CIRCULAR
REGULATIONS AND GUIDELINES FOR IMPLEMENTING CERTAIN ARTICLES OF THE GOVERNMENT DECREE NO. 38/2014/NĐ-CP OF MAY 6, 2014 ON THE MANAGEMENT OF CHEMICALS UNDER THE CONTROL OF THE CHEMICAL WEAPONS CONVENTION
Pursuant to Decision No. 167 HĐ/CTN dated August 24, 1998 of the President approving the Chemical Weapons Convention on the prohibition of development, production, stockpiling, use, and destruction of chemical weapons;
Pursuant to Government Decree No. 38/2014/NĐ-CP dated May 6, 2014 on the management of chemicals under the control of the Chemical Weapons Convention on the prohibition of development, production, stockpiling, use, and destruction of chemical weapons;
Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

The Minister of Industry and Trade issues this Circular to provide detailed regulations and guidelines for implementing certain articles of Government Decree No. 38/2014/NĐ-CP dated May 6, 2014 on the management of chemicals under the control of the Chemical Weapons Convention on the prohibition of development, production, stockpiling, use, and destruction of chemical weapons.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular provides guidelines for implementation and sets out specific provisions:
a) Guidelines for implementing conditions for the production of chemicals in Table 1, chemicals in Table 2, chemicals in Table 3 (hereinafter referred to as chemicals in Tables), and chemicals DOC, DOC-PSF;
b) Specific provisions on forms, production licenses, reissue or adjustment permits; declaration forms for production, business, processing, consumption, storage; request letters, export and import permits; notification and declaration forms for chemicals in Tables; declaration forms for chemicals DOC, DOC-PSF; documents and materials meeting the conditions for producing chemicals in Tables.
2. Transit activities, transshipment trade, temporary import for re-export, temporary export for re-import of chemicals in Tables shall be carried out in accordance with the Law on Trade, Government Decree No. 187/2013/NĐ-CP dated November 20, 2013 detailing and guiding the implementation of the Law on Trade regarding international goods trading activities and foreign goods agency buying, selling, processing, and transit activities, and other guiding documents.
Article 2. Applicability
This Circular applies to organizations and individuals participating in, and those related to the production, business, processing, consumption, storage, export, and import of chemicals under the control of the Chemical Weapons Convention in Vietnam.
Article 3. Responsibilities of organizations and individuals
1. Production, business, processing, consumption, storage, export, and import of chemicals must not violate the provisions of Article 8 of Government Decree No. 38/2014/NĐ-CP dated May 6, 2014 on the management of chemicals under the control of the Chemical Weapons Convention on the prohibition of development, production, use, stockpiling, and destruction of chemical weapons (hereinafter referred to as Decree No. 38/2014/NĐ-CP).
2. Compliance with and fulfillment of production, export, and import conditions stipulated in Decree No. 38/2014/NĐ-CP, and only engage in production, export, and import after obtaining permission from the competent authority.
3. Export and import of chemicals in Table 1 and chemicals in Table 2 can only be conducted with member states of the Chemical Weapons Convention. The list of member states of the Chemical Weapons Convention is updated on the Ministry of Industry and Trade's electronic portal.
4. Responsibility for the accuracy of export and import declaration data; management and use of imported chemicals in accordance with their intended purpose and relevant laws.
5. Compliance with periodic and extraordinary reporting systems as stipulated in this Circular; adherence to inspections and checks by the competent authority.
6. Retention of customer information for at least five (5) years for chemicals in Table 1 and at least two (2) years for chemicals in Table 2, chemicals in Table 3, and chemicals DOC, DOC-PSF, even if the organization or individual ceases operations related to chemicals. In cases where a chemical facility has multiple branches, the chemical data must include all relevant information of these branches.
Chapter II
GUIDELINES FOR IMPLEMENTING PRODUCTION CONDITIONS FOR CHEMICALS IN TABLES AND CHEMICALS DOC, DOC-PSF. DOCUMENTS AND MATERIALS IN APPLICATION FILES AND FORMS
Section 1. GUIDANCE ON IMPLEMENTING THE CONDITIONS FOR PRODUCING CHEMICALS LISTED IN TABLE AND DOC, DOC-PSF CHEMICALS. DOCUMENTS IN THE APPLICATION FILE FOR PERMIT ISSUANCE
Article 4. Guidance on Implementing Conditions for Producing Chemicals Listed in Table and DOC, DOC-PSF Chemicals
The conditions for producing chemicals listed in Table and DOC, DOC-PSF chemicals stipulated in Points c, d, đ, e, g, h, i Clause 1 Article 15; Points c, d Clause 1 Article 16 and Points c, d Clause 1 Article 20 of Decree No. 38/2014/ND-CP shall be implemented as follows:
1. Technical Infrastructure Requirements
a) The production line for chemicals must ensure the quality of the chemicals. Machinery and equipment for producing chemicals listed in Table must have clear and legal origins. Machinery and equipment with strict safety requirements and measuring instruments must be inspected, calibrated, and adjusted according to current regulations on machinery and equipment inspection, meeting production capacity and production technology processes;
b) Storage facilities or storage facilities under lease contracts must be appropriate and meet technological requirements for chemical preservation, ensuring compliance with fire prevention and explosion control regulations. Chemical storage facilities must have a safety chemical rules board displayed in easily visible locations, with warning signs hung where they can be easily seen, and a signaling system suitable for the level of danger and fully reflecting the hazardous characteristics of the chemicals.
Chemicals listed in Table and DOC stored must comply with labeling regulations under current laws on product labeling. Labels for chemicals listed in Table must ensure mechanical and chemical durability throughout the life of the chemicals;
c) Systems for treating exhaust gases and waste from chemicals listed in Table, DOC, and DOC-PSF must comply with environmental laws and meet current national technical standards for industrial emissions, hazardous waste thresholds, and solid waste;
d) The testing laboratory of the chemical production facility must have the capability to analyze quality indicators specified in national technical standards for finished products and quality indicators specified in applicable standards for raw materials to control product quality.
In cases where there is no testing laboratory or sufficient testing capabilities as required, a contract must be made with a designated or recognized testing laboratory to control the quality of chemicals listed in Table.
2. Human Resource Requirements
a) Management, technical, and operational staff involved in the production activities of the chemical production facility must hold a bachelor's degree in chemical engineering or have a certificate proving their expertise in chemistry;
b) Direct workers handling chemicals listed in Table and DOC, DOC-PSF at the production facility must be trained in chemical safety according to Circular No. 36/2014/TT-BCT dated October 22, 2014, issued by the Minister of Industry and Trade on chemical safety training and issuance of certificates of chemical safety training.
Article 5. Authority to Issue Permits
1. Permit for Producing Chemicals Listed in Table, DOC, DOC-PSF
a) The Ministry of Industry and Trade shall submit to the Prime Minister for approval to produce chemicals listed in Table 1 in accordance with Point a Clause 3 Article 17 of Decree No. 38/2014/ND-CP;
b) The Chemicals Administration shall be the agency responsible for issuing permits for producing chemicals listed in Table 2, Table 3, and DOC, DOC-PSF.
2. Permit for Exporting and Importing Chemicals Listed in Table
a) The Ministry of Industry and Trade shall submit to the Prime Minister for approval to export and import chemicals listed in Table 1 in accordance with Point a Clause 4 Article 19 of Decree No. 38/2014/ND-CP;
b) The Chemicals Administration shall be the agency responsible for issuing permits for exporting and importing chemicals listed in Table 2 and Table 3.
Article 6. Documents and materials in the application file for issuing a Permit to produce Chemical Table and Chemical DOC, DOC-PSF
1. A copy of the Enterprise Registration Certificate or Investment Certificate or Business Registration Certificate issued by the competent authority, which includes the business field related to chemicals.
2. An application for issuance of a Permit to produce Chemical Table or Chemical DOC, DOC-PSF.
3. A commitment to produce Chemical Table or Chemical DOC, DOC-PSF.
4. A description of the production process, technical infrastructure (workshop, warehouse), machinery and equipment (list of machinery and equipment with their capacities suitable for each production stage and scale of the facility; measuring and quality control equipment for Chemical Table); list of workshop area, warehouse area, office space, and auxiliary facilities.
5. A copy of the Decision approving the Environmental Impact Assessment Report or the certificate of environmental protection commitment registration issued by the competent authority.
6. A copy of the Fire Prevention and Control Approval Certificate or a copy of the Decision approving the fire fighting plan issued by the competent authority.
7. List of management, technical, and production operation staff.
8. List of technical equipment.
9. A copy of the testing contract with the designated testing organization (if any).
Article 7. Documents and materials for reissuing or amending the Permit to produce Chemical Table and Chemical DOC, DOC-PSF
1. Documents and materials for reissuing the Permit
a) Application for reissuing the Permit;
b) The original Permit that contains errors or the remaining part of the original Permit that can still be identified despite damage;
c) In case the Permit is lost, the organization or individual making the application shall submit it to the competent authority according to the provisions of Point a Clause 1 of this Article.
2. Documents and materials for amending the Permit
a) Application for amending the Permit;
b) The original Permit already issued;
c) Documents and materials proving the content of the amendment according to the provisions of Point b Clause 5 Article 17 Decree No. 38/2014/NĐ-CP.
Section 2. EXPORT AND IMPORT FORMS, DECLARATION OF CHEMICAL TABLE AND DECLARATION OF CHEMICAL DOC, DOC-PSF FACILITIES
Article 8. Export and import forms for Chemical Table
The export and import forms for Chemical Table include: Application form for export and import permit for Chemical Table; export and import permit for Chemical Table; final user certification form; export and import notification form for Chemical Table 1.
Article 9. Declaration forms for production, trading, processing, consumption, storage
1. Declaration forms for production, trading, processing, consumption of Chemical Table include: Annual declaration form for production, consumption, processing of Chemical Table; supplementary and adjustment declaration form for production, processing, consumption of Chemical Table in the following year; initial declaration form for production, consumption, processing of Chemical Table; trading, storage, export, import declaration form for Chemical Table.
2. Declaration forms for production of Chemical DOC, DOC-PSF include: Annual declaration form for production of Chemical DOC, DOC-PSF; initial declaration form for production of Chemical DOC; supplementary and adjustment declaration form for production of DOC.
Chapter III
IMPLEMENTING PROVISIONS
Article 10. Responsibility for Implementation
1. The Chemicals Administration is responsible for directing, guiding, inspecting, and urging the implementation of this Circular. Regularly organizing training and seminars to enhance awareness among organizations and individuals involved in the production, trading, consumption, processing, storage, export, and import of chemicals under the Chemical Weapons Convention.
2. Market Management forces are responsible for inspecting Chemical Table, Chemical DOC, DOC-PSF circulating in the market and handling administrative violations according to the law.
Article 11. Transitional Provisions
1. Organizations and individuals currently producing, trading, processing, consuming, storing, exporting, and importing Chemical Table and producing Chemical DOC, DOC-PSF must meet and supplement all conditions as stipulated in Article 29 of Decree No. 38/2014/NĐ-CP and this Circular.
2. Organizations and individuals starting operations must comply with regulations on production, trading, processing, consumption, storage, export, and import of Chemical Table and production of Chemical DOC, DOC-PSF from the date this Circular takes effect.
Article 12. Effective Date
1. This Circular takes effect from February 15, 2015.
2. This Circular replaces Chapter IV. Establishment and Review of Application Files for Permits to Produce and Use Prohibited Chemicals in Industry as stipulated in Circular No. 28/2010/TT-BCT dated June 28, 2010, issued by the Minister of Industry and Trade detailing certain provisions of the Law on Chemicals and Decree No. 108/2008/NĐ-CP dated October 7, 2008, issued by the Government detailing and guiding the implementation of certain provisions of the Law on Chemicals.
3. During the implementation, if there are difficulties or issues arising, organizations and individuals should promptly report to the Ministry of Industry and Trade (Chemical Administration) for appropriate amendments and supplements.
