Decision No. 548/2009/QD-TTg On Supporting the Replacement of Agricultural and Utility Vehicles; Motorized Tricycles; Three-Wheeled and Four-Wheeled Non-Motorized Vehicles Prohibited from Traffic Participation

Article 1. Implementing support for owners of vehicles that are agricultural and utility vehicles; motorized rickshaws; three-wheeled motor vehicles; three- and four-wheeled non-motorized vehicles prohibited from participating in traffic when changing vehicles or occupations as follows:

1. The subjects eligible for support are the owners of vehicles of types prohibited from participating in traffic, including:

a) Three-wheeled and four-wheeled non-motorized vehicles prohibited from participating in traffic in localities;

b) Three-wheeled motor vehicles that have been registered and assigned license plates but are prohibited from participating in traffic because their operating areas fall within regions where provincial People's Committees have stipulated "prohibition of three-wheeled motor vehicles from participating in traffic," and the vehicle owners cannot move their vehicles to operate in other areas;

c) Three-wheeled motor vehicles without registration and license plates as required;

d) Motorized rickshaws (two-wheeled motor vehicles towing trailers for carrying people and goods); agricultural vehicles assembled from single-cylinder diesel engines and reused automobile components (also known as side-loading vehicles, modified vehicles).

2. Conditions for receiving support:

a) Owners of vehicles prohibited from participating in traffic as specified in Clause 1 of this Article;

b) Having a residence address confirmed by the People's Committee of the commune, ward, or town where they reside.

3. Level of support:

a) For the case of purchasing three-wheeled or four-wheeled motor vehicles (types permitted to circulate according to the law) or changing occupations to replace vehicles prohibited from participating in traffic: the level of support is VND 5 million for each vehicle to be replaced;

b) For the case of purchasing trucks to replace vehicles prohibited from participating in traffic; in addition to the VND 5 million support for each vehicle to be replaced, there is an additional VND 4 million for each new truck purchased. The number of new trucks supported shall not exceed the number of vehicles to be replaced.

4. The period for implementing support: until December 31, 2009.

5. Regarding the method of support: it will be implemented through the State Treasury based on complete documentation and confirmation by relevant agencies as prescribed.

Article 2. Based on specific conditions and budget capabilities of each locality, the Chairman of the Provincial People's Committee or the People's Committee of centrally governed cities decides on special preferential policies for subjects who are war invalids, persons with disabilities, policy households, and households in difficult areas.

Article 3. Sources of funds for implementation

1. The central government budget supports 100% of the costs for localities that have not yet achieved budget self-sufficiency.

2. The central government budget supports 50% of the costs for localities with a distribution rate of revenue below 50% transferred to the central government budget, including: Hai Phong, Quang Ninh, Vinh Phuc, Da Nang, Khanh Hoa, Can Tho.

3. The remaining localities allocate from their local budgets.

Article 4Implementation Organization

1. The Chairmen of the People's Committees of provinces and centrally governed cities are responsible for:

a) Directing, organizing, and supervising the implementation of the support policy for replacing agricultural and utility vehicles; motorized rickshaws; three-wheeled motor vehicles; three- and four-wheeled non-motorized vehicles prohibited from participating in traffic as prescribed in this Decision within their jurisdictions;

b) Directing relevant functional agencies of the locality to handle violations of the law by subjects who have received support funds under this Decision but have not implemented vehicle replacement or occupation change;

c) Regularly reporting quarterly and annually on the results of implementation to the Ministry of Finance and the Ministry of Transport.

2. The Ministry of Finance, in collaboration with the Ministry of Transport, will guide the detailed implementation of this Decision.

Article 5. This Decision takes effect from the date of signature and applies nationwide. Households in northern mountainous provinces and the Central Highlands receiving support for replacing agricultural and utility vehicles beyond their service life under Decision No. 1491/QĐ-TTg dated November 8, 2007 of the Prime Minister shall not be entitled to the support policy for purchasing trucks issued together with this Decision.

Article 6. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
