of The General Statistics Office under the Ministry of Planning and Investment
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Statistics Law dated June 17, 2003;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;
The Prime Minister issues this Decision on principles, criteria, and allocation standards for state budget investment capital development phase 2016-2020.
DECISION:
Article 1. Position and Functions
1. The General Statistics Office is a subordinate agency under the Ministry of Planning and Investment, performing the function of advising and assisting the Minister of Planning and Investment in state management of statistics; organizing statistical activities and providing economic and social statistical information to agencies, organizations, and individuals in accordance with the law.
2. The General Statistics Office has legal personality, a seal bearing the National Emblem, a separate account, and its main office in Hanoi city.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The General Statistics Office shall perform the following tasks and powers:
1. Submit to the Minister of Planning and Investment for submission to the Government and the Prime Minister for consideration and decision;
a) Draft laws, ordinances, draft resolutions of the National Assembly and the Standing Committee of the National Assembly; draft decrees, draft decisions of the Government, and draft decisions of the Prime Minister on statistics;
b) Strategies, plans, action programs, projects, and important proposals on statistics;
c) The national statistical index system, basic statistical reporting regulations, comprehensive statistical reporting regulations, the national statistical survey program, common classification tables applicable to multiple sectors and fields; decisions on national census surveys and other important legal regulatory documents on statistics as prescribed by law.
2. Submit to the Minister of Planning and Investment for consideration and decision:
a) Regulations on disseminating statistical information, provincial, district, and commune-level statistical index systems; contents and calculation methods for key statistical indices;
b) Five-year and annual plans of the Statistical sector;
c) Other documents on the field of statistics within the authority of the Minister of Planning and Investment to issue.
3. Assist the Minister of Planning and Investment in directing, promoting, disseminating, and educating the law on statistics; and organizing the implementation of legal regulatory documents, policies, strategies, plans, programs, projects, and proposals after they have been issued and approved by competent authorities.
4. Issue documents and provide guidance on statistical classification, statistical reporting regulations, statistical surveys, administrative registration file exploitation for statistical work, and other specialized statistical business documents in accordance with the law.
5. Provide training in statistical business for personnel engaged in statistical work at Ministries, ministerial-level agencies, government agencies, the Supreme People's Court, the Supreme People's Procuracy, provincial-level People's Councils, enterprises, and public institutions.
6. Review the professional aspects of specialized statistical classification tables, basic statistical reporting regulations, comprehensive statistical reporting regulations, non-national statistical survey program investigation lists before the Minister, the head of a ministerial-level agency, the head of a government agency, the President of the Supreme People's Court, the Prosecutor-General of the Supreme People's Procuracy, the head of central agencies of mass organizations, and the Chairman of provincial-level People's Councils decide to issue them.
7. Compile statistical reports and survey results provided by Ministries, ministerial-level agencies, government agencies, the Supreme People's Court, the Supreme People's Procuracy, provincial-level People's Councils, and other agencies and units.
8. Conduct monthly, quarterly, annual, and multi-year statistical analysis and forecasting reports on economic and social conditions; reports evaluating the achievement of strategic and development plan targets; specialized statistical analysis reports and other ad hoc statistical reports.
9. Access, exploit, back up, and record initial statistical databases from agencies and units implementing basic statistical reporting regulations, comprehensive statistical reporting regulations, surveys, and administrative registration files of agencies and organizations for statistical purposes; establish, manage, and share national statistical databases and socio-economic statistical data repositories in accordance with the law.
10. Assist the Minister of Planning and Investment in managing the publication of economic and social statistical information in accordance with the law.
11. Publish information from the national statistical index system; provide economic and social statistical information to domestic and foreign agencies, organizations, and individuals in accordance with the law.
12. Compile and publish Statistical Yearbooks and other statistical products.
13. Carry out international statistics work, including collecting and compiling aggregate socio-economic data from countries and regions, conducting international statistical comparisons, and disseminating international statistical methodologies; implement international cooperation in the field of statistics in accordance with the law and the delegation of the Minister of Planning and Investment.
14. Direct and organize research and application of statistical science; apply advanced statistical methods.
15. Apply and develop information technology and communication in the process of collecting, processing, aggregating, analyzing, forecasting, disseminating, and preserving statistical information.
16. Manage organizational structures and staffing; implement salary systems, occupational allowances, and other incentive policies; conduct commendation and disciplinary actions; train and provide professional development for officers, civil servants, and employees under its jurisdiction in accordance with the law and the delegation of the Minister of Planning and Investment.
17. Implement administrative reform; prevent and combat corruption and waste; inspect, audit, and resolve complaints and denunciations against violations of law within its jurisdiction in accordance with the law.
18. Manage finance, assets, and investment projects assigned according to the law and the delegation of the Minister of Planning and Investment.
19. Provide public statistical services according to the law.
20. State management over public institutions operating under self-management and self-responsibility systems and enterprises directly under the General Statistics Office in accordance with the law.
21. Perform other tasks and powers as prescribed by law or assigned by the Minister of Planning and Investment.
Article 3. Organizational Structure
The General Statistics Office shall be organized vertically from central to local levels according to administrative units, ensuring the principle of centralized unity:
1. Central-level General Statistics Office agency:
a) Administrative organizations assisting the Director-General in performing state management functions:
- Department of National Accounts System;
- Department of Integrated Statistics; - Department of National Accounts System;
- Department of Industrial Statistics; - Department of Agriculture, Forestry and Fisheries Statistics;
- Department of Trade and Services Statistics;
- Department of Population and Labor Statistics;
- Department of Social and Environmental Statistics;
- Department of Foreign and International Cooperation Statistics;
- Cadre and Civil Servant Organization Department;
- Planning and Finance Department;
- Department of Organization and Cadres; - Department of Planning and Finance;
- Department of Legal Affairs, Propaganda and Competition - Awards;
- Inspection;
- Office (with a representative office in Ho Chi Minh City).
b) Public service organizations:
- Institute of Statistical Science;
- Center for Documentation and Statistical Services;
- Regional I Computer Statistics Center;
- Regional II Computer Statistics Center;
- Regional III Computer Statistics Center;
- Magazine Numbers and Events;
- Statistical Publishing House;
- College of Statistics;
- Secondary Statistics School.
2. Local-level statistical agencies:
a) Provincial-level Statistics Bureau in provinces and centrally governed cities (referred to collectively as Provincial-level Statistics Bureau) under the General Statistics Office.
b) District-level Statistics Sub-bureau in districts, towns, and provincial-level cities (referred to collectively as District-level Statistics Sub-bureau) under the Provincial-level Statistics Bureau. The Provincial-level Statistics Bureau and District-level Statistics Sub-bureau have legal personality, their own seals, offices, and bank accounts at the State Treasury in accordance with the law.
Article 4. Leadership of the General Statistics Office
1. The General Statistics Office shall have a Director-General and not more than three Deputy Director-Generals.
2. The Director-General and Deputy Director-Generals shall be appointed, dismissed, or removed from office by the Minister of Planning and Investment in accordance with the law. The Director-General shall specify in detail the functions, tasks, powers, and organizational structure of subordinate agencies and units of the General Statistics Office; appoint, dismiss, or remove from office the heads and deputy heads of subordinate agencies and units of the General Statistics Office in accordance with the law and the delegation of the Minister of Planning and Investment.
3. The Director-General shall be responsible to the Minister of Planning and Investment and to the law for all activities of the General Statistics Office. Deputy Director-Generals shall be responsible to the Director-General and to the law for the areas of work assigned to them.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision shall take effect from October 10, 2010. All previous documents contrary to this Decision are hereby abolished.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, Director-General of the General Statistics Office, and other relevant organizations and individuals shall be responsible for implementing this Decision./.
