PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 103/1999/NĐ-CP dated September 10, 1999 of the Government on the transfer, sale, lease, and management of state-owned enterprises;

Pursuant to the proposal of the Chairman of the Central Enterprise Management Reform Board; 

Pursuant to …;:

Article 1. The Prime Minister hereby delegates to the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under the central government, and the Board of Directors of State Corporation 91 the authority to decide on the sale, contractual management, and lease of state enterprises under their management with state capital from one billion to less than five billion dong that have been suffering losses for a prolonged period but have not yet reached a state of bankruptcy, except for state enterprises that are state-owned farms, state-owned forestry farms, and state enterprises operating in consultancy, design, and inspection services.

Article 2. Annually, based on the overall restructuring plan for state enterprises that has been approved, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under the central government, and the Board of Directors of State Corporation 91 shall report to the Prime Minister on the plans and implementation status of the sale, contractual management, and lease of state enterprises as stipulated in Article 1 of this Decision.

Article 3. Those authorized shall be responsible for coordinating with relevant ministries, sectors, and agencies to address issues related to labor, finance, and policies applicable to these enterprises undergoing such transformation processes, ensuring compliance with current laws.

Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under the central government, the Board of Directors of State Corporation 91, and Heads of related agencies are responsible for implementing this Decision.
