Pursuant to Resolution No. 09/1998/NQ-CP dated July 31, 1998 of the Government on strengthening crime prevention and suppression work in the new situation;

Pursuant to Decision No. 59/2004/QĐ-TTg dated April 9, 2004 of the Prime Minister on the establishment of the Steering Committee for the National Program on Crime Prevention and Suppression;

Considering the proposal of the Minister of Public Security,

 DECISION:

Article 1. Issued together with this Decision is the Regulation on the Operation of the Steering Committee for the National Program on Crime Prevention and Suppression (referred to as the Steering Committee 138/CP).138/CP).

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-run cities, and members of the Steering Committee 138/CP are responsible for implementing this Decision./.

REGULATIONS

ACTIVITIES OF THE STEERING COMMITTEE FOR THE NATIONAL PROGRAM
ON CRIME PREVENTION AND SUPPRESSION

(Issued pursuant to Decision No. 55/2005/QĐ-TTg dated March 18, 2005)

of the Prime Minister)

 

PART I

GENERAL PROVISIONS

Article 1. The Steering Committee for the National Program on Crime Prevention and Suppression (referred to as the Steering Committee 138/CP) established by Decision No. 59/2004/QĐ-TTg dated April 9, 2004 of the Prime Minister is an advisory body assisting the Prime Minister in directing the implementation of Resolution No. 09/1998/NQ-CP dated July 31, 1998 of the Government on strengthening crime prevention and suppression work in the new situation and Decision No. 138/1998/QĐ-TTg dated July 31, 1998 of the Prime Minister approving the National Program on Crime Prevention and Suppression.

Article 2. The Steering Committee 138/CP shall be responsible for performing the tasks specified in Article 3 of Decision No. 59/2004/QĐ-TTg dated April 9, 2004 of the Prime Minister on the establishment of the Steering Committee for the National Program on Crime Prevention and Suppression, including:

1. Directing, inspecting, urging, and guiding ministries, sectors, mass organizations, People's Committees of provinces and centrally-run cities in implementing Resolution No. 09/1998/NQ-CP and the National Program on Crime Prevention and Suppression.

2. Developing strategies and plans for crime prevention and suppression in each period. Directing ministries, sectors, mass organizations, and localities to coordinate in carrying out crime prevention and suppression work; directing coordination among functional agencies, forces combating dangerous criminal gangs operating across multiple areas, and complex and serious cases.

3. Proposing to the Government to build and perfect legal regulations related to crime prevention and suppression work.

4. Serving as the focal point for coordinating actions and international cooperation in crime prevention and suppression.

5. Annually, the Steering Committee will conduct a review of the implementation of the reporting system to the Prime Minister on crime prevention and suppression work.

 

Chapter II

PRINCIPLES OF OPERATION

Article 3. The Steering Committee 138/CP shall be responsible for guiding and directing the implementation of Resolution No. 09/1998/NQ-CP and the National Program on Crime Prevention and Suppression by ministries, sectors, mass organizations, and localities. Ensuring concentration, unity, and effectiveness.

Article 4. The Steering Committee 138/CP shall convene regular meetings every six months. Annually, it will conduct a review and implement the reporting system to the Prime Minister. Members of the Steering Committee shall fulfill the periodic reporting system every three months, six months, and annually (in addition to ad hoc reports) on the implementation of Resolution No. 09/1998/NQ-CP and the National Program on Crime Prevention and Suppression at the ministries, sectors, mass organizations, and localities they are assigned to monitor, and other work contents as assigned by the Chairman.

Article 5. In cases where members of the Steering Committee go on long-term business trips or study (three months or more) or there are changes in personnel, they must notify the Chairman of the Steering Committee (through the Office of the Permanent Secretariat of the Steering Committee) to coordinate activities according to the planned program and schedule.

 

Chapter III

ASSIGNMENT OF RESPONSIBILITIES

Article 6.

1. The Deputy Prime Minister, Chairman of the Steering Committee 138/CP, acting on behalf of the Prime Minister: directs and manages the implementation of Resolution No. 09/1998/NQ-CP and the National Program for Crime Prevention and Control; directly directs competent agencies in handling serious cases. Report to the Prime Minister as prescribed.

2. The Minister of Public Security, Vice-Chairman, is responsible for: assisting the Chairman in organizing and directing the implementation of activities according to the program and plan set by the Steering Committee and representing the Chairman in managing tasks assigned by the Chairman.

3. Standing Members: are responsible for assisting the Chairman and Vice-Chairman in organizing and directing the management of tasks according to the program and plan of the Steering Committee and the Office of the Permanent Secretariat of the Steering Committee.

4. Members of the Steering Committee are responsible for: participating in building the program and plan of activities of the Steering Committee; directly directing and managing the implementation of Resolution No. 09/1998/NQ-CP and the National Program for Crime Prevention and Control in their respective sectors and localities according to their assigned functions and responsibilities; performing specific tasks as assigned by the Chairman.

Article 7. The Steering Committee 138/CP uniformly manages the budget allocated from the state budget to implement the National Program for Crime Prevention and Control; prepares comprehensive estimates and plans for budget allocation to ministries, sectors, and localities; checks the use of funds in accordance with current regulations.

Article 8. The Office of the Permanent Secretariat of the Steering Committee 138/CP (located at the General Police Department - Ministry of Public Security) serves as the supporting agency of the Steering Committee, with the following duties:

1. Studying and proposing the construction of the program and plan of activities of the Steering Committee and assisting the Steering Committee in coordinating activities according to the established program and plan.

2. Assisting the Steering Committee in monitoring, inspecting, guiding, compiling, and reporting on the situation and results of implementing programs, plans, projects, and programs; carrying out commendation work for collectives and individuals who have outstanding achievements in crime prevention and control work.

3. Assisting the Steering Committee and the Ministry of Public Security in managing the use of program funds.

4. Ensuring communication among members of the Steering Committee, between the Steering Committee 138/CP and the Steering Committees for the National Program for Crime Prevention and Control of ministries, sectors, mass organizations, and People's Committees of provinces and centrally-administered cities; keeping records, performing clerical work, managing materials and equipment of the Steering Committee.

5. Preparing content, agendas, and documents for meetings of the Steering Committee.

The Office of the Permanent Secretariat of the Steering Committee 138/CP is headed by one Director and several Deputy Directors, including specialized units of the Ministry of Public Security and a team of inter-sectoral experts (experts from member ministries and sectors of the Steering Committee), working under the direct leadership and management of Standing Members of the Steering Committee./.
