Degree of Top Secret and Highest Confidentiality of the Health Sector

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;

Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;

Upon the proposal of the Minister of Health and the Minister of Public Security,

The Prime Minister issues this Decision on the List of State Secrets of Top Secret and Very Secret Levels for the Health Sector.

Article 1. The List of State Secrets of Top Secret Level for the Health Sector includes information and documents within the following scope:

1. Strategies and plans of the Health Sector serving security and defense tasks;

2. Types, quantities, and storage areas of medicines and medical equipment in the national reserve;

3. Documents containing information and documents included in the List of State Secrets of Top Secret Level from other agencies and organizations.

Article 2. The List of State Secrets of Very Secret Level for the Health Sector includes information and documents within the following scope:

1. Contents of negotiations, signed documents with foreign countries in the health sector, and foreign or international organization materials transferred to Vietnam in the health sector that have agreements not to disclose or have not been disclosed;

2. Plans, files, and documents protecting the health of senior Party and State leaders that have not been disclosed or have not been disclosed;

3. New strains of microorganisms related to human health and lives that have not been identified and have not been disclosed or have not been disclosed;

4. National-level scientific investigation and research results in the health sector that have not been disclosed or have not been disclosed;

5. Policies of the Party and State regarding activities to address the consequences of chemical warfare agents used in Vietnam that have not been disclosed or have not been disclosed;

6. Documents containing information and documents included in the List of State Secrets of Very Secret Level from other agencies and organizations.

Article 3. Effectiveness

This Decision takes effect from January 1, 2016.

Decision No. 168/2004/QĐ-TTg dated September 22, 2004 of the Prime Minister on the List of State Secrets of Top Secret and Very Secret Levels in the Health Sector shall cease to be effective from the date this Decision takes effect.

Article 4. Responsibilities for Implementation

THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
