DECISION
Amending and supplementing certain articles of the Regulation on the issuance and management of business travel cards
for APEC business persons issued together with Decision number 45/2006/QĐ-TTG

Article 1. Amending and supplementing certain articles of the Regulation on the issuance and management of business travel cards for APEC business persons issued together with Decision No. 45/2006/QĐ-TTg dated February 28, 2006 of the Prime Minister as follows:
"1. The purpose of the national high school examination is to use the examination results for recognizing high school graduation; provide information to evaluate the quality of secondary education; provide data as a basis for university and vocational education admissions."
"1. The ABTC has a validity period of five years from the date of issuance and shall not be extended; in case the ABTC expires, a new card will be issued."
c) Form No. 09b: Permit for Vietnamese individuals residing abroad to perform artistic performances, fashion shows.
“Article 4"Businesspersons from Vietnam who lose their ABTC must notify the Exit and Entry Administration under the Ministry of Public Security (in accordance with the form prescribed by the Ministry of Public Security) to cancel its validity and inform other countries or territories about the cancellation of the lost card."
3. Article 6 shall be amended and supplemented as follows:
"Article 6. Cases eligible for issuance of ABTC
1. Businesspersons from Vietnam working at state-owned enterprises
a) Chairperson of the Board of Members, Chairperson of the company, General Director of State-Owned Enterprises appointed by the Prime Minister;
b) Member of the Board of Members; General Director, Deputy General Director; Director, Deputy Director of industrial zones, export processing zones, economic zones; Director, Deputy Director of banks or bank branches;
c) Chief Accountant, Head of Department, Deputy Head of Department of industrial zones, export processing zones, economic zones, banks; Branch Manager of enterprises or bank branches.
2. Businesspersons from Vietnam working at enterprises established in accordance with Vietnamese laws
a) Owner of a private enterprise, Chairperson of the Board of Members, member of the Board of Members, Chairperson of the Board of Directors, member of the Board of Directors, General Director or Director of a company;
b) Chairperson of the Board of Directors, member of the Board of Directors, Director or General Director of cooperatives or cooperative unions;
c) Chief Accountant, Head of Department in enterprises; Branch Manager of enterprises and other equivalent positions.
3. Civil servants and public officials involved in APEC activities
a) Ministers, Deputy Ministers of Ministries, Heads of agencies at the ministerial level, members of the People's Councils of provinces and centrally-administered cities directly under the central government responsible for attending meetings, conferences, and economic cooperation activities of APEC;
b) Civil servants and public officials responsible for attending meetings, conferences, seminars, and other APEC activities;
c) Chief representatives, deputy chief representatives of Vietnam's trade offices in member countries and territories of APEC.
4. In cases where necessary, upon the proposal of the competent authority specified in Clause 2, Article 7 of this Regulation, the Minister of Public Security may consider and issue ABTC to individuals not covered by Clauses 1, 2, and 3 of this Article."
4. Article 7 shall be amended and supplemented as follows:
“Article 7. Competence to Approve the Use of ABTC Card
1. Cases stipulated in Point a Clause 1 and Point a Clause 3 of Article 6 of this Regulation that require the use of the ABTC card must be reported and requested for issuance of the card in writing by the Head of the agency or enterprise where they work.
2. Cases stipulated in Points b and c Clause 1, Clause 2, and Points b and c Clause 3 of Article 6 of this Regulation that require the use of the ABTC card must be examined and approved for use of the card by the Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of provinces and centrally-run cities, or Chairman of the Board of Directors appointed by the Prime Minister.
Businesspeople working at enterprises established by ministries, ministry-level agencies, or agencies under the Government but which have been equitized and no longer have state capital dominance shall have their use of the ABTC card examined and approved by the Chairman of the People's Committee of the province or centrally-run city where the enterprise is headquartered.
3. The Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of provinces and centrally-run cities, or Chairman of the Board of Directors when examining and approving businesspeople specified in Clause 2 of Article 6 of this Regulation to use the ABTC card must base it on their production and business capacity, and their ability to cooperate with partners from countries or regions that are members of the program.
5. Clause 1 of Article 9 is amended as follows:
“1. Cases stipulated in Article 6 of this Regulation that require issuance of the ABTC card shall handle procedures at the immigration management agency under the Ministry of Public Security, with the dossier including:
- One application form for requesting issuance of the ABTC card, affixed with a photograph and stamped with a cross-stamp and confirmed by the Head of the enterprise or the personnel organization agency of economic sectors or specialized state management agencies regarding the activities of enterprises (in accordance with the model prescribed by the Ministry of Public Security);
- A notification letter requesting issuance of the ABTC card or a letter permitting use of the ABTC card issued by the competent authority as stipulated in Clause 1 and Clause 2 of Article 7 of this Regulation.”
6. Clause 1 of Article 12 is amended as follows:
“1. In cases where the ABTC card remains valid but the businessperson requests reissuance.”
7. Point a Clause 1 of Article 13 is amended and supplemented as follows:
“a) For cases stipulated in Clause 1 of Article 12 of this Regulation, the dossier includes:
- One application form for requesting issuance of the ABTC card, affixed with a photograph and stamped with a cross-stamp and confirmed by the Head of the enterprise or the personnel organization agency of economic sectors or specialized state management agencies regarding the activities of enterprises (in accordance with the model prescribed by the Ministry of Public Security);
- A letter permitting use of the ABTC card issued by the competent authority as stipulated in Clause 1 and Clause 2 of Article 7 of this Regulation. If the person requesting reissuance of the ABTC card is confirmed by the agency or enterprise where they work that there has been no change in position or job title compared to the previous request for issuance of the ABTC card, then there is no need to submit the letter of permission from the competent authority;
- The previously issued ABTC card.”
In cases of reissuing the ABTC card due to supplementing the names of member countries and territories onto the card, only a request letter for reissuance of the card from the agency or enterprise where the person works needs to be submitted.
8. Point d Clause 1 of Article 13 is amended and supplemented as follows:
“d) For cases stipulated in Clause 4 of Article 12 of this Regulation, the dossier includes:
- One application form for requesting issuance of the ABTC card, affixed with a photograph and stamped with a cross-stamp and confirmed by the Head of the enterprise or the personnel organization agency of economic sectors or specialized state management agencies regarding the activities of enterprises (in accordance with the model prescribed by the Ministry of Public Security);
- A notification letter reporting loss of the ABTC card in accordance with Article 4 of this Regulation.”
9. Clause 2 of Article 13 is amended and supplemented as follows:
“2. Validity period of the reissued ABTC card:
a) The ABTC card reissued according to Clause 1 and Clause 6 of Article 12 of this Regulation will have a validity period of five years from the date of issuance of the new card;
b) The ABTC card reissued according to Clause 2, Clause 3, Clause 4, and Clause 5 of Article 12 of this Regulation will have a validity period of five years from the date of issuance of the old card.”
10. Clause 3 of Article 18 is amended as follows:
“3. Agencies, organizations, and enterprises are responsible for coordinating with functional agencies to manage the activities of businesspeople using the ABTC card upon entry into Vietnam in accordance with the purpose of entry and coordinating with accommodation facilities to implement temporary residence registration for businesspeople in accordance with the law.”
11. Add Article 20a on transitional provisions as follows:
“Article 20a. Transitional Provisionsdevelopmentn continue
ABTC cards issued before September 1, 2015, which still have validity periods, will continue to be used until the end of the validity period indicated on the card.”
Article 2. Effective Date
This Decision takes effect from December 15, 2015.
