CIRCULAR
Regulations on Selecting Citizens for the People's Police Force

BASED ON THE Law on Public Security dated November 20, 2018;âBASED ON Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government prescribing the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

CONSIDERING the proposal of the General Department of Personnel;uTHE MINISTRY OF PUBLIC SECURITY ISSUES this Circular prescribing the principles, subjects, conditions, standards, methods, procedures for selecting citizens to serve in the People's Public Security under a professional system or recruitment system; responsibilities of agencies, organizations, and individuals in selecting citizens to serve in the People's Public Security.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

IMPLEMENTATION IN ACCORDANCE WITH Clause 1, Article 7 of the Law on Public Security 2018 and the following provisions:

Article 2. Principles of Selection

1. In accordance with the tasks and staffing requirements of the People's Police Force.

2. Ensuring democracy, fairness, transparency, legality, and gender equality.

2. Possessing professional technical qualifications, vocational skills, aptitudes, and abilities suitable for the requirements of the position, function, and work to be recruited.

3. Meeting the recruitment standards prescribed in Article 5 of this Circular and voluntarily serving in the People's Public Security. For cases prescribed in Clause 1, Article 3 of this Circular, the years of service must be classified as having satisfactorily completed duties or better by the agency or organization (where the citizen works).

Article 3. Subjects of Selection

Ensuring political standards as prescribed in Circular No. 44/2018/TT-BCA dated December 26, 2018 of the Minister of Public Security stipulating political standards for public security officers and soldiers and the following criteria:

Article 4. Conditions for Selection

3. Academic Degrees and Certificates

1. The People's Police Force has a need for staffing.

Having graduated and been awarded a degree (or certificate) and meeting one of the following criteria:

a) Candidates selected according to Clause 1, Article 3 of this Circular must have a bachelor's degree or higher;

Article 5. Standards for Selection

b) Candidates selected according to Clause 2, Article 3 of this Circular must have a secondary, college, or university degree (including vocational secondary and vocational college), bachelor's, master's, or doctoral degrees.

Selection for placement in public security operations or state management in various fields according to the functions of the People's Public Security shall only recruit persons with a bachelor's degree or higher.

a) Having firm political resolve, absolutely loyal to the country, the people, the Party, and the State;

b) Having the ability and responsibility to complete assigned tasks, ready to fight and sacrifice to protect the Party, the State, the people, and the socialist regime, national independence, sovereignty, territorial integrity, and national security;

c) Being honest, self-aware, strictly adhering to organizational discipline, having a high sense of revolutionary vigilance, and safeguarding state secrets.

2. Moral Character: Having good moral character and conduct.

From 18 years old to under 30 years old (as of the date of the recruitment decision); citizens with a doctorate, specialist physician level I, specialist physician level II, resident physician, specialist pharmacist level I, specialist pharmacist level II in medical or pharmaceutical sciences, and cases prescribed in Clause 1, Article 3 of this Circular may be selected up to 35 years old, professors and associate professors up to 40 years old.

5. Health

a) Height: for males, 1.64 meters or more; for females, 1.58 meters or more;

b) Vision: unaided vision of each eye must be 9-10/10, total vision of both eyes must be 18-20/10;

c) Citizens selected for placement in scientific and technological work, including technical operations, criminal technical, information, cryptographic, cyber security, electronic warfare, teaching at training institutions; those with a doctorate, specialist physician level I, specialist physician level II, resident physician, specialist pharmacist level I, specialist pharmacist level II in medical or pharmaceutical sciences; those with professor or associate professor titles: may be reduced by 2 (two) centimeters for each gender compared to the provisions in Point a of this Clause; may have nearsightedness or farsightedness but not exceeding 3 diopters per eye.

4. Age

Citizens selected for placement in public security operations units must be calm, sensitive, agile, have good memory, and possess necessary police aptitude standards as prescribed by subordinate units of the Ministry of Public Security for each force system (if applicable).

1. The selection of citizens to serve in the People's Public Security is carried out through competitive examinations, except for cases prescribed in Clause 2 of this Article. The examination format and content must be appropriate to the profession and ensure the selection of individuals who meet the required qualities, qualifications, and capabilities.

Meeting the health standards for selection into the People's Police as prescribed by the Minister of Public Security and the following provisions:

2. Candidates falling into any of the following categories will be selected through non-competitive examinations:

a) Those with a doctorate, specialist physician level I, specialist physician level II, resident physician, specialist pharmacist level I, specialist pharmacist level II in medical or pharmaceutical sciences;

b) Cases prescribed in Clause 1, Article 3 of this Circular;

c) Cases prescribed in Article 2 of Decree No. 140/2017/NĐ-CP dated December 5, 2017 of the Government on policies to attract and create sources of cadres from outstanding graduates and young scientists.

Article 6. Recruitment Methods

3. In cases where the number of applicants for the competitive examination or non-competitive examination does not meet the principles prescribed in Clause 4, Article 2 of this Circular, the public security unit or locality reports to the General Department of Personnel for consolidation and submission to the Minister for consideration and decision.

4. BASED ON the guidelines of the Central Party Committee of the Public Security and the leadership of the Ministry of Public Security regarding cadre work in each period, the Director of the General Department of Personnel reports to the Minister of Public Security for consideration and adjustment of the method of selecting citizens to serve in the People's Public Security in accordance with the law.

a) Hold a doctoral degree, a specialist physician of the first level, a specialist physician of the second level, a resident physician, a specialist pharmacist of the first level, or a specialist pharmacist of the second level in the field of medicine or pharmacy;

b) The cases prescribed in Clause 1 of Article 3 of this Circular;

c) The cases prescribed in Article 2 of Decree No. 140/2017/NĐ-CP dated December 5, 2017 of the Government on policies to attract and develop outstanding graduates and young scientists as cadres;

3. In cases where the number of applicants registering for the recruitment examination or selection does not comply with the principles stipulated in Clause 4 of Article 2 of this Circular, the Public Security unit or local police shall report to the Personnel Organization Bureau for consolidation and submission to the Minister for consideration and decision;

4. Based on the guidelines of the Central Party Committee of the Ministry of Public Security and the leadership of the Ministry of Public Security regarding cadre work at each stage, the Director of the Personnel Organization Bureau shall report to the Minister of Public Security for consideration and adjustment of the methods for selecting citizens to join the People's Public Security Force in accordance with the provisions of the law.

Article 7. Priority Points in Selection

1. Persons who meet the conditions and criteria stipulated in Articles 4 and 5 of this Circular shall be granted priority points if they fall under any of the following cases:

a) Hold a Doctorate degree, Specialist II in Medicine, Specialist II in Pharmacy specializing in medicine or pharmacy: 50 points will be added to the total examination score;

b) Hold a Master's degree, Specialist I in Medicine, Intern Specialist in Medicine, Specialist I in Pharmacy specializing in medicine or pharmacy, or graduate with excellent grades from a bachelor’s program: 40 points will be added to the total examination score or selection score;

c) Graduate with good grades from a bachelor’s program; graduate with excellent grades from a college or secondary vocational school program; graduate with outstanding grades from a primary vocational school program; have a higher level of training that matches the position being recruited for (as per recruitment targets); ethnic minority persons: 30 points will be added to the total examination score or selection score;

d) Achieve international or national awards in fields and areas specified in the recruitment targets: 20 points will be added to the total examination score or selection score;

đ) Children of: Martyrs, War Invalids, War Disabled, persons entitled to benefits similar to war invalids, persons affected by chemical warfare agents during wartime, Heroes of People's Armed Forces, Labor Heroes, Public Security Officers; persons completing their duty in the Public Security Force: 10 points will be added to the total examination score or selection score.

2. In cases where a person has multiple priorities as stipulated in Clause 1 of this Article, only the highest priority points will be added to the total examination score or selection score.

Article 8. Determination of Academic Results of Applicants

1. The academic score is determined by the average score of all subjects throughout the entire training period (training course) at the level of specialized technical and vocational training, converted according to a scale of 100 points, with a coefficient of 1.

2. The graduation score at the level of specialized technical and vocational training, converted according to a scale of 100 points, with a coefficient of 1, specifically:

a) The graduation score is determined by the average score of final exam subjects;

b) In cases where there are graduation thesis scores, graduation project scores, or graduation design scores, the graduation score is determined by the highest score among the graduation thesis, graduation project, or graduation design scores;

c) In cases where there is a graduation certificate obtained through a direct entry program at a certain level, the graduation score is determined by the graduation score at that level of training.

3. In cases where the grade sheet provided by the educational institution is incomplete or cannot determine the score or does not have a grade sheet, the academic score will be converted based on the ranking or certification of the graduation certificate and according to a scale of 100 points, with a coefficient of 1, as follows:

a) Graduation certificates ranked or certified as average or without ranking or certification, the academic score is calculated as 20 points, the graduation score is calculated as 20 points;

b) Graduation certificates ranked or certified as good average, the academic score is calculated as 40 points, the graduation score is calculated as 40 points;

c) Graduation certificates ranked or certified as good, the academic score is calculated as 60 points, the graduation score is calculated as 60 points;

d) Graduation certificates ranked or certified as excellent, the academic score is calculated as 80 points, the graduation score is calculated as 80 points;

đ) Graduation certificates ranked or certified as outstanding, the academic score is calculated as 90 points, the graduation score is calculated as 90 points.

4. In cases of credit-based training, the academic score is simultaneously the graduation score, converted according to a scale of 100 points, with a coefficient of 1.

5. The academic results of applicants are the sum of the academic score and the graduation score.

Chapter II

ORGANIZATION OF CITIZEN RECRUITMENT INTO THE PEOPLE'S POLICE

Article 9. Application Documents for Recruitment

1. The application documents for recruitment include:

a) A voluntary service application form in the People's Public Security Forces;

b) A self-reported personal history statement (according to the model of the Ministry of Public Security) confirmed by the People's Committee of the commune, ward, town where the applicant resides within thirty days from the date of submission of the application documents as prescribed;

c) A copy of the birth certificate;

d) Certified copies of academic diplomas, technical and vocational certificates, and transcripts of all courses completed;

In cases where academic diplomas, certificates, and transcripts are issued by foreign educational institutions, they must be translated into Vietnamese and recognized as equivalent by the competent authority according to the provisions of the law;

đ) Certificate of membership in the Youth Union or the Communist Party (if applicable);

e) Certified copies of confirmation documents at points d, đ of Clause 1, Article 7 of this Circular;

g) A health certificate issued by a hospital at the district level or higher within thirty days from the date of submission of the application documents as prescribed;

h) Four color photographs measuring 4cm x 6cm taken within six months from the date of submission of the application documents;

2. For cases specified in Clause 1, Article 3 of this Circular, in addition to the provisions of Clause 1 of this Article, the following documents shall be supplemented:

a) An employee's personal history record with confirmation from the workplace organization;

b) A work performance evaluation report;

c) Certified copies of decisions on salary classification and salary increase made by the competent authority;

d) Copies of the social insurance book confirmed by the authorized agency.

Article 10. Recruitment Board

1. The recruitment selection board of the Public Security unit or locality includes:

a) Chairman: Head of the Public Security unit or locality;

b) Vice-Chairman: Deputy head of the Public Security unit or locality responsible for force building;

c) Member: Heads of organizational personnel departments, inspection, health, and related professional departments under the Public Security unit or locality;

d) Secretary: Cadre responsible for recruiting citizens into the People's Public Security Forces under the organizational cadre department of the Public Security unit or locality;

đ) Permanent Office: Organizational and personnel department of the Public Security unit or locality.

2. The recruitment selection board of the Public Security unit or locality has the following tasks and powers:

a) Assist the Party committee and the head of the Public Security unit or locality in implementing recruitment through examination or selection methods;

b) Establish working groups, including: Secretariat (if necessary), examination question-setting group, examination supervision group, marking group, and review group in case of organizing examinations, or verification and assessment group in case of organizing selections;

c) Conduct thorough reviews and conclude on political standards; inspect and conclude on health conditions, educational qualifications, and special talents of applicants;

d) Compile examination or selection results and submit them for review by the Party committee and leadership of the unit, and report in writing to the head of the Public Security unit or locality for recruitment decision;

đ) Resolve complaints and denunciations during the examination or selection process according to the provisions of the law;

3. The recruitment board of the Public Security unit or locality operates based on collective principles, concludes by majority vote, and automatically dissolves upon completion of its tasks.

Article 11. Examination Content

1. Preliminary Round

a) Interview to understand motives, purposes, and aspirations to serve in the People's Public Security Forces. This section only evaluates whether the requirements are met or not;

b) Skill assessment as stipulated in Clause 6, Article 5 of this Circular. This section only evaluates whether the requirements are met or not;

c) General knowledge test about the Party's policies and State laws regarding the People's Public Security Forces through a multiple-choice format with a duration of 30 minutes. Applicants who meet the general knowledge requirement must answer more than 50% of the questions correctly;

d) Foreign language proficiency test in one of five languages: English, French, German, Russian, Chinese, or another language required for the position, through a multiple-choice format with a duration of 30 minutes. Applicants who meet the foreign language requirement must answer more than 50% of the questions correctly;

In cases where the job requires a foreign language specialty, the applicant does not need to take the foreign language test. For positions requiring ethnic minority languages, the foreign language test is replaced by an ethnic language test. The head of the Public Security unit or locality decides the format and content of the ethnic language test;

đ) Computer skills test according to the requirements of the position decided by the head of the Public Security unit or locality. The test format is multiple-choice with a duration of 30 minutes. Applicants who meet the computer skills requirement must answer more than 50% of the questions correctly;

In cases where the head of the Public Security unit or locality decides to organize a computer-based test, the preliminary round test will only include general knowledge and foreign language tests;

e) Exemption from foreign language and computer skills tests in the following cases:

- Exemption from foreign language and computer skills tests for those holding master's, doctoral, specialist physician level I, specialist physician level II, specialist pharmacist level I, specialist pharmacist level II degrees in medicine or pharmacy, and for recruitment as drivers or police workers;

- Exemption from foreign language tests for those holding bachelor's degrees in foreign languages; bachelor's degrees obtained abroad or in Vietnam taught in a foreign language; and those holding international English language certificates such as IELTS 6.0 or higher;

- Exemption from computer skills tests for those holding bachelor's degrees or higher in information technology, computer science, mathematics-computer science;

g) The preliminary round must be conducted in the order from point a to point đ of this clause; applicants who fail to meet the requirements in any section will not proceed to subsequent sections, and only those who meet the preliminary round requirements may continue to the technical and professional subject exams;

2. Technical and Professional Subject Exam

a) Understanding, ability, and skills in technical and professional subjects according to the requirements of the position. For positions requiring foreign language or computer skills, the technical and professional subject exam is in foreign language or computer skills. In this case, applicants do not need to take the foreign language or computer skills test as specified in points d, đ of Clause 1 of this Article;

b) Written or practical examination, scored out of 100, with a coefficient of 1. The written examination lasts 90 minutes, while the practical examination lasts between 30 to 45 minutes.

Article 12. Content of Selection Examination

1. Preliminary selection in accordance with Clause 1, Article 11 of this Circular; only those cases meeting the requirements of the preliminary round shall be eligible for further examination.

2. The academic results of the candidates shall be determined in accordance with Clause 5, Article 8 of this Circular (except for cases with doctoral degree, second-level specialist doctorate, and second-level specialist pharmacist degrees).

3. The total points for the examination selection shall be the sum of the academic results stipulated in Clause 2 of this Article and any preferential points (if applicable) as prescribed in Article 7 of this Circular.

Article 13. Determination of Successful Candidates

1. Successful candidates in the recruitment examination round must meet the following criteria:

a) They must have the qualifications and standards prescribed in Articles 4 and 5 of this Circular and achieve a total score of 50 points or more in the specialized technical and professional subject examinations.

b) The candidate selected (successful candidate) must satisfy the provisions of point a of this clause and have a higher total score in the specialized technical and professional subject examinations and any preferential points (if applicable), ranked from highest to lowest until all approved quotas are filled.

2. Successful candidates in the examination selection round

a) For cases with doctoral degree, second-level specialist doctorate, and second-level specialist pharmacist degrees, they will be successful if they meet the qualifications and standards prescribed in Articles 4 and 5 of this Circular and pass the preliminary round as specified in Clause 1, Article 11 of this Circular. In cases where two or more candidates meet the same conditions and standards, the Party Committee and leadership of the local Public Security unit shall review and determine the successful candidates in the following order:

- Those holding the title of professor;

- Those holding the title of associate professor;

- Ethnic minority candidates;

- Candidates belonging to the category specified in point d, Clause 1, Article 7 of this Circular;

- Candidates belonging to the category specified in point đ, Clause 1, Article 7 of this Circular;

- Younger candidates;

If there are still equal candidates after reviewing these criteria, the Party Committee and heads of the local Public Security units shall decide on the successful candidates.

b) For other cases

- They must have the qualifications and standards prescribed in Articles 4 and 5 of this Circular and achieve at least 20 points in each type of academic and graduation scores;

- The candidate selected (successful candidate) must have a higher academic result score as determined in Clause 5, Article 8 of this Circular and any preferential points (if applicable), ranked from highest to lowest until all approved quotas are filled.

3. In cases where two or more candidates have the same final quota score in both the specialized technical and professional subject examinations and any preferential points (if applicable) or academic result scores and any preferential points (if applicable), the Party Committee and leadership of the local Public Security units shall review and determine the successful candidates in the following order:

a) Those with higher qualifications;

b) Those with higher graduation rank;

c) Ethnic minority candidates;

d) Candidates belonging to the category specified in point d, Clause 1, Article 7 of this Circular;

đ) Candidates belonging to the category specified in point đ, Clause 1, Article 7 of this Circular;

e) Younger candidates;

If there are still equal candidates after reviewing these criteria, the Party Committee and heads of the local Public Security units shall decide on the successful candidates.

4. Results of the recruitment examination and selection examination cannot be carried over to subsequent recruitment rounds.

Article 14. Procedure for Selecting Citizens into the People's Police Force

1. Developing a plan to organize recruitment

Based on the quota approved by the Minister of Public Security, the organizational cadre agencies of the Public Security units and localities shall develop a plan to organize the recruitment of citizens into the People's Police Force of their respective units and localities, to be submitted for approval by the heads of the units and localities. The content of the plan should clearly state the number, specialties, level of training required, eligibility criteria, sources of recruitment, time for receiving applications, and assignment of responsibilities for organizing implementation.

2. Announcement of Recruitment and Acceptance of Applications

a) Based on the approved plan for recruiting citizens into the People's Police Force by the head of the unit or locality, the organizational cadre agency shall publicly announce on at least one mass media channel such as radio, print, television, and also post on the unit or locality’s website, and publicly display at the workplace regarding the standards, eligibility criteria, number needed, application procedures, and location for receiving applications of those registering to apply. For recruitment for specialized units requiring confidentiality about the intended recruits, announcements shall only be made to introduce potential candidates within the unit or locality.

b) The organizational cadre agency shall arrange staff to directly receive applications. The place receiving applications must prominently display all necessary procedures so that applicants can submit their applications smoothly. Only applications that match the needs and comply with the regulations shall be accepted; those not meeting the requirements shall be returned immediately to the applicant. When receiving applications, a record book must be established to note detailed information about the applicant and the order of submission.

c) The period for accepting applications from candidates applying for recruitment is at least 30 working days from the date of the recruitment announcement.

3. Establishing the Recruitment Board and Organizing the Recruitment Examination or Selection

a) Upon completion of the application receipt process as stipulated in point c, Clause 2 of this Article, the organizational cadre agency shall report to the head of the Public Security unit or locality to issue a decision to establish the Recruitment Board to carry out the tasks prescribed in Article 10 of this Circular;

b) The Recruitment Board shall organize the recruitment examination or selection according to the assigned quota based on the provisions of Articles 10, 11, and 12 of this Circular.

4. Announcement of Recruitment Results

a) Within the latest three working days after completing the recruitment examination or selection, the Recruitment Board must publicly display and send a written notification of the recruitment results to the applicants at the address registered by the applicants or contact them to receive the notification directly at the organizational cadre agency of the Public Security unit or locality;

b) Within seven working days from the date of public display of the recruitment results, applicants have the right to submit a request for a re-examination of the recruitment examination or selection results. The Recruitment Board is responsible for organizing the re-examination within seven working days from the end of the deadline for submitting re-examination requests as stipulated in this Clause.

5. Decision on Temporary Recruitment and Recruitment of Citizens into the People's Police Force

After implementing the provisions of Clause 4 of this Article, the Selection Council unifies the list of successful candidates for the selection period, reports to the Party committee and leadership of the unit or locality for comments before submitting to the head of the unit or locality for a temporary recruitment decision to recruit citizens into the People's Police. For cases specified in Clause 1 of Article 3 of this Circular, before the organizational cadre agency proposes the head of the police unit or locality to make a decision, they must require the candidate to submit the discharge decision, transfer decision, or document agreeing to transfer work from the competent authority managing cadres.

6. Announce the temporary recruitment, recruitment decision for citizens into the People's Police

a) Within 07 working days from the date the head of the police unit or locality issues the temporary recruitment, recruitment decision for citizens into the People's Police, the organizational cadre agency must notify in writing to the citizen the time when they are present at the agency or unit to receive tasks and take the lead in organizing and announcing the decision together with the unit directly using personnel.

b) The recruitment, temporary recruitment decision for citizens into the People's Police must be simultaneously sent to the Personnel Organization Bureau one copy (original) for management purposes.

Article 15. Temporary Recruitment

1. Citizens recruited into the People's Police must undergo temporary recruitment, except for the following cases:

a) Those holding a master's degree, doctoral degree, specialist physician level I, specialist physician level II, resident physician, specialist pharmacist level I, and specialist pharmacist level II in the field of medicine or pharmacy, or those graduating from university with outstanding grades;

b) Cases specified in Clause 1 of Article 3, Point c of Clause 2 of Article 6, and Clause 1 of Article 21 of this Circular.

2. The duration of temporary recruitment is stipulated as follows:

a) 06 months for those with a bachelor's degree;

b) 09 months for those with an associate degree;

c) 12 months for those with a college or secondary degree;

d) The period of temporary recruitment starts from the date the temporary recruitment decision becomes effective. Maternity leave under social insurance regulations and sick leave according to the law are not counted within the period of temporary recruitment.

3. Citizens temporarily recruited in business units shall not be assigned to perform tasks related to police business secrets.

Article 16. Recruitment of Citizens into the People's Police after the End of the Temporary Recruitment Period

1. Twenty working days before the end of the temporary recruitment period, the citizen undergoing temporary recruitment must report the results of their performance in writing; the officer assigned to guide and evaluate the performance of the temporarily recruited citizen must report to the head of the unit directly managing and using the temporarily recruited person.

2. The collective Party committee and leadership of the unit directly managing and using the temporarily recruited citizen convene a meeting to assess and evaluate the political qualities, morals, and performance results of the temporarily recruited person (with minutes of the meeting recorded). Based on the results of the meeting, the unit directly using personnel will issue a document evaluating whether the requirements are met or not met, reporting to the head of the police unit or locality (through the organizational cadre agency) for consideration and decision.

3. The organizational cadre agency reviews the report of the unit, compiles it, seeks opinions from the collective Party committee and leadership of the police unit or locality, before submitting to the head of the police unit or locality for a recruitment decision.

Article 17. Revocation of temporary recruitment, selection decisions

1. The temporary recruitment, selection decision of a citizen shall be revoked in the following cases:

a) The person temporarily recruited or selected does not report for duty within the prescribed time limit without the consent of the competent authority or violates the law and is punished with a warning or higher penalty;

b) The person temporarily recruited fails to complete the assigned tasks or is disciplined with a reprimand or higher penalty during the temporary recruitment period.

2. In addition to the provisions of Clause 1 of this Article, based on the conclusion of the authorized inspection and examination agency, the temporary recruitment, selection decision of citizens into the People's Public Security shall be revoked in the following cases:

a) Not belonging to the target group for selection or failing to meet the conditions and standards for selection stipulated in Articles 4 and 5 of this Circular or recruiting beyond the approved level, profession, or specialty without reporting to the competent authority for review before making the decision;

b) Temporarily recruiting or selecting when not allocated the quota or exceeding the number of quotas approved by the Minister of Public Security;

c) Temporarily recruiting or selecting not in accordance with the procedures prescribed in Articles 14 and 15 of this Circular.

3. Citizens whose temporary recruitment, selection decisions are revoked or who fail to meet the requirements for selection at the end of the temporary recruitment period must commit in writing not to disclose the assigned tasks or related knowledge to the agencies or units where they were temporarily recruited or selected.

4. For the case of revoking the temporary recruitment, selection decision as provided in point a of Clause 1 of this Article, the Public Security unit or locality may decide to temporarily recruit or select persons with adjacent examination or assessment results.

Article 18. Promotion of rank, salary classification, and job assignment after selection

1. Based on educational qualifications (according to the selection quota), military rank, salary coefficient, mandatory social insurance payment period (if applicable), and assigned professional duties, citizens selected into the People's Public Security shall be considered for promotion of rank, salary classification according to the regulations of the Minister of Public Security.

2. Job assignments must be based on the professional training received and the position according to the selection quota. For those with primary, secondary, or college-level education (including vocational secondary and college), they can only be assigned to clerical, medical, driving, police worker, and other administrative support jobs after working for at least ten years if there is a need from the unit or locality and the staff meets the required criteria and conditions, then they may be allowed to study other professional courses to change their job.

3. Within three consecutive years from the date of selection, if the staff member fails to meet the job requirements and has one year of non-performance (based on annual staff classification) or is disciplined with a reprimand or higher penalty due to moral character violations or organizational discipline (including penalties imposed by the party organization, government, or mass organizations), the Public Security unit or locality shall consider and resolve to terminate their service in the People's Public Security. In such cases, the staff member does not need to submit a request letter.

Article 19. Management of Recruitment Files

1. Public Security units and localities shall be responsible for establishing and storing individual files of officers. All developments during the working process of officers from the time they are temporarily recruited to the time they cease service must be recorded in their officer files. The establishment, management, and storage of officer files shall be carried out according to the分级管理权限。

2. In cases where the decision on temporary recruitment or recruitment is revoked, the individual cannot reclaim the recruitment file. The local public security agency retains the file according to regulations.

Article 20. Time Limit for Implementing Recruitment Targets and Reporting Results

1. The time limit for implementing recruitment targets for citizens into the People's Public Security is twelve months, starting from the date of issuance of the announcement by the Personnel Department. After this period, Public Security units and localities absolutely may not continue to recruit according to the announced targets. In cases where there are objective reasons (requiring extended time for verification, investigation, and conclusion regarding political standards, health, and credentials of candidates), Public Security units and localities must exchange views and obtain written agreement from the Personnel Department before continuing implementation. The extension period in such cases shall not exceed two months and can only be granted once.

2. Within fifteen days from the date of announcing temporary recruitment and recruitment decisions for citizens into the People's Public Security, Public Security units and localities must report the results of recruitment to the Personnel Department for management purposes.

Article 21. Application of Recruitment Regulations to Cases of Position Conversion and Officer Deployment According to Task Requirements

1. For cases where work is performed at enterprises or public institutions within the People's Public Security that fall under the category of labor contracts, but due to adjustments in tasks, organizational structure, or being appointed to positions or jobs that do not sign labor contracts according to Circular No. 32/2010/TT-BCA dated September 29, 2010 of the Minister of Public Security on the use of contractual labor in the People's Public Security (recruitment into the permanent staff), it is necessary to ensure the conditions and standards stipulated in Articles 4 and 5 of this Circular.

2. Public Security workers who convert to officers or non-commissioned officers in the field of specialized work or advisory and state management must meet the standards specified in point b, Clause 3, Article 5 of this Circular.

Article 22. Responsibilities of Public Security Units and Localities

1. Command, Departments, and Equivalent Units under the Ministry of Public Security, Provincial Public Security Departments, and Municipal Public Security Departments directly under the Central Government

a) Disseminate and implement regulations on recruiting citizens into the People's Public Security to the officers and soldiers of their units and localities;

b) Based on the staffing situation and needs for each position and job, guide subordinate Public Security units and localities to implement and propose recruitment targets for citizens into the People's Public Security;

c) Establish a Recruitment Board, organize strict implementation, and make temporary recruitment and recruitment decisions in accordance with the regulations of the Ministry of Public Security on recruiting citizens into the People's Public Security;

d) Be responsible to the Minister of Public Security during the organization of recruitment; handle complaints and reports about recruitment in accordance with the law on complaints and reports;

đ) Fully implement policies for citizens during temporary recruitment and after recruitment; organize training, instruction, and professional development for those recruited; deploy and utilize them according to the分级管理权限。

e) Based on the characteristics of work and combat, security and intelligence units may supplement conditions and standards for candidates, examination and recruitment content, but must not contravene the provisions of this Circular.

2. The Cadre and Civil Servant Organization Department

a) Advise the Standing Committee of the Party Central Committee of Public Security and the leadership of the Ministry on the policy and plan for recruiting citizens into the People's Public Security annually;

b) Guide Public Security units and localities to determine needs, develop plans, and implement recruitment plans for citizens in accordance with regulations, meeting the requirements of the People's Public Security;

c) Review and consolidate to submit to the Minister of Public Security for approval the recruitment targets for citizens into the People's Public Security for each Public Security unit and locality;

d) Monitor, urge, guide, and inspect the implementation of recruitment of citizens into the People's Public Security by Public Security units and localities;

đ) Fulfill responsibilities stipulated in Clause 1 of this Article.

3. Units directly managing and utilizing cadres (at the department level and equivalent)

a) Annually, based on the staffing situation, needs, and guidance from superiors, propose recruitment targets for citizens into the People's Public Security for their units; coordinate to organize recruitment according to functional requirements and superior instructions;

b) Guide temporarily recruited personnel to understand internal regulations, work rules of the agency or unit, state secrets protection regulations of the Public Security sector, and practice tasks they will undertake after recruitment;

c) Within three working days from the date the citizen reports for duty, the head of the unit must assign competent and experienced professionals to guide the temporarily recruited personnel. Each officer can only guide one temporarily recruited person at a time.

Article 23. Responsibilities of Citizens Temporarily Selected or Selected for the People's Police

1. Citizens must report for duty on the date, month, and year specified in the decision on temporary selection or selection. In cases where there are valid reasons preventing them from reporting for duty within the time limit stated in the decision, they must submit a request for extension and obtain the consent of the head of the directly managing unit. The duration of each extension shall not exceed five working days and may not be extended more than twice.

2. When citizens report for duty, they must write a commitment not to seek out or come into contact with state secrets-related materials without authorization; not to disclose assigned tasks or related knowledge concerning the agency or unit where they have been temporarily selected or selected.

3. To fulfill their duties and responsibilities, and refrain from actions prohibited for police officers, non-commissioned officers, and soldiers as stipulated in Articles 31 and 32 of the Law on the People's Police 2018.

Article 24. Handling of Responsibility

1. The heads of local police units must bear responsibility for resolving issues related to the rights and legitimate interests of citizens when their temporary selection or selection decisions are revoked according to Clause 2, Article 17 of this Circular; at the same time, they must return to the State budget the portion of funds spent on salaries and policies based on the salary paid to the temporarily selected or selected citizens.

Depending on the nature and severity of the violation, the Director of the Personnel Organization Department will submit to the Minister of Public Security for consideration to restrict or not grant the authority to select citizens for the People's Police, and propose disciplinary measures according to Circular No. 49/2019/TT-BCA dated October 15, 2019, issued by the Minister of Public Security on the handling of disciplinary actions against public security officers (hereinafter referred to as Circular No. 49/2019/TT-BCA).

2. Direct personnel who advise or propose the selection of citizens for the People's Police who intentionally violate regulations or lack a sense of responsibility in their work (as concluded by competent authorities) or have been disciplined for misconduct (except for the revocation of the title of People's Police officer), depending on the nature and severity of the violation, will be subject to disciplinary action according to Circular No. 49/2019/TT-BCA.

3. Citizens who are temporarily selected or selected and fail to report for duty within the time limit specified in the decision on temporary selection or selection without the consent of the head of the directly using unit or exceed the extended period as stipulated in Clause 1, Article 23 of this Circular will be subject to disciplinary action according to Circular No. 49/2019/TT-BCA or have their temporary selection or selection decision revoked, depending on the nature and severity of the violation.

4. All violations in the process of selecting citizens for the People's Police, once concluded or decided upon by the competent authority, must be publicly announced within the local police unit; if general lessons need to be drawn, the Personnel Organization Department will issue a notice throughout the force.

Chapter III

IMPLEMENTING PROVISIONS

Article 25. Effective Date

1. This Circular takes effect from January 1, 2020, and replaces Circular No. 30/2009/TT-BCA dated May 20, 2009, issued by the Minister of Public Security on the selection of citizens for the People's Police (hereinafter referred to as Circular No. 30/2009/TT-BCA) and Circular No. 35/2011/TT-BCA dated May 25, 2011, issued by the Minister of Public Security amending Article 5 of Circular No. 30/2009/TT-BCA dated May 20, 2009, on the selection of citizens for the People's Police (hereinafter referred to as Circular No. 35/2011/TT-BCA).

2. In cases where the referenced documents in this Circular are amended, supplemented, replaced, or newly issued, the relevant contents of this Circular will also be adjusted according to the amended, supplemented, replaced, or newly issued documents.

Article 26. Transitional Provisions

Cases of temporary selection or selection for the People's Police before the effective date of this Circular will continue to be implemented according to Circular No. 30/2009/TT-BCA and Circular No. 35/2011/TT-BCA.

Article 27. Responsibility for Implementation

1. The head of local police units shall be responsible for organizing the implementation of this Circular.

2. The Director of the Personnel Organization Department is responsible for guiding and inspecting the implementation of this Circular; prescribing uniform forms for use in the selection of citizens for the People's Police.

Any difficulties encountered during the implementation process shall be reported to the Ministry (through the Cadre Organization Department) for consolidation and reporting to the Minister for consideration and decision./.
