CIRCULAR
CThe Minister of Transport issues this Circular to announce the waters of the seaports located within the territory of Binh Dinh Province, Phu Yen Province, and the area under the management of Quy Nhon Maritime Port Office.
Pursuant to the Vietnam Maritime Code on November 25, 2015;
Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
1. Amending Clause 2 Article 2 as follows:
At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;
The Minister of Transport promulgates this Circular to announce the waters of the seaports located within the territory of Binh Dinh Province, Phu Yen Province, and the area under the management of Quy Nhon Maritime Port Office.
Article 1. Announcement of the waters of the seaports located within the territory of Binh Dinh Province and Phu Yen Province
Clause 1. The waters of the Quy Nhon Seaport located within the territory of Binh Dinh Province are the waters of the seaport located in Quy Nhon Bay and Thiti Nai Lagoon.
Clause 2. The waters of the Vung Ro Seaport located within the territory of Phu Yen Province include the waters of the Vung Ro Seaport located in Vung Ro Bay and the waters of the Vung Ro Seaport located in Xuan Dai Bay.
Article 2. Scope of the waters of the seaports located within the territory of Binh Dinh Province and Phu Yen Province
Clause 1. The scope of the waters of the Quy Nhon Seaport located within the territory of Binh Dinh Province, measured from the highest tidal level, is specified as follows:
Point a) The seaward boundary is limited by straight lines connecting points QN1, QN2, QN3, and QN4, with the following coordinates:
QN1: 13°45'16"N; 109°17'08"E;
QN2: 13°41'10"N; 109°17'08"E;
QN3: 13°41'10"N; 109°14'59"E;
QN4: 13°41'19"N; 109°13'51"E.
Point b) The landward boundary is limited from point QN4 running along the coast northward to point QN5 with coordinates 13°48'16"N, 109°13'35"E, from point QN5 connected by a straight line to point QN6 with coordinates 13°48'40"N, 109°15'05"E, from point QN6 running along the coast of Phuoc Mai Peninsula to point QN1.
Clause 2. The scope of the waters of the Vung Ro Seaport located in Vung Ro Bay, measured from the highest tidal level, is determined as follows:
Point a) The seaward boundary is limited by straight lines connecting points VR1, VR2, VR3, and VR4, with the following coordinates:
VR1: 12°50'52"N; 109°25'29"E;
VR2: 12°49'58"N; 109°25'29"E;
VR3: 12°49'58"N; 109°23'47"E;
VR4: 12°50'44"N; 109°23'20"E.
Point b) The landward boundary is limited from point VR4 running along the coast of Vung Ro Bay northward, southward to point VR1.
Clause 3. The scope of the waters of the Vung Ro Seaport located in Xuan Dai Bay, measured from the highest tidal level, is specified as follows:
XD1: 13°27’52,0”N, 109°19’34,0”E;
XD1: 13°27'52"N; 109°19'34"E;
XD2: 13°17'16"N; 109°19'34"E;
XD3: 13°15'22"N; 109°18'53"E.
Point b) The landward boundary is limited from point XD3 running along the coast of Xuan Dai Bay northward, eastward to point XD4, crossing the mouth of Phu Ngan River to point XD5 and along the shore northeastward to point XD6; from point XD6 cutting across Xuan Dai Bay to point XD7 and running along the shore southeastward, northeastward to point XD1, with the following coordinates:
XD4: 13°15'28"N; 109°18'51"E;
XD5: 13°15'28"N; 109°18'45"E;
XD6: 13°25'46"N; 109°14'11"E;
XD7: 13°25'46"N; 109°15'23"E.
Clause 4. The boundaries of the waters of the Quy Nhon Seaport and the waters of the Vung Ro Seaport located in Xuan Dai Bay stipulated in this Circular are determined on Chart number VN 300017; the boundaries of the waters of the Vung Ro Seaport located in Vung Ro Bay are determined on Chart number VN 300018 published by the Southern Marine Safety Assurance Corporation for the first time in 2016. The coordinates of the points stipulated in this Circular are applied according to the VN-2000 Coordinate System and converted to the WGS-84 Coordinate System in the Appendix attached to this Circular.
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.
The Director of the Vietnam Maritime Administration shall organize the announcement of the pilot reception and disembarkation areas, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving the Quy Nhon Seaport and the Vung Ro Seaport, and other water areas and zones as prescribed.
Article 4. Responsibilities of the Quy Nhơn Maritime Port Office
1. Perform tasks and exercise powers as prescribed by the Vietnam Maritime Code and related legal normative documents concerning maritime activities at ports and port waters within the jurisdiction of Binh Dinh Province and Phu Yen Province.
2. Based on actual conditions regarding weather, waves, winds, draft, tonnage of vessels, and nature of cargo, designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and avoid storms in accordance with regulations, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Binh Dinh Province and Phu Yen Province
Outside the waters specified in Article 2 of this Circular, the Quy Nhơn Maritime Port Office shall be responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea area within the jurisdiction of Binh Dinh Province and Phu Yen Province.
Article 6. Effectiveness
This Circular takes effect from January 15, 2019. The Decision No. 33/2007/QĐ-BGTVT dated July 17, 2007 of the Minister of Transport promulgating the waters of ports within the jurisdiction of Binh Dinh Province and Phu Yen Province and the management area of the Quy Nhơn Maritime Port Office is hereby abolished.
Article 7. Implementation Organization
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Department of Transport of Binh Dinh Province, Directors of the Department of Transport of Phu Yen Province, Director of the Quy Nhơn Maritime Port Office, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
