THE MINISTER OF HEALTH

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Considering the proposal of the Organization and Cadres Affairs Department Director and the Preventive Medicine and Environment Department Director, Ministry of Health.

DECISION:

Article 1. Position and Functions

1. The Preventive Medicine and Environment Department is a specialized department under the Ministry of Health, advising the Minister of Health on performing state management functions and organizing the implementation of laws, directing and managing professional activities in the field of preventive medicine throughout the country including: Prevention and control of infectious diseases and social diseases; prevention and control of occupational diseases and injuries; prevention and control of risk factors for non-communicable diseases in the community; environmental health, occupational health, school health; community nutrition; border quarantine; vaccine and medical product use; chemicals, insecticides, and bactericides used in household and medical fields.

2. The Preventive Medicine and Environment Department has legal personality, its own seal and separate bank account, with its headquarters located in Hanoi City. The operating budget of the Department is provided by the state budget and other legitimate sources.

Article 2. Tasks and Authorities

1. Take the lead in developing strategies, planning, and plans for preventive medicine throughout the country including: Prevention and control of infectious diseases and social diseases; prevention and control of occupational diseases and injuries; prevention and control of risk factors for non-communicable diseases in the community; laboratory biosafety; protection of the environment in the health sector, environmental health, occupational health, school health; community nutrition; border quarantine; management of chemicals, insecticides, and bactericides used in household and medical fields, to be submitted to the Minister of Health for approval or by the Minister to the competent authority for approval.

2. Take the lead and coordinate in developing, revising, and supplementing regulatory legal documents, systems, and policies in the field of preventive medicine assigned, to be issued by the Minister of Health or by the Minister to the competent authority for issuance.

3. Take the lead and coordinate in developing national standards, technical tier regulations, professional rules, and national technical standards in the fields of: Prevention and control of infectious diseases and social diseases; prevention and control of occupational diseases and injuries; prevention and control of risk factors for non-communicable diseases in the community; laboratory biosafety; protection of the environment in the health sector, environmental health, occupational health, school health; community nutrition; drinking water hygiene and sanitation of household facilities; border quarantine; management of chemicals, insecticides, and bactericides used in household and medical fields, to be issued by the Minister of Health or by the Minister to the competent authority for issuance.

4. Take the lead and coordinate in developing the list of reserves for medicines, chemicals, equipment, and dedicated materials and funds for disease prevention and control, to be submitted to the Minister of Health for approval or by the Minister to the competent authority for approval.

5. Direct the use of vaccines and medical products including: Establishing regulations on conditions and standards for vaccination facilities; regulations on the use of vaccines and medical products; guiding, supervising, and inspecting the implementation of regulations on the safe and effective use of vaccines and medical products.

6. Develop lists of occupational diseases and substances requiring strict occupational safety and health requirements, to be submitted to the competent authority for issuance.

7. Manage and direct specialized preventive medicine activities within the country's scope, manage and direct the professional activities of Institutes and units under the preventive medicine system; act as the focal point for managing and directing preventive medicine professional activities of Ministries and sectors.

8. Manage, direct, and organize the implementation of the following contents:

a) Activities for the prevention and control of infectious diseases and social diseases throughout the country; managing infectious disease data and advising the Minister of Health on declaring epidemics within their authority;

b) Border health quarantine throughout the country; focal point for implementing the International Health Regulations in Vietnam;

c) Environmental health, school health, and community nutrition; preventive health and health promotion activities; prevention and control of risk factors for non-communicable diseases in the community;

d) Monitoring the quality of water used for drinking and daily activities; guiding and monitoring hygiene standards for household sanitation facilities;

đ) Focal point for implementing the environmental protection mission of the health sector; directing surveillance and assessment of environmental impacts on health;

e) Hygiene in funeral activities as prescribed by law;

g) Inspecting and monitoring workplace environments, caring for workers' health, preventing occupational diseases, assessing the impact of workplace environments on health;

h) Preventing accidents and injuries, building safe communities; managing accident and injury databases;

i) Issuing, suspending, and revoking registration certificates for circulation; reviewing the professional content, registering advertisements for chemicals, insecticides, and bactericides used in household and medical fields.

9. Direct the implementation of National Target Programs in the field of preventive medicine, projects and programs assigned in the field of preventive medicine.

10. Direct the development and implementation of information, education, and communication activities related to health in the field of preventive medicine assigned.

11. Direct the implementation of professional training for staff in the field of preventive medicine assigned. Act as the focal point for organizing the implementation of the field epidemiology training program.

12. Take the lead or coordinate with relevant units to direct, guide the implementation, inspect, and supervise the National Standards in preventive medicine throughout the country.

13. Take the lead or coordinate with relevant units to organize inspections and propose measures to handle violations in specialized preventive medicine activities according to the provisions of the law; participate in inspection teams regarding specialized preventive medicine activities.

14. Conduct scientific research activities and international cooperation in the field of preventive healthcare.

15. Manage staff, officials, assets, and allocated funds in accordance with the provisions of the law and the delegation of authority by the Minister of Health.

16. Lead and coordinate with Departments, Bureaus, the Ministry's Office, the Ministry of Health Inspectorate, and related units in directing specialized activities of the national preventive healthcare system.

17. Perform other tasks assigned by the Minister of Health.

Article 3. Organization and Operation Mechanism

1. Leadership of the Bureau.

The Preventive Healthcare and Environment Bureau leadership consists of the Director and Deputy Directors appointed and relieved from duty by the Minister of Health.

The Director is responsible to the Minister of Health and the law for all activities of the Bureau.

Deputy Directors assist the Director, are responsible to the Director and the law for the tasks delegated to them.

2. Structure of the Bureau

a) Office of the Department;

b) Planning and Finance Department;

c) Field Guidance Department;

d) Infectious Disease Control Department;

đ) Border Health Quarantine Department;

e) Environmental Health Management Department;

g) Environmental Health Department;

h) Occupational Health - Accidents and Injuries Department;

i) Attached Public Service Unit: Specialized Journal.

3. Operation Mechanism

a) The Preventive Healthcare and Environment Bureau operates under a chief executive system;

b) The functions, duties, and authorities of the Bureau's Office and its departments are defined by the Director based on the functions, duties, and authorities of the Bureau delegated by the Minister of Health. Relationships between the Bureau's Office and the departments within the Bureau are regulated by the Director;

c) Appointments and dismissals of leadership positions in the Bureau's Office and its departments are carried out in accordance with current laws;

d) Leaders of the Bureau, leaders of the Bureau's Office, and leaders of the Bureau's departments are entitled to allowances as prescribed by law.

4. Staffing

The staffing of the Preventive Healthcare and Environment Bureau is determined by the Minister of Health's Decision and adjusted annually based on work needs proposed by the Director.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette.

This Decision replaces Decision No. 20/2005/QĐ-BYT dated July 26, 2005, of the Minister of Health regarding the functions, duties, authorities, and organizational structure of the Vietnam Preventive Healthcare Bureau.

Article 5. Responsibilities for Implementation

The Permanent Secretary of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of Bureaus, Directors of General Bureaus under the Ministry of Health, and Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
