THE MINISTER OF HEALTH

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Considering the proposal of the Director of the Personnel Department and the Director of the Department of HIV/AIDS Prevention and Control, Ministry of Health.

DECISION:

Article 1. Position and Functions.

1. The Department of HIV/AIDS Prevention and Control is a specialized department under the Ministry of Health, assisting the Minister of Health in performing state management functions and organizing the implementation of laws, directing, managing, inspecting, and supervising HIV/AIDS prevention and control activities nationwide.

2. The Department of HIV/AIDS Prevention and Control has legal personality, its own seal and bank account, and its headquarters is located in Hanoi. The operating budget of the Department is provided by the state budget and other legitimate sources of funding.

Article 2. Tasks and Authorities

1. To take the lead in drafting strategies, planning, and annual plans for HIV/AIDS prevention and control, to submit to the Minister of Health for approval or to have the Minister submit to competent authorities for approval.

2. To take the lead in drafting, amending, and supplementing regulatory legal documents, policies, and systems related to HIV/AIDS prevention and control, to submit to the Minister of Health for issuance or to have the Minister submit to competent authorities for issuance.

3. To take the lead or coordinate in drafting technical tier regulations, professional rules, and national technical standards related to HIV/AIDS prevention and control, to submit to competent authorities for issuance.

4. To assist the Minister of Health in serving as the permanent representative on HIV/AIDS prevention and control for the National Committee for HIV/AIDS and Prostitution Prevention.

5. To manage and direct HIV/AIDS prevention and control activities nationwide; to serve as the focal point for managing and directing professional activities related to HIV/AIDS prevention and control for relevant ministries and sectors.

6. To manage, direct, and take the lead in organizing the implementation of the following contents:

a) Information, education, communication, and community mobilization for HIV/AIDS prevention and control;

b) Harm reduction interventions to prevent HIV transmission;

c) HIV counseling and testing;

d) Prevention of occupational HIV exposure due to accidents and risks;

đ) Surveillance of HIV/AIDS/STIs, monitoring, and evaluating HIV/AIDS prevention and control programs;

e) Treatment and care for people living with HIV/AIDS; prevention of mother-to-child HIV transmission; coordination in preventing sexually transmitted diseases and co-infections of Tuberculosis and HIV;

g) Scientific research, training, and professional development in the field of HIV/AIDS prevention and control;

h) Editing, publishing, and distributing the "AIDS and Community Journal".

7. To take the lead in managing, directing, coordinating, and implementing international cooperation projects in the field of HIV/AIDS prevention and control.

8. To advise the Minister on inter-sectoral collaboration in HIV/AIDS prevention and control.

9. To take the lead or coordinate with relevant units in organizing inspections and proposing measures to address violations in the field of HIV/AIDS prevention and control according to the law; to participate in inspection teams regarding professional activities in HIV/AIDS prevention and control.

10. To manage staff, civil servants, officials, assets, and allocated funds according to the law and the delegation of authority by the Minister of Health.

11. To take the lead and coordinate with Departments, Bureaus, General Departments, the Office of the Ministry, and the Inspectorate of the Ministry of Health in managing and directing professional activities of the HIV/AIDS prevention and control network at lower levels.

12. To perform other tasks assigned by the Minister of Health.

Article 3. Organizational Structure and Operations

1. Leadership of the General Department

The leadership of the General Department for HIV/AIDS Prevention and Control includes the Director and Deputy Directors appointed and relieved from duty by the Minister of Health.

The Director is responsible to the Minister of Health and to the law for all activities of the General Department.

The Deputy Directors assist the Director, and are responsible to the Director and to the law for the tasks assigned to them.

2. Organization of the General Department

a) Office of the Department;

b) Planning and Finance Department;

c) Surveillance, Monitoring, and Evaluation Division;

d) Treatment and Care Division for HIV/AIDS;

đ) Prevention Intervention Division for HIV Transmission;

e) Communication and Community Mobilization Division;

g) Research, Science, and International Cooperation Division;

h) Attached Unit of the General Department: AIDS and Community Magazine.

3. Operation Mechanism

a) The General Department for HIV/AIDS Prevention and Control operates under the head system;

b) The functions, tasks, and authorities of the General Department's Office, divisions within the General Department, and AIDS and Community Magazine are defined by the Director based on the functions, tasks, and authorities of the General Department for HIV/AIDS Prevention and Control delegated by the Minister of Health. The working relationships between the General Department's Office, divisions within the General Department, and AIDS and Community Magazine are also defined by the Director;

c) The appointment and removal of leadership positions at the General Department's Office and divisions within the General Department, and leadership positions at AIDS and Community Magazine shall be carried out in accordance with current laws;

d) Leaders of the General Department, leaders of the General Department's Office, leaders of divisions within the General Department, and leaders of AIDS and Community Magazine shall receive allowances as prescribed by law.

4. Staffing

The staffing of the General Department for HIV/AIDS Prevention and Control is determined by the Decision of the Minister of Health and adjusted annually based on work needs proposed by the Director.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette.

This Decision replaces Decision No. 21/2005/QĐ-BYT dated July 26, 2005 of the Minister of Health regarding the functions, tasks, authorities, and organizational structure of the General Department for HIV/AIDS Prevention and Control of Vietnam.

Article 5. Responsibilities for Implementation

The Permanent Secretaries of the Ministry, the Inspector General of the Ministry, Heads of Departments, Directors of General Departments, Directors of General Bureaus under the Ministry of Health, and Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
