CIRCULAR

Issuing 30 technical safety inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under its management authority

Pursuant to Decree No. 45/2013/NĐ-CP dated May 10, 2013 of the Government detailing certain provisions of the Labor Code on working hours, rest periods, and labor safety and hygiene.

Pursuant to the Law on Occupational Safety and Health dated June 25, 2016;

Pursuant to Decree No. 106/2012/ND-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Decree No. 44/2016/ND-CP dated May 15, 2016 of the Government detailing certain provisions of the Law on Occupational Safety and Health regarding technical safety inspection activities, occupational safety and health training, and workplace environmental monitoring;

At the proposal of the Director of the Department of Occupational Safety and Health;

The Minister of Labor, Invalids and Social Affairs issues this Circular issuing 30 technical safety inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Labor, Invalids and Social Affairs.

Article 1. Scope of Regulation and Applicability

1. This Circular hereby promulgates 30 technical safety inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Labor, Invalids and Social Affairs. The names and codes of these procedures are listed in the Appendix.

2. This Circular applies to organizations engaged in technical safety inspection activities, technical safety inspectors conducting technical safety inspections of machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Labor, Invalids and Social Affairs.

Article 2. Effective Date

1. This Circular takes effect from June 1, 2017.

2. Repeal Circular No. 07/2014/TT-LDTBXH dated March 6, 2014 of the Ministry of Labor, Invalids and Social Affairs promulgating 27 technical safety inspection procedures for machinery and equipment with strict requirements for labor safety under the responsibility of the Ministry of Labor, Invalids and Social Affairs and Circular No. 46/2015/TT-LDTBXH dated November 16, 2015 of the Ministry of Labor, Invalids and Social Affairs promulgating technical safety inspection procedures for electric hoists running on tracks; hand chain hoists with a load capacity of 1,000 kg or more; vertical elevator shafts; inclined elevator shafts; mobile stage floors and oil heating boilers.

Article 3. Implementation organization

1. The Department of Occupational Safety and Health, the Ministry of Labor, Invalids and Social Affairs, technical safety inspection organizations, and related organizations and individuals are responsible for implementing this Circular.

2. In the course of implementation, if there are difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Labor, Invalids and Social Affairs for research and resolution.
