Establishing and defining the position, functions, tasks, powers, structure, and organization of the office of the National Assembly delegation and People's Council at provincial level and centrally governed cities

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

Pursuant to the Law on the Organization of the National Assembly;

Pursuant to the Law on the Organization of the People's Council and People's Committee;

Pursuant to the Rules of Procedure of Deputies and Delegation of the National Assembly issued together with Resolution No. 08/2002/QH11;

Pursuant to the Rules of Procedure of the People's Council issued together with Resolution No. 753/2005/NQ-UBTVQH11;

After reaching consensus with the Government;

Considering the proposal of the Head of the Delegation Work Committee,

RESOLUTION:

Article 1.

1\. Establish the Office of the National Assembly Delegation and People's Council at provincial level and centrally governed cities (hereinafter referred to as the Office of the National Assembly Delegation and People's Council) based on the merger of the Office of the National Assembly Delegation and the Office of the People's Council at provincial level and centrally governed cities.

The Standing Body of the People's Council at provincial level and centrally governed cities shall decide to establish the Office of the National Assembly Delegation and People's Council after reaching consensus with the Head of the National Assembly Delegation.

2\. The Office of the National Assembly Delegation and People's Council is an assisting body of the National Assembly Delegation and People's Council at provincial level and centrally governed cities (hereinafter referred to as the provincial level) with the task of advising and organizing services for the activities of the National Assembly Delegation, the Head of the Delegation, Deputy Heads of the Delegation, National Assembly deputies, the People's Council, the Standing Body of the People's Council, Committees of the People's Council, and People's Council deputies at the provincial level.

3\. The Office of the National Assembly Delegation and People's Council has legal personality, has a seal, and is allowed to open an account at the State Treasury in accordance with the provisions of the law.

Article 2.

1\. In organizing services for the activities of the National Assembly Delegation, the Head of the Delegation, Deputy Heads of the Delegation, and National Assembly deputies, the Office of the National Assembly Delegation and People's Council shall have the following tasks:

a\. Advising on the development of work programs and activity plans monthly, quarterly, semi-annually, and annually for the National Assembly Delegation; organizing services for the implementation of approved programs and plans;

b\. Serving the National Assembly Delegation and National Assembly deputies in directly contributing opinions, organizing the collection of opinions on draft Laws, draft Ordinances, draft Resolutions, and other documents as required by the Standing Committee of the National Assembly;

c\. Serving the National Assembly Delegation and National Assembly deputies in their supervisory activities; monitoring and urging relevant agencies, organizations, and individuals to implement recommendations in supervisory conclusions;

d\. Serving the National Assembly Delegation and National Assembly deputies in receiving citizens' visits, receiving and processing complaints and petitions from citizens; monitoring and urging the resolution of complaints and petitions and citizen recommendations;

đ\. Coordinating with relevant agencies and organizations to serve National Assembly deputies in meeting with voters; assisting the Head of the National Assembly Delegation in compiling comprehensive reports on voter opinions and recommendations to be submitted to the Standing Committee of the National Assembly and responsible agencies and organizations for consideration and resolution;

e\. Assisting the Head of the Delegation and Deputy Heads of the Delegation in summarizing the activities of the Delegation to report to the Standing Committee of the National Assembly, maintaining contact with National Assembly deputies; serving the National Assembly Delegation and National Assembly deputies during sessions of the National Assembly and in external activities;

2\. In organizing services for the activities of the People's Council, the Standing Body of the People's Council, Committees of the People's Council, and People's Council deputies at the provincial level, the Office of the National Assembly Delegation and People's Council shall have the following tasks:

a\. Advising on the development of work programs and activity plans monthly, quarterly, semi-annually, and annually for the People's Council, the Standing Body of the People's Council, and Committees of the People's Council; organizing services for the implementation of approved programs and plans;

b\. Advising and serving the Standing Body of the People's Council in managing the general operations of the People's Council; coordinating and harmonizing the activities of Committees of the People's Council; ensuring the implementation of the Rules of Procedure of the People's Council, the Standing Body of the People's Council, Committees of the People's Council, and the Rules of Procedure of the People's Council session; assisting the Standing Body of the People's Council in maintaining contact with Representative Groups and People's Council deputies; serving the People's Council, the Standing Body of the People's Council, and Committees of the People's Council in external activities;

c\. Assisting the Standing Body of the People's Council in developing programs and organizing services for People's Council sessions, meetings of the Standing Body of the People's Council, and Committee meetings; urging relevant agencies and organizations to prepare materials for People's Council sessions, meetings of the Standing Body of the People's Council, and Committee meetings;

d\. Assisting the Standing Body of the People's Council and Committees of the People's Council in preparing work reports; serving Committees of the People's Council in reviewing proposals, reports, and draft resolutions; assisting the Secretary of the People's Council session in finalizing the Resolution of the People's Council; assisting the Standing Body of the People's Council in perfecting the resolutions of the People's Council;

đ\. Serving the People's Council, the Standing Body of the People's Council, Committees of the People's Council, and People's Council deputies in their supervisory activities; monitoring and urging relevant agencies, organizations, and individuals to implement recommendations in supervisory conclusions;

e\. Serving the People's Council, the Standing Body of the People's Council, Committees of the People's Council, and People's Council deputies in receiving citizens' visits, receiving and processing complaints and petitions from citizens; monitoring and urging the resolution of complaints and petitions and citizen recommendations;

g\. Coordinating with relevant agencies and organizations to serve People's Council deputies in meeting with voters; assisting the Standing Body of the People's Council in compiling voter opinions and recommendations and submitting them to responsible agencies and organizations for consideration and resolution;

h\. Serving the Standing Body of the People's Council in collecting opinions on draft Laws, draft Ordinances, and other documents as required by the Standing Committee of the National Assembly;

i) Serve the Standing Committee of the People's Council in the work of electing members of the National Assembly and electing representatives of all levels of People's Councils; approve the results of the election of Chairperson, Vice-Chairpersons, and regular members of the People's Council at the lower level directly under its jurisdiction;

k) Serve the Standing Committee of the People's Council and Committees of the People's Council in the work of holding meetings, exchanging experiences, and training skills for representatives of all levels of People's Councils;

3. In addition to the tasks prescribed in Clause 1 and Clause 2 of this Article, the Office of the National Assembly Delegation and People's Council shall also perform the following tasks:

a) Serve the National Assembly Delegation, the Head of the Delegation, Deputy Heads of the National Assembly Delegation, the People's Council, the Standing Committee of the People's Council, Committees of the People's Council in maintaining working relations with central agencies and provinces/cities directly under the Central Government, the Standing Committee of the Provincial Party Committee, Municipal Party Committee, People's Committee, Vietnam Fatherland Front Committee, People's Court, People's Procuracy, and other agencies, organizations, and mass organizations at the local level;

b) Serve the Head of the National Assembly Delegation and the Standing Committee of the People's Council in preparing annual budget estimates for activities, organizing implementation, and managing activity funds of the National Assembly Delegation and the People's Council;

c) Ensure conditions for the operation of the National Assembly Delegation, the Head of the Delegation, Deputy Heads of the National Assembly Delegation, National Assembly delegates, the People's Council, the Standing Committee of the People's Council, Committees of the People's Council, Delegation Groups of the People's Council, and People's Council delegates; serve the Head of the National Assembly Delegation and the Standing Committee of the People's Council in implementing systems and policies for National Assembly delegates and People's Council delegates;

d) Manage material resources, scientific research activities, administrative work, archives, security, and reception services of the agency, the National Assembly Delegation, and the People's Council;

đ) Participate in planning, drafting training plans, and implementing personnel management for civil servants and officials of the Office of the National Assembly Delegation and People's Council in accordance with the law;

e) Perform other tasks assigned by the Head of the Delegation, Deputy Heads of the National Assembly Delegation, and the Standing Committee of the People's Council;

Article 3.

1. The Office of the National Assembly Delegation and People's Council has a Director and not more than three Deputy Directors. The Standing Committee of the People's Council, after reaching consensus with the Head of the National Assembly Delegation, appoints, dismisses, or removes the Director and Deputy Directors;

2. The Office of the National Assembly Delegation and People's Council has a Representative Work Department, a People's Council Work Department, and an Administrative - Organization - Management Department;

Based on the actual situation of the locality and genuine needs, the Standing Committee of the People's Council, after reaching consensus with the Head of the National Assembly Delegation, decides to establish additional departments;

The functions, tasks, and staffing of each department are decided by the Standing Committee of the People's Council after reaching consensus with the Head of the National Assembly Delegation. Each department has a Head and not more than two Deputy Heads. The Director, after seeking opinions from the Standing Committee of the People's Council and the Head of the National Assembly Delegation, appoints or removes the Heads and Deputy Heads of departments;

3. The staffing of the Office of the National Assembly Delegation and People's Council is within the total administrative staffing of the locality allocated by the Provincial People's Committee after reaching consensus with the Head of the National Assembly Delegation and the Standing Committee of the People's Council;

4. The Office of the National Assembly Delegation and People's Council operates under a directorate system. The Director is the head of the Office, oversees general operations, and is responsible before the Standing Committee of the People's Council, the Head, and Deputy Heads of the National Assembly Delegation, and before the law for all activities of the Office. Deputy Directors assist the Director in performing tasks as assigned by the Director;

5. The Office of the National Assembly Delegation and People's Council has a working regulation. The working regulation is issued by the Director;

Article 4.

The operating expenses of the Office of the National Assembly Delegation and People's Council are included in the operating expenses of the National Assembly Delegation and People's Council;

Article 5.

1. The Office of the National Assembly Delegation and People's Council maintains working relationships with the Office of the Provincial Party Committee, Municipal Party Committee, Office of the People's Committee, Standing Committee of the Vietnam Fatherland Front, provincial-level departments, and other agencies, organizations, and units at the local level to coordinate in serving the activities of the National Assembly Delegation and People's Council;

2. The Office of the National Assembly, the Office of the Government, the Ministry of Home Affairs, and the Representative Work Committee under the Standing Committee of the National Assembly guide the activities of the Office of the National Assembly Delegation and People's Council according to their respective functions and responsibilities;

Article 6.

The Director of the Office of the National Assembly, the Minister - Director of the Office of the Government, Ministers, Heads of Ministries equivalent to Ministries, the Head of the Representative Work Committee, the National Assembly Delegation, the People's Council, and the People's Committee of provinces/cities directly under the Central Government shall implement this Resolution according to their responsibilities;

Article 7.

1. This Resolution takes effect from January 1, 2008;

2. This Resolution replaces Resolution No. 416/NQ-UBTVQH11 dated September 25, 2003 of the Standing Committee of the National Assembly and Decree No. 133/2004/NĐ-CP dated June 9, 2004 of the Government. Abolish Paragraph 1 and Paragraph 2 of Article 79 of the Operation Regulation of the People's Council issued together with Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 of the Standing Committee of the National Assembly./.
