND SOLDIERS SERVING WITH A FIXED TERM IN THE PEOPLE'S INTERNAL AFFAIRS FORCE

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Public Security Law dated November 29, 2005;

Pursuant to the Education Law dated June 14, 2005;

Considering the proposal of the Minister of Public Security,

DECREE:

Article 1. Scope of application

This Decree stipulates the benefits and policies for the relatives of non-commissioned officers and soldiers serving with a fixed term in the People's Internal Affairs Force (hereinafter referred to as the relatives of non-commissioned officers and soldiers). The relatives of non-commissioned officers and soldiers include: father, mother, legal guardian; spouse; biological child, legally adopted child; father, mother of the spouse; legal guardian of the spouse.

Article 2. Benefits for the relatives of non-commissioned officers and soldiers serving with a fixed term in the People's Internal Affairs Force

1. If the relatives of non-commissioned officers and soldiers do not fall under the category required to participate in mandatory health insurance according to the laws on health insurance, they shall be issued a mandatory health insurance card. The monthly contribution rate for mandatory health insurance for one person is 3% of the national minimum wage as prescribed by the Government at the time of purchasing health insurance.

2. The family of non-commissioned officers and soldiers shall be provided with emergency hardship assistance in the following cases:

a) In case the family suffers from fire or natural disasters; relatives suffer from accidents, illness for one month or more, or hospitalization for 15 days or more, they will be assisted with VND 300,000 per person per occurrence but not exceeding two occurrences in a year.

b) When a relative dies or goes missing, the family will be assisted with VND 600,000 per person.

3. Biological children and legally adopted children of non-commissioned officers and soldiers are exempt from tuition fees when studying at state-run preschools and primary-secondary schools.

4. The relatives of non-commissioned officers and soldiers specified in Article 1 of this Decree shall cease to enjoy the benefits and policies when the non-commissioned officers and soldiers terminate their service in the People's Internal Affairs Force.

1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.

The funding for implementing the benefits prescribed in this Decree shall be guaranteed by the State budget in accordance with the provisions of the Law on State Budget.

Article 4. Responsibilities of Ministries and Agencies

1. Responsibilities of the Ministry of Public Security:

a) To take the lead and coordinate with the Ministry of Finance and relevant agencies in guiding the implementation of this Decree.

b) To implement emergency hardship assistance for the families of non-commissioned officers and soldiers.

c) To organize the purchase, issuance, and recovery of health insurance cards for the relatives of non-commissioned officers and soldiers in accordance with the provisions of this Decree.

2. The Ministry of Finance shall be responsible for allocating the State budget estimate to implement the benefits prescribed in this Decree in accordance with the provisions of the Law on State Budget.

3. The Chairman of the People's Committee of provinces and centrally-administered cities shall be responsible for directing and organizing the implementation of the tuition exemption policy prescribed in this Decree for the relatives of non-commissioned officers and soldiers residing within their jurisdiction.

4. Those who falsify or forge documents shall be subject to disciplinary action, administrative penalties, or criminal prosecution and must compensate for any losses incurred (if any) in accordance with the provisions of the law.

Article 5. Effective Date

This Decree shall take effect fifteen days after its publication in the Official Gazette.

Article 6. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decree.
