Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Announcing the waters of the seaports located within the territories of the provinces of Tiền Giang, Bến Tre, Vĩnh Long, and Long An including the following waters:Pursuant to the Technical Standards Law promulgated on June 29, 2006; 1. 4. Waters of the seaport of Long An.

Article 2. Scope of the waters of the seaports located within the territories of the provinces of Tiền Giang, Bến Tre, Vĩnh Long, and Long An

The scope of the waters of the seaports located within the territories of the provinces of Tiền Giang, Bến Tre, Vĩnh Long, and Long An is defined according to the highest tidal level as follows:

1. Scope of the waters of the seaport of Tiền Giang:

From point MT1 with coordinates: 10°16’07”N, 106°45’20”E running along the coast northward to the parallel 10°28’56”N, then running eastward along this parallel to the left edge of the Soài Rạp channel (from the sea inward). Running along the left edge of the Soài Rạp channel (from the sea inward) toward the sea to the meridian 106°49,30”E, then running southward along this meridian to point SR4 with coordinates: 10°15’00”N, 106°49’30”E. Connecting points SR4, SR3, MT2, MT3, MT4 sequentially with straight lines. Points SR3, MT2, MT3, and MT4 have the following coordinates:

SR3: 10°15’00”N, 107°00’00”E;

MT2: 10°10’53”N, 106°59’54”E;

MT3: 10°10’53”N, 106°47’36”E;

a) Seaward boundary:

MT4: 10°12’30”N, 106°47’51”E.

From points MT1 and MT4 running along both banks of the Tiền River to the straight line intersecting the river at points MT5 and MT6, each 500 meters from the edge of Mỹ Tho port wharf upstream. Points MT5 and MT6 have the following coordinates:

MT5: 10°20’08”N, 106°19’08”E;

MT6: 10°20’29”N, 106°19’07”E.

The boundary of the water area at the river mouths and creeks along both banks of the Tiền River is the straight line connecting the two most protruding points at the mouths and creeks.

b) The boundary towards the mainland:

2. Scope of the waters of the seaport of Bến Tre:

Limited by straight lines connecting points BT1, MT3, MT2, BT2, BT3, BT4 sequentially. Points BT1, BT2, BT3, and BT4 have the following coordinates:

BT1: 10°09’02”N, 106°47’23”E;

BT2: 9°40’04”N, 107°00’01”E;

BT3: 9°40’04”N, 106°43’54”E;

a) Seaward boundary:

BT4: 9°47’14”N, 106°37’02”E;

From point BT1 running along the coast southward through the Đại gate, the Ba Lai gate, to point BT6 with coordinates: 10°00’44”N, 106°41’19”E, connecting to point BT5 with coordinates: 9°53’03”N, 106°41’08”E. From point BT5 running along the coast southward to point BT4.

c) Boundary in the Giao Long area: circular lines with a radius of 350 meters, centered at points GL1, GL2, GL3 with the following coordinates:

GL1: 10°19’04”N, 106°25’41”E;

GL2: 10°19’11”N, 106°25’29”E;

b) The boundary towards the mainland:

GL3: 10°19’19”N, 106°25’16”E.

d) Boundary on the Hàm Luông River: circular lines with a diameter of 350 meters, centered at points HL1, HL2, HL3 with the following coordinates:

HL1: 10°12’55”N, 106°21’03”E;

HL2: 10°12’46”N, 106°21’11”E;

HL3: 10°12’36”N, 106°21’20”E;

3. Scope of the waters of the seaport of Vĩnh Long:

a) Upper boundary: limited by a straight line from point VL1 with coordinates: 10°15’40”N, 105°56’49”E, 500 meters from the edge of the Vĩnh Long port wharf upstream, perpendicular to the outer edge of the Cổ Chiên River channel, running along the bank and the outer edge of the Cổ Chiên River channel to the lower boundary of the Vĩnh Long port wharf;

b) Lower boundary: a straight line from point VL2 with coordinates: 10°15’34”N, 105°57,23”E, 500 meters from the edge of the Vĩnh Long port wharf downstream, perpendicular to the outer edge of the Cổ Chiên River channel.

4. Scope of the waters of the seaport of Long An:

From the intersection of the left bank of the Soài Rạp River (from the sea inward) and the parallel: 10°28’56”N, running along the left bank of the Soài Rạp River northward to the parallel: 10°34’41”N (the parallel: 10°34’41”N passes through the intersection between the provincial border of Long An - Hồ Chí Minh City and the Soài Rạp River bank), running eastward along the parallel 10°34’41’N to the left edge of the Soài Rạp channel (from the sea inward), running along the left edge of the Soài Rạp channel toward the sea to the parallel 10°28’56”N, running westward along this parallel to the left bank of the Soài Rạp River.

5. Boundaries of the waters of the seaports specified in this Circular are determined on Chart No. I-300-08 of the Vietnam Navy published in 1978. Coordinates of the points specified in this Circular are applied according to the VN-2000 Coordinate System and converted to other coordinate systems as follows:

Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones

The Director of the Vietnam Maritime Administration shall organize the announcement of areas for pilot embarkation and disembarkation, quarantine zones, anchorage areas, transshipment zones, typhoon shelters for vessels entering and leaving coastal ports in Tiền Giang, Bến Tre, Vĩnh Long, Long An, and other water areas and zones as prescribed.

Article 4. Responsibilities of the My Tho Port Office and related port offices v1. Responsibilities of the My Tho Port Office

a) Implement tasks and powers as prescribed by the Vietnam Maritime Code and relevant legal documents concerning maritime activities in the waters of coastal ports within the territories of the provinces of Tien Giang, Ben Tre, Vinh Long, and Long An;

b) Based on actual conditions regarding weather, waves, wind, draft, and tonnage of vessels, designate specific anchorage positions for vessels to moor, transfer cargo, and avoid typhoons in accordance with regulations, ensuring maritime safety, maritime security, and environmental protection.

2. Coordination management responsibilities between the My Tho Port Office and the Vung Tau Port Office, Ho Chi Minh City Port Office

a) The My Tho Port Office shall be responsible for:

Notifying the Vung Tau Port Office of information related to vessels entering and leaving coastal ports within the territories of the provinces of Tien Giang, Ben Tre, Vinh Long, and Long An at least two hours before the vessels reach the pilot station area of Vung Tau;

Notifying the Vung Tau Port Office of the movement of vessels departing from positions designated by the Vung Tau Port Office to enter the waters of coastal ports within the territories of the provinces of Tien Giang, Ben Tre, Vinh Long, and Long An at least one hour before the vessels depart from their positions;

Notifying the Ho Chi Minh City Port Office of information related to vessels entering and leaving coastal ports on the Saigon River within the territories of Tien Giang and Long An at least two hours before the vessels reach the waters of Ho Chi Minh City port.

b) The Vung Tau Port Office shall be responsible for designating specific positions for vessels to pick up pilots, undergo quarantine, moor, and avoid typhoons based on actual conditions regarding weather, waves, wind, draft, and tonnage of vessels entering and leaving coastal ports within the territories of the provinces of Tien Giang, Vinh Long, Ben Tre, and Long An. This must be done within one hour after receiving notification and confirming this to the My Tho Port Office.

c) The Ho Chi Minh City Port Office shall be responsible for designating specific positions for vessels to moor and avoid typhoons based on actual conditions regarding weather, waves, wind, draft, and tonnage of vessels entering and leaving bridges and wharves on the Saigon River within the territories of Tien Giang and Long An but which must moor and avoid typhoons in the waters of Ho Chi Minh City port. This must be done within one hour after receiving notification and confirming this to the My Tho Port Office.

1. This Circular takes effect from January 1, 2016. Decree No. 35/2007/QĐ-BGTVT dated July 25, 2007 of the Minister of Transport announcing the waters of coastal ports within the territories of the provinces of Tien Giang, Vinh Long, Ben Tre, and the management area of the My Tho Port Office is hereby repealed.

Article 5. Effective Date

2. Amend and supplement Point d Clause 2 and Clause 9 Article 2 of Circular No. 02/2015/TT-BGTVT dated February 25, 2015 of the Minister of Transport announcing the waters of coastal ports within the territory of Ho Chi Minh City and the management area of the Ho Chi Minh City Port Office as follows:

a) Point d Clause 2 Article 2 is amended and supplemented as follows:

"d) The parallel of latitude 10°34'41"N."

b) Replace "10°28'56"" with "10°34'41"" and "10°28'52"" with "10°34'37"" in the coordinate conversion table specified in Clause 9 Article 2.

The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Directors of the Vietnam Maritime Administration Bureau, the Director of the Vietnam Inland Waterway Administration Bureau, the Directors of the Department of Transport of Tien Giang Province, the Director of the Department of Transport of Vinh Long Province, the Director of the Department of Transport of Ben Tre Province, the Director of the Department of Transport of Long An Province, the Director of the My Tho Port Office, the Director of the Vung Tau Port Office, the Director of the Ho Chi Minh City Port Office, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.

Article 6. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Transport Departments of Tiền Giang Province, Vĩnh Long Province, Bến Tre Province, Long An Province, Directors of the My Tho Port Office, Vũng Tàu Port Office, Hồ Chí Minh City Port Office, Heads of agencies, organizations, and individuals related to this Circular are responsible for its implementation./.
