Article 5. Authority over public service units directly under the Ministry of Industry and Trade
The Minister of Industry and Trade:
1. Proposes the Prime Minister to decide on establishing new units, renaming, merging, dissolving, and converting the form of operation of public service units under the Ministry that fall within the Prime Minister's decision-making authority.
Specifically, the conversion of the form of operation of research institutes under the Ministry of Industry and Trade shall be carried out in accordance with Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government on the mechanism of self-management and responsibility of public scientific and technological organizations and Decree No. 80/2007/NĐ-CP dated May 19, 2007 of the Government on scientific and technological enterprises.
2. Proposes the Minister of Education and Training to decide on establishing new colleges, renaming, merging, and dissolving colleges under the Ministry of Industry and Trade in accordance with the law.
3. Proposes the Minister of Labor, Invalids, and Social Affairs to decide on establishing new vocational colleges, renaming, merging, and dissolving vocational colleges under the Ministry of Industry and Trade in accordance with the law.
4. Decides on establishing new units, renaming, merging, dissolving, and converting the form of operation of public service units under the Ministry within his/her authority; stipulates the functions, tasks, powers, and organizational structure of public service units under the Ministry, except where otherwise provided by law.
Article 6. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature and abolishes previous regulations contrary to this Decision.
2. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of provincial People's Committees, centrally governed cities, relevant agencies, organizations, units, and individuals are responsible for implementing this Decision./.
