Pursuant to the Fire Prevention and Fighting Law 2001; the Law Amending and Supplementing Certain Articles of the Fire Prevention and Fighting Law 2013;
Pursuant to Decree No. 79/2014/ND-CP dated July 31, 2014 detailing the implementation of certain articles of the Fire Prevention and Fighting Law and the Law Amending and Supplementing Certain Articles of the Fire Prevention and Fighting Law (hereinafter referred to as Decree No. 79/2014/ND-CP);
Pursuant to Decree No. 77/2009/ND-CP dated September 15, 2009 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security; Decree No. 21/2014/ND-CP dated March 25, 2014 amending and supplementing Article 3 of Decree No. 77/2009/ND-CP dated September 15, 2009;
Pursuant to the proposal of the Director of the Fire Prevention, Firefighting, and Rescue Police Department;
The Minister of Public Security issues this Circular prescribing provisions on equipping fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, specialized fire prevention and firefighting forces.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular prescribes standards, funding for equipping, and responsibilities of agencies, organizations, and individuals related to equipping fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, specialized fire prevention and firefighting forces.
Article 2. Applicability
This Circular applies to:
1. Citizen protection forces;
2. Basic fire prevention and fire fighting forces;
3. Specialized fire prevention and fire fighting forces;
4. Public Security units and localities;
5. Agencies, organizations, and individuals related to equipping fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, specialized fire prevention and firefighting forces.
Article 3. Principles for equipping fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, specialized fire prevention and firefighting forces
2. Ensuring the purpose, requirements, safety, effectiveness, and contributing to national security protection and maintaining public order and social safety.
2. Ensuring the improvement of quality and effectiveness of fire prevention and firefighting activities of civilian defense forces, grassroots fire prevention and firefighting forces, specialized fire prevention and firefighting forces.
3. Ensuring economy, rationality, compliance with standards, purposes, and user categories.
4. Being appropriate to the budget conditions of localities at each stage and suitable to the financial guarantee conditions of each facility.

3. Based on the standard for equipping civilian defense forces prescribed in Clause 1 and Clause 2 of this Article, the Director of Provincial Police or the Director of Provincial Fire Prevention and Fighting Service shall propose to the People's Committee at the same level to submit to the People's Council for decision on equipping fire prevention and firefighting equipment for civilian defense forces in accordance with the local budget conditions.
3. Based on the equipment standards for the civilian defense force as stipulated in Clause 1 and Clause 2 of this Article, the Director of the Provincial Public Security Force or the Director of the Fire Prevention and Fighting Police of the centrally governed city, or the Director of the Fire Prevention and Fighting Service of the centrally governed city shall propose to the People's Committee at the same level to submit to the People's Council for a decision to equip the civilian defense force with fire prevention and fighting equipment suitable to the local budget conditions.

2. For facilities equipped with mechanical firefighting equipment, the standard for equipping fire prevention and firefighting equipment along with mechanical firefighting equipment shall be implemented according to the guidelines of the Fire Prevention and Fighting Police Department.
3. Based on the nature, level of fire and explosion danger, and the ability to ensure funding of each facility, the head of the agency or organization directly managing the facility may equip additional necessary fire prevention and firefighting equipment for the grassroots fire prevention and firefighting force, such as fire pumps, fire trucks, fire boats, portable radios, gas masks with filters, self-contained breathing apparatus, other necessary fire prevention and firefighting equipment, and consider and decide on the specific types of fire prevention and firefighting equipment to be equipped for positions such as team leader, deputy team leader, and team members when performing fire prevention and firefighting tasks.

1. Funding to ensure the provision of fire prevention and firefighting equipment for civilian defense forces is allocated from the annual national defense and security budget of the People's Committees at all levels and implemented according to the provisions of the State Budget Law.
2. The head of the agency or organization directly managing the facility ensures funding to provide fire prevention and firefighting equipment for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces in accordance with Clause 2 of Article 32 of Decree No. 79/2014/ND-CP.
Funding to ensure the provision of fire prevention and firefighting equipment for grassroots fire prevention and firefighting forces and specialized fire prevention and firefighting forces belonging to state agencies, public service units, armed forces, and other entities benefiting from the state budget at central and local levels is guaranteed by the state budget and implemented according to the provisions of the State Budget Law.
1. This Circular takes effect from December 30, 2014.
2. Civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces that have been equipped with fire prevention and firefighting equipment according to the standard set forth in this Circular before its effective date shall continue to use them until their expiration; in cases where they have not been equipped or have been equipped below the standard set forth in this Circular, they shall implement this Circular.
Chapter III
IMPLEMENTATION
Article 8. Effective Date
2. Based on requirements and actual conditions, the Fire Prevention and Fighting Police Department is responsible for taking the lead and coordinating with relevant units to study amendments and supplements to the regulations on providing fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces stipulated in this Circular, and report to the Minister of Public Security for consideration and decision.
a) Guide, inspect, and report annually in December to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department) on the implementation of regulations on providing fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces.
Article 9. Responsibility for implementation
1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department shall be responsible for directing, inspecting, and urging the implementation of this Circular.
b) Summarize proposals and recommendations for amending and supplementing the standards for providing fire prevention and firefighting equipment for civilian defense forces, grassroots fire prevention and firefighting forces, and specialized fire prevention and firefighting forces and report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department).
Clause 3. Provincial and municipal public security organs and firefighting police departments under the central government shall be responsible for:

Chiefs of General Departments, Heads of Units under the Ministry of Public Security, Directors of Public Security, Fire Prevention and Fighting Police Departments of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, public security units, localities, agencies, organizations, and individuals related to it should report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department) for timely guidance./.
4. The Heads of the Departments under the Ministry of Public Security, the Directors of the Public Security Forces, Fire Prevention and Fighting Services of the provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, the relevant units, localities, agencies, organizations, and individuals shall report to the Ministry of Public Security (through the Fire Prevention, Fighting and Rescue Bureau) for timely guidance./.
