Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on Directive No. 01/2003/CT-TTg dated January 16, 2003 of the Government Chairman on continuing to promote the restructuring, modernization, development, and improvement of efficiency of state-owned enterprises;
Considering the proposal of the Board of Directors of the Vietnam Oil and Gas Corporation, opinions of the Ministries of Industry, Planning and Investment, Finance, Labor, War Invalids and Social Affairs,
Considering the proposal of the People's Committee of Lai Chau Province (report No. 51/TTr-UB dated January 30, 2003), the opinions of the Ministries of Planning and Investment (Letter No. 1371 BKH/DN dated March 13, 2003), Finance (Letter No. 1932 TC/TCDN dated March 4, 2003), Labor, Invalids and Social Affairs (Letter No. 563/LĐTBXH-CSLĐVL dated February 28, 2003), Home Affairs (Letter No. 347/BNV-TCBC dated February 26, 2002), and the Central Economic Commission (Letter No. 65-CV/KTTW dated February 27, 2003), and the socio-economic characteristics of Lai Chau Province,
DECISION:
Article 1. Approves the overall plan for restructuring and modernizing state-owned enterprises in Lai Chau Province until 2005 as attached.
Article 2. The Chairman of the People's Committee of Lai Chau Province shall be responsible for:
- Directing the implementation of the restructuring and modernization of directly subordinate state-owned enterprises in accordance with the approved content and schedule. During the implementation process, specific and timely measures must be taken to ensure that all regulations and policies are fully addressed for surplus workers due to enterprise restructuring.
- Continuously proactively restructure state-owned enterprises in the province towards maintaining, consolidating, and developing enterprises in which the State continues to hold 100% of the charter capital in essential business areas for production development and improving the material and spiritual life of ethnic people in mountainous, remote, and far-flung regions; at the same time, accelerate the shareholding reform of enterprises where the State does not need to hold 100% of the charter capital.
Article 3. The Ministry of Finance, the Ministry of Planning and Investment, the Ministry of Home Affairs, the Ministry of Labor, Invalids and Social Affairs, and related agencies shall be responsible for coordinating with the People's Committee of Lai Chau Province in implementing the Plan.
The Steering Committee for Enterprise Renewal and Development shall be responsible for directing, urging, guiding, and monitoring the implementation of this Plan, and simultaneously proposing solutions to overcome difficulties during the implementation process to the Prime Minister.
Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
The Chairman of the People's Committee of Lai Chau Province and the heads of related agencies shall be responsible for enforcing this Decision./.
