CIRCULAR

REGULATIONS ON THE WORK OF COMPETITION AND REWARD OF THE MINISTRY OF CONSTRUCTION

On the basis of Law on Competition and Reward dated June 15, 2022;

Decree No. Decision No. 152/2025/NĐ-CP of June 14, 2025 of the Government on分级处理和授权领域的规定；对《奖励与表彰法》若干条款的具体规定和实施指导； 《奖励与表彰法》；

Decree No. 决定第33/2025/NĐ-CP号，2025年2月25日，政府关于建设部职能、任务、权限和组织结构的规定；

根据干部人事司司长的建议；

建设部部长发布此通报，规定建设部的竞争和奖励工作。

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

本通报详细规定了《奖励与表彰法》2022年第24条第4款；第26条第3款；第27条第3款；第28条第3款；第71条第2款；第74条第6款；第75条第2款；第81条第1款；以及第84条第6款的执行；根据政府第152/2025/NĐ-CP号决定关于分级处理和授权领域的规定，规定了被授权的内容；对《奖励与表彰法》若干条款的具体规定和实施指导（以下简称“通报”）。

Article 2. Applicability

1. 属于建设部的组织和个人，省或中央直辖市人民政府的专业机关，乡级人民委员会在建设领域。

2. 对建设部的发展有贡献的家庭、个人或其他组织，与建设部的竞争和奖励工作相关。

Article 3. Competitions and Clusters of the Ministry of Construction

1. The Competition Cluster is organized by the Competition and Reward Council of the Ministry of Construction to launch and implement competition movements, sign competition agreements, conduct mid-term and final reviews of competition movements, and propose rewards to competent authorities according to regulations.

2. The Competition Group is organized by the Competition and Reward Councils of subordinate agencies and units with legal personality under the Ministry of Construction to launch and implement competition movements, sign competition agreements, conduct mid-term and final reviews of competition movements, and propose rewards to competent authorities according to regulations.

Article 4. Recognition of Task Completion Levels for Individuals and Groups Under the Management Authority of the Ministry of Construction

The recognition of task completion levels for individuals and groups under the Ministry of Construction's subordinate agencies and units shall be carried out in accordance with the regulations of the Party, state laws, and the regulations of the Ministry of Construction.

Chapter II
OBJECTS, CRITERIA, FILES, PROCEDURES FOR AWARDS OF COMPETITION AND REWARDS UNDER THE AUTHORITY OF THE MINISTRY OF CONSTRUCTION AND ITS SUBORDINATE AGENCIES

Article 5. "Advanced Worker" Title

1. The "Advanced Worker" title is awarded to cadres, civil servants, public officials, and workers under and directly subordinate to the Ministry of Construction's agencies and units who meet the criteria stipulated in Clause 1, Article 24 of the Law on Competition and Reward 2022.

2. The evaluation of the "Advanced Worker" title in certain specific cases shall be carried out in accordance with Clause 5, Article 2 of Circular No. 15/2025/TT-BNV dated August 4, 2025, issued by the Minister of Home Affairs, guiding the implementation of the Law on Competition and Reward and Decision No. 152/2025/NĐ-CP of June 14, 2025, of the Government on分级处理和授权领域的规定；对《奖励与表彰法》若干条款的具体规定和实施指导；

Article 6. The Flag of Excellence of the Ministry of Construction

The title of the Flag of Excellence of the Ministry of Construction shall be awarded to collectives in the following cases:

1. Annually to the leading collective in the excellence movement organized by the Ministry of Construction and meeting the standards prescribed in Clause 1 of Article 26 of the Law on Commendation and Reward.

2. To the leading collective in the excellence movement on specific topics launched by the Ministry of Construction with a duration of implementation of three years or more when concluding the movement and meeting the criteria of the excellence movement on specific topics.

Article 7. The Title "Outstanding Labor Collective"

1. The title "Outstanding Labor Collective" shall be awarded to collectives under and affiliated with the Ministry of Construction that meet the standards stipulated in Clause 1 of Article 27 of the Law on Commendation and Reward.

2. The title "Outstanding Labor Collective" shall not be considered for awarding to collectives under and affiliated with the newly established Ministry that have been operating for less than one year as of the time the unit submits the commendation dossier, except for agencies and units that have merged or consolidated.

Article 8. The Title "Advanced Labor Collective"

1. The title "Advanced Labor Collective" shall be awarded to collectives under and affiliated with the Ministry of Construction that meet the standards stipulated in Clause 1 of Article 28 of the Law on Commendation and Reward.

2. The title "Advanced Labor Collective" shall not be considered for awarding to collectives under and affiliated with the newly established Ministry that have been operating for less than one year as of the time the unit submits the commendation dossier, except for agencies and units that have merged or consolidated.

Article 9. Certificate of Merit of the Ministry of Construction

1. The Certificate of Merit of the Ministry of Construction shall be awarded or posthumously awarded to individuals who set a good example in implementing the Party's policies, State laws, and achieve one of the following criteria:

a) Achieving outstanding results recognized in excellence movements initiated or implemented by the Minister of Construction;

b) Achieving many merits or outstanding achievements with influence in one of the sectors or fields under the management of the Ministry of Construction;

c) Contributing to economic and social development, applying scientific and technological progress, social work, humanitarian aid in sectors or fields and public services managed by the Ministry of Construction according to the law;

d) Being awarded the title "Model Worker at the Grassroots Level" twice consecutively or being recognized as having completed tasks excellently for two consecutive years or more, during which period two initiatives were recognized and effectively applied within the grassroots level or two scientific research projects, scientific programs, and science and technology works were successfully reviewed and effectively applied within the grassroots level;

đ) Having worked in agencies and units under the Ministry of Construction for ten years or more (for men), eight years or more (for women), achieving many merits or outstanding achievements, contributing to the development of the agency or unit; having five consecutive years before the proposal date rated as completing tasks well or better, during which period at least one time was rated as completing tasks excellently. Individuals proposed for awarding on the occasion of the anniversary of the establishment or traditional day of the agency or unit (full year);

e) Individuals working in the Ministry of Construction, Construction Departments, Urban Planning and Architecture Departments of provinces and centrally-administered cities, eligible for awarding before retirement as follows:

For individuals working in agencies and units under the Ministry of Construction: having five consecutive years before retirement rated as completing tasks well or better;

For individuals working in Construction Departments, Urban Planning and Architecture Departments: having held the position of Department Director or Deputy Director for five years or more, during which period they were continuously rated as completing tasks well or better.

2. The Certificate of Merit of the Ministry of Construction shall be awarded or posthumously awarded to business leaders, intellectuals, scientists who comply well with the Party's policies, State laws, and achieve one of the criteria specified in Point a, Point b, or Point c of Clause 1 of this Article or have made contributions in the construction and development of the Ministry of Construction recognized by the Ministry of Construction.

3. The Certificate of Merit of the Ministry of Construction shall be awarded to exemplary collectives that comply well with the Party's policies, State laws, maintain internal unity, and meet one of the following criteria:

a) Achieving outstanding results recognized in excellence movements initiated or implemented by the Minister of Construction;

b) Achieving outstanding and sudden merits with influence in one of the sectors or fields under the management of the Ministry of Construction;

c) Contributing to economic and social development, applying scientific and technological progress, social work, humanitarian aid in sectors or fields and public services managed by the Ministry of Construction according to the law;

d) Agencies and units under the Ministry of Construction that have been recognized as completing tasks excellently for two consecutive years or have been awarded the title "Outstanding Labor Collective" for two consecutive years, implementing democracy at the grassroots level, organizing excellent excellence movements; caring for the material and spiritual life of the collective; practicing thrift, combating waste; preventing corruption and negative practices;

đ) Agencies and units under the Ministry of Construction that have been established for ten years or more, including five consecutive years before the proposal date rated as completing tasks well or better and are awarded on the occasion of the anniversary of the establishment or traditional day of the agency or unit (full year).

4. The Certificate of Merit of the Ministry of Construction shall be awarded to individuals and collectives under ministries, departments, and sectors; individuals and collectives under associations, social funds, charitable funds, non-governmental organizations; individuals and collectives under enterprises and economic organizations who set a good example in complying with the Party's policies, State laws, have made contributions in the process of cooperating to implement tasks of the Ministry of Construction or meet one of the criteria specified in Point a, Point b, or Point c of Clause 1 of this Article or Point a, Point b, or Point c of Clause 3 of this Article or have made contributions in the construction and development of the Ministry of Construction.

5. The Certificate of Merit of the Ministry of Construction shall be awarded to exemplary families that comply well with the Party's policies, State laws, and have made significant contributions to society in sectors or fields under the management of the Ministry of Construction.

6. The Certificate of Merit of the Ministry of Construction shall be awarded to Vietnamese individuals and collectives residing abroad; foreign individuals and collectives who have made contributions in the construction and development of the Ministry of Construction.

Article 10. Certificate of Merit

1. The Certificate of Merit issued by the Head of the agency or unit under and directly under the Ministry with legal personality; the Certificate of Merit issued by the Chairman of the Board of Directors, the Chairman of the Board of Members, the General Director, or the Director of enterprises under and directly under the Ministry to present to individuals or groups meeting one of the criteria specified in Clause 3 and Clause 4 of this Article.

2. The Certificate of Merit issued by the Minister of Construction to present to

a) Groups meeting one of the criteria specified in Clause 4 of this Article; including: Departments directly under the Ministry, the Office of the Ministry, and groups within Departments and the Office of the Ministry; advisory agencies and organizations assisting the Party Committee of the Ministry in performing their regular duties at inter-ministerial coordination organizations;

b) Individuals belonging to the groups specified in point a of this clause, meeting one of the criteria specified in Clause 3 of this Article.

3. Criteria for awarding the Certificate of Merit to individuals

a) Completing tasks satisfactorily or better; having good moral qualities; being united, exemplary in implementing the policies of the Party and laws of the State; internal regulations and working rules of the agency or unit;

b) Achieving outstanding results recognized in competitive campaigns initiated by the agency or unit;

c) Achieving many merits or sudden achievements in the field managed by the agency or unit.

4. Criteria for awarding the Certificate of Merit to groups

a) Completing tasks satisfactorily; maintaining unity, being exemplary in implementing the policies of the Party and laws of the State, effectively practicing democracy at the grassroots level, thrift, and anti-waste;

b) Achieving outstanding results recognized in competitive campaigns.

c) Achieving many merits or sudden achievements in the field managed by the agency or unit.

Article 11. Commemorative Medal

1. The Commemorative Medals of the Ministry of Construction include the "For the Development of Vietnam's Transport Industry" Commemorative Medal and the "For Construction" Commemorative Medal to be awarded or posthumously awarded to individuals working in industries and fields under the management authority of the Ministry of Construction (hereinafter referred to as within the industry) and individuals outside the industry who have contributed to the development of industries and fields under the management authority of the Ministry of Construction.

a) The "For the Development of Vietnam's Transport Industry" Commemorative Medal to be awarded or posthumously awarded to individuals working in the transport sector nationwide, including: roadways, railways, inland waterways, maritime, civil aviation, and inspection services; managing public services in the transport sector and individuals who have contributed to the development of the transport sector;

b) The "For Construction" Commemorative Medal to be awarded or posthumously awarded to individuals working in the construction sector nationwide, including: planning, architecture; investment activities; urban development; technical infrastructure; housing; real estate market; building materials; managing public services in the construction sector and individuals who have contributed to the development of the construction sector.

2. Principles for awarding Commemorative Medals

a) The awarding of Commemorative Medals must ensure accuracy, fairness, democracy, transparency, and timeliness, in accordance with the criteria stipulated in this Circular;

b) Each type of Commemorative Medal can only be awarded or posthumously awarded once to an individual. If an individual meets the criteria, they may be awarded two types of Commemorative Medals;

c) The second Commemorative Medal can only be awarded after the individual has received the first Commemorative Medal for at least three years;

d) For individuals specified in Clause 3 of this Article, if they have worked in remote, mountainous, or island areas and are entitled to regional allowances of 0.5 or more according to regulations, the actual working time in these areas will be multiplied by a factor of 1.5;

đ) Commemorative Medals shall not be awarded to individuals who voluntarily leave their jobs; those disciplined with dismissal or criminal prosecution; those under disciplinary review or investigation, prosecution, or trial; or those currently serving disciplinary sanctions;

In cases where individuals are subject to disciplinary action, the period of disciplinary sanction shall not be counted towards the period for awarding Commemorative Medals;

e) For individuals within the industry who are transferred or reassigned from the transport sector to the construction sector or vice versa, they may be proposed for the awarding of Commemorative Medals based on the sector they worked in or are currently working in at the time of the proposal for the awarding of Commemorative Medals (or before retirement);

In cases where individuals work in agencies or units with common functions and responsibilities for both the transport sector and the construction sector, the Head of the agency or unit managing the individual decides to propose the awarding of one type of Commemorative Medal.

3. Criteria for awarding Commemorative Medals to individuals within the industry

Individuals currently employed or retired with good moral qualities, completing assigned tasks during their employment period, meeting one of the following criteria:

a) Having a total working period of 20 years or more for males, 15 years or more for females. For the second Commemorative Medal, the total working period must be 25 years or more for males, 20 years or more for females;

b) Having a total period of five years or more in leadership positions at the Department/Council level or equivalent under the Ministry or leading specialized agencies in the transport and construction sectors under provincial/municipal People's Committees or higher;

For the second Commemorative Medal, the total period must be ten years or more in leadership positions at the Department/Council level or equivalent under the Ministry or leading specialized agencies in the transport and construction sectors under provincial/municipal People's Committees or higher;

c) For individuals transferred to agencies or units within the industry or from agencies or units within the industry to other sectors, having a continuous working period of 25 years, including a working period in the industry and fields under the management authority of the Ministry of Construction of 10 years or more for males, eight years or more for females;

d) An individual working in the industry, currently employed or retired, with good moral character, who has fulfilled assigned tasks during their tenure and meets the conditions stipulated in Clause 4 of this Article shall be considered for the award of the Commendation Medal.

4. Criteria for considering the award of the Commendation Medal to individuals who have made contributions and achievements towards the development of the industry and sector under the management authority of the Ministry of Construction, meeting one of the following criteria:

a) Having outstanding contributions and achievements in work, leadership, guidance, and management, contributing to the construction and development of the industry and sector under the management authority of the Ministry of Construction, and obtaining the unified opinion of the provincial People's Committee, ministry, or sector from the Ministry of Construction.

b) Proposing innovative ideas, solutions, or scientific research projects with practical value, making substantial and effective contributions to the development of the industry and sector under the management authority of the Ministry of Construction, and obtaining the unified opinion of the provincial People's Committee, ministry, or sector from the Ministry of Construction.

c) Contributing resources (intellectual, financial, or material) to the construction and development of the industry and sector under the management authority of the Ministry of Construction, and obtaining the unified opinion of the provincial People's Committee, ministry, or sector from the Ministry of Construction.

d) Making contributions to the construction, development, and consolidation of cooperative relations between Vietnam and other countries and international organizations, contributing to the development of the industry and sector under the management authority of the Ministry of Construction.

đ) Other cases where individuals make contributions and achievements and are confirmed by the Ministry of Construction.

5. Authority to propose commendation awards

a) Annually, the heads of agencies and units under the Ministry of Construction shall review applications, compile lists, and propose the award of the Commendation Medal to individuals under their management who meet the criteria set forth in Article 11 of the Circular (including those who have retired according to regulations; in cases where agencies or units are dissolved or merged, the agency or unit assuming the responsibilities shall be responsible for reviewing and proposing) and related individuals who meet the specified criteria.

b) Annually, the Directors of Construction Departments and Planning and Architecture Departments of provinces and centrally-administered cities shall review applications, compile lists, and propose the award of the Commendation Medal to individuals under their management and other individuals in their locality who meet the criteria set forth in Article 11 of this Circular.

c) The Director of the International Cooperation Department shall review applications, compile lists, and propose the award of the Commendation Medal to foreign individuals, overseas Vietnamese, or individuals working for foreign organizations.

6. Individuals receiving the Commendation Medal shall be awarded a Certificate of the Commendation Medal and the emblem (logo) of the Ministry of Construction; they are also responsible for continuing to uphold and promote traditions in industries and sectors under the management authority of the Ministry of Construction; serving as role models in implementing Party policies and State laws.

Article 12. Banner of the Ministry of Construction

The banner of the Ministry of Construction is presented to agencies and units under and directly under the Ministry of Construction; Construction Departments, Planning and Architecture Departments; Associations and Trade Unions in the industry and sector managed by the Ministry of Construction on the occasion of celebrating traditional anniversaries (on the prescribed round anniversary years), having made contributions to the development of the industry and sector under the management authority of the Ministry of Construction and meeting the following criteria:

1. Actively participating in regular, practical, and effective competitive movements initiated by the Ministry of Construction.

2. Internal unity; the party organization and mass organizations recognized by competent authorities as completing tasks well; actively practicing thrift, combating waste, corruption, and other social evils.

Chapter III
AUTHORITY TO DECIDE ON RECOGNITION AWARDS AND APPLICATIONS, PROCEDURES FOR PROPOSING RECOGNITION AWARDS

Article 13. General provisions on files and procedures for commendation

1. The commendation proposal file must ensure compliance with the prescribed time limit, components, and contents. The subject proposed for commendation is responsible for the accuracy of their achievement report.

The national-level commendation proposal file of agencies and units under the Ministry must have the unified opinion of the Ministry's leadership responsible before being submitted to the Standing Committee of the Ministry of Construction's Competition and Commendation Council.

In cases where the subject considered for awarding titles and commendation forms is a collective or the head of a production or business unit, the achievement report must include the implementation of tax payment obligations; ensuring environmental protection, labor safety, and food hygiene (with extracts and confirmation contents from competent state agencies).

2. The head of the unit proposing commendation is responsible for the accuracy of the commendation proposal file; evaluates and signs to confirm before submitting to the competent authority for commendation:

a) Achievement reports of individuals, collectives, and households;

b) Results of implementing the commendation procedures;

c) Contents related to the implementation of Party policies, State laws.

3. For individuals who have retired (or died or passed away): the commendation proposal file is examined and proposed by the agency managing the individual before retirement (or death or passing away).

For collectives and individuals belonging to agencies and units that have been dissolved, merged, consolidated, or reorganized, the agency or unit receiving the tasks of those collectives and individuals examines and proposes commendation.

4. For Vietnamese individuals residing abroad or foreign individuals, and collectives, the provisions of the Law on Competition and Commendation 2022 and related documents on commendation involving foreign elements shall apply.

5. Soliciting opinions from relevant agencies before submitting to the Minister for consideration and commendation is carried out by the Cadre and Civil Servant Organization Department.

6. Competition and Commendation Councils at all levels must conduct voting when meeting to consider competition titles and commendation forms. The voting result is the percentage (%) of agreeing votes over the total number of Council members.

Cases proposed for awarding the title "Model Worker at the Grassroots Level" and the flag "Competition Flag of the Ministry of Construction" must achieve a voting result of 80% or higher; individuals proposed for awarding the title "Model Worker of the Ministry of Construction" must achieve a voting result of 90% or higher.

The meeting results and voting results must be fully reflected in the competition examination record and the commendation examination record.

7. The Standing Committee of the Competition and Commendation Council of the Ministry of Construction is responsible for receiving, examining the commendation files, and reporting:

a) The Competition and Commendation Council of the Ministry of Construction considers commendations for national-level competition titles; national-level commendation forms; "Flag of the Ministry of Construction"; "Model Worker of the Ministry of Construction";

b) The Minister considers and decides on commendations for: "Excellent Labor Collective", "Advanced Labor Collective", Merit Certificate of the Ministry of Construction, Commemorative Medal, Banner of the Ministry of Construction, and Minister's Certificate of Commendation.

8. The proposal file for awarding competition titles and commendation forms at the Ministry level is established in one set (original copy) sent to the Ministry of Construction (Cadre and Civil Servant Organization Department); simultaneously sending the file in electronic format (Word file and PDF file) to the email address [email protected] (except for documents containing state secrets).

The validity period of the achievement report in the commendation file: not exceeding six months from the date the Ministry of Construction (Cadre and Civil Servant Organization Department) receives the commendation file.

The deadline for the Ministry of Construction to receive commendation proposal files is as follows:

a) For "Excellent Labor Collective", "Advanced Labor Collective", "Model Worker of the Ministry of Construction", Merit Certificate of the Ministry of Construction, Flag of the Ministry of Construction, and Flag of the Government, send to the Ministry of Construction no later than March 31 each year; for schools with evaluation and classification periods according to academic years and business sectors, the deadline for sending to the Ministry of Construction is no later than September 30 each year.

b) For Commemorative Medals: send before March 1 each year;

c) For commendations based on competition movements, the submission deadline for files follows the requirements of the competition movement.

10. Time to announce the results of commendation examination

a) For cases meeting the conditions and standards for commendation as prescribed, the Cadre and Civil Servant Organization Department implements the procedure to propose the Minister to examine and decide on commendation or submit to the competent authority for commendation and notify the proposing unit within twenty-five days from the date of receipt of the complete file as prescribed;

b) For cases not meeting the conditions and standards, within ten days from the date of receipt of the commendation proposal or from the date of the formal opinion of the competent authority for commendation examination, the Cadre and Civil Servant Organization Department notifies the proposing unit.

Article 14. Authority to Decide on Awards

1. For national-level and ministry-level awards: carried out in accordance with the provisions of the Law on Competition and Rewards and the Government Decree detailing implementation of certain articles of the Law on Competition and Rewards in 2022.

2. The Minister

a) Bestows the title "Outstanding Labor Collective" on agencies and units under the Ministry; other organizations assisting the Minister in performing inter-ministerial coordination organization tasks; collectives under the Ministry's Departments, the Ministry’s Office; advisory and support agencies for the Party Committee of the Ministry;

b) Bestows the titles "Model Worker at the Grassroots Level" and "Advanced Worker" on individuals belonging to: the Ministry's Departments, the Ministry’s Office; other organizations assisting the Minister in performing inter-ministerial coordination organization tasks; advisory and support agencies for the Party Committee of the Ministry;

3. Heads of agencies and units with legal personality under the Ministry decide to bestow the titles "Outstanding Labor Collective", "Advanced Labor Collective", "Model Worker at the Grassroots Level", "Advanced Worker" and commendation certificates on collectives and individuals within their management authority.

Article 15. Provisions on the Composition of the Nomination File for Awards

1. The nomination file for considering commendation titles and forms of reward within the authority of the Minister shall be implemented according to the provisions of Article 84 of the Law on Competition and Rewards and the Emblem of the Ministry of Construction, including: one set (original).

a) Nomination report for awarding;

b) Report on achievements of the collective or individual nominated for awarding;

c) Minutes of meeting to assess competition and award;

Minutes of assessment of competition by the Competition and Award Council at the grassroots level when nominating the commendation titles "Outstanding Labor Collective", "Advanced Labor Collective", "Advanced Worker"; Minutes of assessment of competition and award and voting results of the agency, unit collective or the Competition and Award Council at the grassroots level when nominating the commendation titles "Model Worker at the Grassroots Level", "Model Worker of the Ministry of Construction", "Flag of the Ministry of Construction";

Minutes of assessment by the Competition Group when nominating the presentation of "Flag of the Ministry of Construction" and "Certificate of Merit of the Ministry of Construction";

d) Decision or confirmation by the Minister regarding applied initiatives that have been effective and replicable within the Ministry of Construction or scientific research topics, scientific projects, scientific and technological works that have been accepted and effectively applied, having influence within the Ministry of Construction for cases of nominating the title "Model Worker of the Ministry of Construction". Decision or confirmation by the competent agency or unit regarding applied initiatives or scientific research topics, scientific projects, scientific and technological works or decision recognizing outstanding completion of tasks for cases of nominating the title "Model Worker at the Grassroots Level", Certificate of Merit of the Ministry of Construction for achievements.

2. The nomination file for presenting Commemorative Medals includes one set (original):

a) Nomination report for presenting Commemorative Medals (attached list);

b) Summary of the career of the individual nominated for presenting Commemorative Medals. For individuals outside the industry nominated for presenting Commemorative Medals, the file includes the nomination report attached with a list summarizing contributions.

The model of the nomination file for awarding follows the provisions from 1.1 to 1.8 in the Appendix attached to this Circular.

Article 16. Organization of Awarding

1. The Minister shall directly award or delegate to the Heads of Ministries, Heads of agencies, and units to present commendation titles and forms of reward at the ministerial level.

2. The Cadre and Civil Service Department shall take the lead and coordinate with the Ministry's Office to organize the presentation of commendation titles and forms of reward to collectives and individuals under the advisory and assisting agencies of the Minister.

3. Agencies, organizations, and units shall organize the presentation of commendation titles and forms of reward in a solemn and frugal manner.

Chapter IV
PROCEDURES FOR ISSUING, REISSUING AWARD ITEMS; PROCEDURES FOR WITHDRAWING DECISIONS TO AWARDS AND RECOVERING AWARD ITEMS AND AWARDS MONEY

Article 17. Procedures for certification, issuance, and reissuance of award items within the authority of the Ministry

1. The application dossier for issuing and reissuing award items at the ministerial level (one original copy) includes:

a) A letter requesting issuance or reissuance from a collective or an individual's or household's request for certification when the award item is damaged and no longer usable due to objective reasons such as natural disasters, floods, fires, or printing errors.

b) A letter requesting issuance or reissuance from subordinate units of the Ministry, Construction Departments, Planning and Architecture Departments (hereinafter referred to as the units that have submitted for awards), accompanied by a list that has been reviewed and sent to the Ministry of Construction for certification of ministerial-level awards.

2. Procedures for certification of ministerial-level awards:

a) Collectives submit letters, individuals or households submit applications (according to Model 2.1 and 2.2 of the annex issued together with this Circular) along with the award items.

b) The units that have submitted for awards compare with the retained files, confirm, compile, and send a letter requesting certification of awards to the Ministry of Construction, accompanied by a list (according to Model 2.3 of the annex issued together with this Circular) that has been reviewed and retain the old damaged award items; implement disposal and destruction according to the law.

c) Based on the letter requesting certification of awards from the units that have submitted for awards, the Ministry of Construction reviews and certifies the awards (according to Model 2.4 of the annex issued together with this Circular).

3. Time limit for processing certification of ministerial-level awards: within 60 days from the date of receipt of the application dossier from the units that have submitted for awards.

Article 18. Procedures for revoking decisions to confer commendation titles or forms of reward, and recovering award items and awards money for commendation titles or forms of reward within the authority of the Ministry

1. Individuals, collectives, or households who commit acts as specified in Clause 2 of Article 93 of the Law on Commendation and Awards 2022 shall have their decisions to confer commendation titles or forms of reward revoked and their received award items and awards money recovered.

2. The application dossier for revoking decisions to confer commendation titles or forms of reward consists of one set (original copy) including:

a) A proposal from the unit requesting recovery for each commendation title or form of reward for individuals, collectives, or households.

b) A summary report from the direct unit submitting for awards regarding the reasons for requesting revocation of the decision to confer commendation titles or forms of reward (accompanied by the Decision on Awards).

3. Based on the conclusion of the competent authority determining that individuals or collectives have committed violations as specified in Clause 2 of Article 93 of the Law on Commendation and Awards 2022, the unit submitting for awards shall be responsible for proposing the Ministry of Construction to issue a decision revoking the decision to confer commendation titles or forms of reward and recover the award items and awards money.

4. The Cadre and Civil Service Department shall compile the dossier and submit it to the Minister of Construction within 10 days from the date of receiving all required documents.

5. The dossier compiled by the Cadre and Civil Service Department and submitted to the Minister of Construction includes: The proposal from the Cadre and Civil Service Department along with the dossier stipulated in Clause 2 above.

6. Recovery of award items and awards money

a) Within 15 days from the date of receipt of the decision to revoke the decision to confer commendation titles or forms of reward by the Minister of Construction, the unit that has submitted for awards must return the received award items within the prescribed time and send them back to the Ministry of Construction; the recovered awards money shall be deposited into the state budget or the commendation and awards fund according to regulations.

b) The Cadre and Civil Service Department shall be responsible for urging units and organizations to recover award items.

Article 19. Procedures for revoking decisions to confer commendation titles or award forms, and recovering awarded items and monetary rewards under the authority of agencies or units under the Ministry.

1. Individuals, collectives, or households who commit acts as specified in Clause 2 of Article 93 of the Law on Commendation and Awards 2022 shall have their decisions to confer commendation titles or forms of reward revoked and their received award items and awards money recovered.

2. The application dossier for revoking decisions to confer commendation titles or forms of reward consists of one set (original copy) including:

a) A proposal from the unit requesting revocation for each commendation title or award form for individuals, groups, or households.

b) A summary report from the direct unit submitting for awards regarding the reasons for requesting revocation of the decision to confer commendation titles or forms of reward (accompanied by the Decision on Awards).

3. Based on the conclusion of the competent authority determining that individuals or groups have committed violations as stipulated in Clause 2 of Article 93 of the Law on Commendation and Awards 2022, the agency or unit shall be responsible for issuing a decision to revoke the decision to confer commendation titles or award forms and recover awarded items and monetary rewards.

4. The agency or unit must report to the Ministry of Construction through the Personnel Organization Department within 10 days after issuing the decision to revoke the decision to confer commendation titles or award forms and recover awarded items and monetary rewards.

5. The dossier sent to the Ministry of Construction includes: the report of the agency or unit along with the dossier prescribed in Clause 2 of this Article.

6. Recovery of award items and awards money

a) Within 15 days from the date of issuance of the decision to revoke the decision to confer commendation titles or award forms by the head of the agency or unit, the individual, group, or household must return all awarded items and monetary rewards received to the unit.

b) The rewarding agency or unit is responsible for urging individuals, groups, or households to return awarded items within the specified time limit and report to the Ministry of Construction within 15 days from the date of receiving the recovered items; the recovered monetary rewards must be deposited into the state budget or the commendation and reward fund as prescribed.

c) The direct recommending agency is responsible for urging and organizing the recovery of awarded items.

d) The advisory department for commendation and reward work of the entity with legal personality is responsible for notifying the decision to revoke in cases within the authority of the entity's head.

Chapter V
ORGANIZATION AND OPERATIONS OF THE COMMENDATION AND REWARD COUNCIL OF THE MINISTRY OF CONSTRUCTION AND THE COMMENDATION AND REWARD COUNCILS OF AGENCIES AND UNITS UNDER THE MINISTRY OF CONSTRUCTION

Article 20. Organization of the Commendation and Reward Councils at various levels under the Ministry of Construction

1. The Commendation and Reward Councils at various levels under the Ministry of Construction include:

a) The Commendation and Reward Council of the Ministry of Construction (hereinafter referred to as the Central Council);

b) The Commendation and Reward Council at the grassroots level, including the Commendation and Reward Council of the Ministry of Construction's agency and the Commendation and Reward Councils of agencies and units with legal personality directly under the Ministry of Construction (hereinafter referred to as the Grassroots Council).

c) The Commendation and Reward Council below the grassroots level.

2. The Central Council

a) The Central Council is established by the Minister of Construction and is responsible for advising and consulting the Minister of Construction on the commendation and reward work of the Ministry of Construction;

b) The Council consists of: the Chairman, Vice Chairmen, and Council Members;

The Chairman of the Council is the Minister of Construction; the permanent Vice Chairman of the Council is the Deputy Minister in charge of commendation and reward work; other Vice Chairmen and Council Members are appointed by the Minister of Construction.

The permanent body of the Central Council is the Personnel Organization Department.

3. The Grassroots Council

a) The Commendation and Reward Council of the Ministry of Construction's agency (hereinafter referred to as the Agency Council) is established by the Minister of Construction and is responsible for advising and consulting the Minister of Construction on the commendation and reward work of agencies and units without legal personality directly under the Ministry of Construction. The Council consists of: the Chairman, Vice Chairmen, and Council Members;

The Chairman of the Agency Council is the Deputy Minister in charge of commendation and reward work of the Ministry, the Vice Chairman is the leader of the Personnel Organization Department in charge of commendation and reward work, and the Council Members are appointed by the Chairman of the Agency Council.

The permanent body of the Agency Council is the Personnel Organization Department.

b) The Commendation and Reward Councils of agencies and units with legal personality directly under the Ministry of Construction are established by the heads of these agencies and units and are responsible for advising and consulting their heads on commendation and reward work.

The Council consists of the Chairman, Vice Chairmen, and Council Members.

The Chairman of the Council is the head of the agency or unit; the Vice Chairmen and Council Members are appointed by the head of the agency or unit.

The permanent body of the Council is the advisory department for commendation and reward work of the agency or unit.

4. The Commendation and Reward Council below the grassroots level

The establishment of the Commendation and Reward Council below the grassroots level (if any) is decided by the head of the agency or unit with legal personality under and directly subordinate to the agencies and units under the Ministry.

Article 21. Activities of the Competition and Reward Councils at all levels under the Ministry of Construction

1. The Council operates on a collective basis with individual responsibility; it convenes meetings according to the requirements of competition and reward work and conducts voting by majority.

2. The Council convenes a meeting when at least two-thirds of its total members attend. For matters concerning the consideration and recommendation for awarding the title of National Model Worker and Labor Hero, at least ninety percent of the total Council members must attend.

3. At each session of the Council, if a Council member is absent, they must appoint another person to attend the meeting to ensure continuity and decision-making authority over matters related to their area of responsibility; the opinion of the substitute attendee is considered the opinion of the Council member.

The substitute attendee is responsible for the opinions they contribute during discussions at the meeting and any decisions made by the Council; they may vote on competition and rewards, participate in resolutions on discussion contents of the Council, and immediately report to the Council member about the content and results of the meeting.

In cases where a Council member is absent and cannot appoint a substitute attendee, the Chairman of the Council decides to seek the Council member's opinion in writing.

4. The evaluation and awarding process is conducted through voting or ballot. Balloting is implemented for cases involving the examination and awarding of commendation titles, state-level reward forms, the Construction Ministry Flag of Merit, Construction Ministry Model Worker, grassroots Model Worker, and other cases as decided by the Chairman of the Council.

In cases where individuals or groups meet the ballot ratio but exceed the awarding ratio, results are taken from highest to lowest; in the final case where there is a tie in votes, the Chairman of the Council decides.

5. For Council meetings, depending on the content and requirements, the chairperson may invite representatives from relevant agencies and units to attend. Attendees may provide opinions but do not have the right to vote or ballot.

6. Council members operate on a concurrent basis.

7. In cases where a Council meeting is not convened, the Council Standing Committee has the responsibility to send documents and materials, solicit opinions from each Council member; compile and report to the Council Chairman for review and decision.

8. The Council may use the seal of the agency or unit.

9. The Ministry-level Council is subject to guidance, inspection, supervision, and direction from the Central Competition and Reward Council. It is responsible for organizing implementation, proposing, reporting, and making recommendations to the Central Competition and Reward Council regarding issues related to competition and reward work.

10. The grassroots-level Competition and Reward Council is subject to guidance, inspection, supervision, and direction from the Ministry-level Council. It is responsible for organizing implementation, proposing, reporting, and making recommendations to the Ministry-level Council regarding issues related to competition and reward work.

Chapter VI
IMPLEMENTATION

Article 22. Effectiveness

1. This Circular takes effect from January 1, 2026. The Circular No. 15/2025/TT-BXD dated June 30, 2025, issued by the Minister of Construction guiding the implementation of competition and reward work of the Ministry of Construction, is hereby repealed.

2. In cases where laws and regulations referred to in this Circular are amended, supplemented, or replaced, they shall be applied according to the provisions of the amended, supplemented, or replaced laws and regulations.

Article 23. Transitional Provisions

Files sent to the Ministry of Construction (as evidenced by the receipt stamp) before this Circular takes effect shall continue to be implemented in accordance with Circular No. 15/2025/TT-BXD dated June 30, 2025, issued by the Minister of Construction guiding the implementation of competition and reward activities of the Ministry of Construction.

Article 24. Implementation Organization

1. The heads of agencies, units, enterprises under the Ministry of Construction and other related agencies, organizations, and individuals shall be responsible for implementing this Circular.

2. In case of difficulties during implementation, the relevant agencies, units, enterprises, and individuals are requested to report to the Ministry of Construction for consolidation, examination, and decision-making.
