DECREE
Amending and supplementing some articles of Decree No. 107/2007/ND-CP dated June 25, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Residence

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Residence dated November 29, 2006;
Considering the proposal of the Minister of Public Security,
DECREE:
Article 1. Amending and supplementing some articles of Decree No. 107/2007/ND-CP dated June 25, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Residence as follows:
1. Clause 3 shall be amended and supplemented as follows:
“Article 3. Strictly Prohibited Acts of Abusing Household Registration Regulations to Restrict Citizens' Lawful Rights and Interests
1. The household registration regulations under the Law on Residence include the following contents:
a) Registration and management of permanent residence;
b) Registration and management of temporary residence;
c) Notification of stay;
d) Declaration of temporary absence.
2. Acts of abusing regulations on household registration that limit the rights and legitimate interests of citizens are strictly prohibited, including:
a) Issuing normative legal documents and other documents related to household registration regulations that limit citizens' lawful rights and interests;
b) Issuing normative legal documents, other documents related to regulations on household registration contrary to the provisions of the Law on Residence and detailed and guiding documents;
c) Issuing regulations limiting the freedom of residence of citizens beyond authority, procedures, and formalities prescribed by law;
d) Enacting regulations on household registration as conditions to limit the rights and legitimate interests of citizens;
đ) Resolving residence matters contrary to the provisions of law or refusing to resolve requests for household registration of citizens, thereby limiting their rights and legitimate interests;
e) Allowing others to enter their household registration books or places of residence for personal gain or allowing them to enter the same place of residence without ensuring the minimum floor area per person as stipulated;
g) Signing indefinite-term labor contracts with workers not belonging to their own enterprises for the purpose of household registration.
3. Ministries, sectors, and People's Committees at all levels shall be responsible for:
a) Inspecting and reviewing normative legal documents and other documents within their management areas related to regulations on household registration to amend, supplement, abolish, or propose competent authorities to amend, supplement, or abolish contents that contravene the Law on Residence and guiding documents of the Law on Residence, thereby limiting the rights and legitimate interests of citizens;
b) Issuing normative legal documents and other documents within their authority related to regulations on household registration must ensure compliance with the Law on Residence and guiding documents of the Law on Residence; they may not limit the rights and legitimate interests of citizens;
c) Directing, inspecting, and supervising agencies, organizations, and individuals under their management in implementing the Law on Residence and guiding documents of the Law on Residence;
d) Promptly and strictly discovering, preventing, and handling acts of abusing household registration regulations to restrict citizens' lawful rights and interests.
4. Citizens have the right to promptly detect, report, and assist competent authorities in preventing and handling acts of abusing regulations on household registration that limit the rights and legitimate interests of citizens.
2. Clause 4 shall be amended and supplemented as follows:
Article 4. Place of residence of citizens
1. The place of residence of citizens is a lawful dwelling where they reside regularly. The place of residence of citizens is either a permanent residence or a temporary residence. Each citizen can only register permanent residence at one lawful dwelling which is their regular place of residence.
A lawful dwelling may belong to the ownership or use of citizens or be rented, lent, or allowed to stay by organizations, institutions, or individuals according to the provisions of law. For dwellings rented, lent, or allowed to stay in Hanoi and Ho Chi Minh City, they must ensure a minimum floor area of 5 m2 /person.
2. In cases where the place of residence of citizens cannot be determined according to Clause 1 of this Article, the place of residence of citizens is where they are currently residing and confirmed by the Police Station of the commune, ward, or town.
3. Legal accommodation includes:
a) Housing;
b) Ships, boats, or other means of transportation intended for living and serving daily activities of households or individuals;
c) Guesthouses under points a and b of this clause but used for residential purposes and serving daily life of households or individuals.
4. Permanent residence registration shall not be conducted when citizens move to new accommodations in any of the following cases:
a) Accommodation located in restricted areas or construction zones or encroaching upon boundaries protecting technical infrastructure, historical, and cultural sites already classified;
b) Accommodation where the entire residential area lies on illegally occupied land;
c) Dwellings with compensation, support, and resettlement plans approved by competent state agencies; dwellings are part or all of the area of housing currently in dispute, complaint related to ownership or use rights but not yet resolved according to the law (except when those who have family relationships such as grandparents, parents, spouse, children move in together).
d) Accommodation seized, confiscated, or purchased compulsorily by state authorities;
đ) Dwellings are houses with demolition decisions issued by competent state agencies.
3. Article 5 shall be amended and supplemented as follows:
Article 5. Documents proving lawful dwelling
1. Documents proving lawful dwelling for permanent residence registration include one of the following documents:
a) Documents proving lawful dwelling owned by citizens include one of the following documents:
- Certificate of ownership of housing or other documents on ownership of housing issued by competent authorities at different periods;
- Documents on land use rights for residential purposes as prescribed by laws on land (where there is housing on that land);
- Construction permit as prescribed by laws on construction (in cases where such permits are required);
- Contract for sale of state-owned housing or documents on liquidation price of state-owned housing;
- Contract for purchase of housing or documents proving delivery and acceptance of housing from enterprises with functions of housing business investment and sale;
- Documents on purchase, sale, gift, exchange, inheritance of housing with notarization or certification by People's Committee of commune, ward, town (hereinafter referred to as People's Committee of commune);
- Documents on donation of patriotic houses, charitable houses, solidarity houses, provision of housing and land for individuals and households relocated according to the State’s plan or other subjects;
- Documents of the Court or competent administrative agencies resolving ownership of housing which have taken legal effect;
- Documents with confirmation by People's Committee of commune on housing and land without disputes over ownership of housing and land use rights if there is no one of the above-mentioned documents;
- Documents proving the registration of vessels, boats, or other means of transportation owned and the original address of the vessel used for residence. If there is no registration certificate, confirmation from the People's Committee of the commune about the ownership or sale, gift, exchange, inheritance of vessels, boats, or other means of transportation and the original address of the vessel must be provided.
b) Documents proving the rental, lending, or allowing to stay in lawful dwellings are lease, loan, or stay contracts for houses or other buildings of organizations, institutions, or individuals (in the case of lease, loan, or stay contracts for houses or other buildings of individuals, these contracts must be notarized or certified by the People's Committee of the commune). For houses or other buildings in Hanoi and Ho Chi Minh City, the contract must clearly specify the leased, lent, or stayed area;
c) Documents from organizations, institutions, religious establishments proving that citizens have dwellings as specified in point c and point d of Clause 1 of Article 26 of the Law on Residence;
d) Documents signed by the head of the organization or institution and stamped by the organization or institution proving the allocation, use, transfer of houses, or houses established on land allocated by the organization or institution for housing (for houses and land under the management of the organization or institution) or confirmation from the People's Committee of the commune that the house does not have disputes over ownership or use rights.
2. Documents proving lawful dwelling for temporary residence registration include one of the following documents:
a) One of the documents specified in Clause 1 of this Article, except in the case where the document proving lawful dwelling is a lease, loan, or stay contract for houses or other buildings of individuals, then the contract does not need to be notarized or certified by the People's Committee of the commune;
b) Citizen's commitment letter stating that they have a dwelling under their use rights and there is no dispute over use rights if they do not have one of the documents specified in point a of this clause.
3. In cases where laws on housing change, the Minister of Public Security shall specify other documents proving lawful dwelling for permanent and temporary residence registration consistent with those laws.
4. Article 7 shall be amended and supplemented as follows:
"Article 7. Conditions for citizens temporarily residing to register permanent residence in centrally governed cities
1. Citizens who are temporarily residing shall be eligible to register permanent residence in centrally governed cities if they meet the following conditions:
a) They have a lawful place of residence in a centrally governed city and have continuously resided there for one year or more;
b) The place where they request to register permanent residence must be their current temporary residence location.
2. The period of temporary residence shall be calculated from the date the citizen registers temporary residence to the date the citizen submits the application for permanent residence registration.
3. Documents proving the period of temporary residence include one of the following:
a) A temporary residence book issued to a household or an individual according to the model prescribed by the Ministry of Public Security;
b) Confirmation from the Police Station of the commune, ward, town regarding the time and place of temporary residence registration (in cases where temporary residence registration is made but no temporary residence book is issued)."
Article 2. Effectiveness
This Decree takes effect from July 10, 2010.
Article 3. Responsibility for Implementation
1. The Minister of Public Security is responsible for organizing, urging, and inspecting the implementation of this Decree.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
