Guidelines for the development, review

and publication of national occupational skill standardsa

Pursuant to the Law on Employment No. 38/2013/QH13 dated November 16, 2013;1Pursuant to Decree No. 31/2015/NĐ-CP dated March 24, 2015 of the Government detailing implementation of certain provisions of the Law on Employment regarding assessment and issuance of national vocational skill certificates;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

The Department of Vocational Training;No. The Minister of Labor, Invalids and Social Affairs issues this Circular guiding the development, review and publicationon of national occupational skill standards.

At the proposal of the Inspector General specialized agency under the People's Committee of the province/city.The terms used in this Circular shall be understood as follows:, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThis Circular stipulates the principles, procedures for developing national occupational skill standards, organizing the review and publication of national occupational skill standards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Chapter II

National occupational skill standards for occupations must ensure the following principles:

1. According to each level of occupational skill proficiency for each occupation and the national framework of occupational skill levels as prescribed in Clause 1, Article 32 of the Law on Employment;

2. A uniform structure format and developed according to the procedures specified in this Circular;

Article 5. National Framework of Occupational Skill Levels

The national framework of occupational skill levels is a classification of skill levels from Level 1 to Level 5 based on descriptions according to criteria such as the nature and degree of work to be performed and the scope and situation of performing the work; flexibility and creativity in performing the work; coordination and responsibility in performing the work. The framework of each specific level is as follows:

b) Possess basic knowledge about the specialty and understanding of the profession's activities in a narrow range of fields; able to apply knowledge and understanding to perform work according to instructions;

c) Able to receive, record, and convey information as required; able to participate in team or group work; responsible for part of the results of the work, products produced.

a) Perform routine tasks and some complex tasks in certain situations;

b) Possess specialized knowledge and understanding of the profession's activities in a broad range of fields; able to apply knowledge and understanding to propose solutions to solve common technical problems and some complex issues but require guidance when performing the work;

1. Level 1:

a) Performing simple, repetitive tasks in fixed situations;

c) Able to analyze, judge, and explain information; work independently in teams or groups and have the ability to work alone in some cases when performing the work; mainly responsible for the results of the work, products produced.

a) Perform most complex tasks, tasks with many choices in different situations;

2. Level 2:

b) Possess specialized knowledge, basic knowledge about principles and theories, and broad understanding of the profession's activities in various fields; apply knowledge and understanding to propose solutions to solve complex technical problems and some management requirements when performing the work;

c) Able to recognize, analyze, and evaluate information from multiple sources; work independently and guide others in teams or groups when performing the work; responsible for the quality of the work, products produced according to specified standards and partially responsible for the results of the work, products produced by others in the team or group.

a) Perform almost all complex tasks, tasks with many choices in various situations;

3. Level 3:

b) Possess deep specialized knowledge, knowledge about principles and theories, and broad understanding of the profession's activities in various fields; apply knowledge and understanding to propose solutions to solve complex technical problems and management requirements when performing the work;

c) Analyze, evaluate information from multiple sources and use the analysis results to provide opinions and recommendations for management and research purposes; work independently and highly autonomous; have the ability to manage and lead teams or groups during the performance of work; fully responsible for the quality of the work, products produced according to specified standards and responsible for the results of the work, products produced by others in the team or group.

a) Perform complex tasks, tasks with many choices in all situations;

4. Level 4:

b) Possess deep specialized knowledge, broad knowledge about principles and theories, and broad understanding of the profession's activities in various fields; have analytical, reasoning, diagnostic, and design skills to propose solutions to solve complex technical problems or management requirements in a wide range when performing the work;

c) Know how to analyze, evaluate information and generalize to provide perspectives and innovations; work independently and highly autonomous; manage and lead teams or groups during the performance of work; fully responsible for the quality of the work, products produced and responsible for the results of the work, products produced by the team or group ensuring technical specifications and according to specified standards.

c) Analyze and evaluate information from various sources and utilize the analysis results to provide opinions and recommendations for management and research purposes; work independently with high autonomy; have the ability to manage and lead teams during the execution of tasks; be responsible for the quality of the work products produced according to specified standards and be accountable for the work results and products of other members in the team.

5. Level 5:

a) Perform complex tasks with multiple options in various situations;

b) Possess deep specialized knowledge and broad understanding of principles and theories, as well as extensive knowledge of activities within the profession across different fields; have skills in analyzing, reasoning, diagnosing, and designing solutions to address complex technical issues or management requirements within a wide scope when performing tasks;

c) Be able to analyze, evaluate information, and generalize to form viewpoints and initiatives; work independently with high autonomy; manage and lead teams during the execution of tasks; be responsible for the quality of the work products produced and ensure that the work results and products of the team meet technical specifications and comply with established standards.

Article 6. Structure of National Occupational Skill Standards

The structure of national occupational skill standards for a profession includes three (03) basic components as follows:

1. Job Description:

Content describing the scope covered by the profession, job positions and main tasks that need to be performed in various application contexts.

2. List of Competency Units:

Content presenting the list of competency units of the profession and the competency units of each job position within the profession, including a full listing of competency units and arranged into the following groups:

a) Basic Competencies: consisting of competencies applied generally for work not specific to a particular profession or industry (hereinafter referred to collectively as the industry);

b) Common Competencies: consisting of competencies required when working in a specific industry;

c) Specialized Competencies: consisting of necessary competencies of the profession that an individual must possess to be recognized as competent at a specific level.

3. Competency Units:

Content detailing each competency unit included in the list of competency units. For each specific competency unit, the following contents must be demonstrated:

a) Name of the competency unit;

b) Components and implementation criteria: providing a detailed description of the components within a competency unit that need to be implemented, the degree of implementation and measurable, calculable, determinable outcomes;

c) Important skills and essential knowledge: providing information on the skills and knowledge needed to perform effectively and select resources or alternative solutions to achieve the outcomes;

d) Implementation conditions: describing parameters for applying the competency and types of work, resources, services that can be applied when using the competency;

e) Evaluation guidance: providing context and methods for selecting evidence supporting evaluation to determine whether an individual meets the standard of the competency unit or not.

4. The format of the structure of national occupational skill standards shall follow the model set out in Appendix 01 attached hereto.

Section 2

PROCEDURE FOR BUILDING STANDARDS

1. According to each level of occupational skill proficiency for each occupation and the national framework of occupational skill levels as prescribed in Clause 1, Article 32 of the Law on Employment;

Article 7. Establishment and Selection of Organizations to Assist in Building National Occupational Skill Standards

1. Ministries, ministerial-level agencies, and government agencies (hereinafter collectively referred to as the Leading Agency) have the responsibility to lead the development of national occupational skill standards for each profession under their management. The Leading Agency must establish or select an organization to advise and assist in building national occupational skill standards for each profession (hereinafter referred to as the assisting organization).

2. In the case of establishing an assisting organization, the organization established must meet the following requirements:

a) Participants include representatives from the Leading Agency; representatives of organizations representing workers in that profession; representatives of related professional associations; representatives of organizations of employers or enterprises employing workers in that profession; representatives of vocational education institutions or educational institutions training that profession.

In the assisting organization established, the number of members representing professional associations, employer organizations, or enterprises must account for at least half (one-half) of the participating members.

b) Members participating in the assisting organization according to the provisions of Point a of this Clause must have a bachelor's degree or higher, be knowledgeable and proficient in that profession, and have at least five (5) years of work experience or be professionals with the highest skill level in that profession (hereinafter referred to as experts in the profession).

3. In the case of selecting an assisting organization, the selected organization must be one of the following:

a) Professional associations related to that profession;

b) Vocational education institutions or educational institutions, scientific and technological organizations, healthcare facilities under the management of the Leading Agency, reputable and experienced in training or research, application, and technology transfer related to that profession.

4. The assisting organization has the rights and responsibilities as follows:

a) Implementing and complying with the procedure for building national occupational skill standards as stipulated in Articles 8, 9, 10, 11, 12, and Clause 5 of Article 16 of this Circular;

b) Having the right to hire or utilize individuals or organizations both domestically and internationally with experience and capability in building occupational standards to implement the tasks specified in Articles 8, 9, 10, and 11 of this Circular;

c) Being permitted to use occupational standards, skill standards, or competency standards transferred from abroad to revise and compile draft national occupational skill standards according to the structural format prescribed in Article 6 of this Circular;

d) Complying with legal regulations on copyright and intellectual property rights when using materials and occupational standards of individuals and organizations both domestically and internationally.

Article 8. Job Analysis

1. Collecting materials and standards of the job currently being used domestically and internationally.

2. Studying and selecting enterprises that employ workers for such jobs according to large, small, and medium scales, and the technological levels currently used in production, business activities, as well as management at various levels of popularity, oldness, and newness to establish a list of enterprises to be surveyed, ensuring representation from different regions across the country.

3. Developing survey forms for the following subjects:

a) A survey form on the situation of labor use and division of labor for the job under investigation, with the survey subject being enterprises.

b) A survey form on functions, roles, positions held; regular and non-regular tasks that need to be performed and conditions, contexts for performing each task for survey subjects within enterprises who are managers or supervisors, technical professionals, and those directly performing the job tasks or related work.

4. Conducting surveys at selected enterprises according to the list established in Clause 2 and for the subjects specified in Clause 3 of this Article to investigate job positions at workplaces and collect data on tasks required for each job position.

5. Organizing the analysis of data collected from survey forms and results of the surveys conducted as stipulated in Clause 4 of this Article to determine common job positions of the profession and tasks required for each job position; compiling and creating a table of common job positions of the profession according to Appendix 02 issued together with this Circular.

Article 9. Task Analysis

1. Based on data collected from survey forms and results of the surveys conducted as stipulated in Clause 4 of Article 8 of this Circular, perform the following tasks:

a) Analyze the survey results collected for each task of each job position determined in Clause 5 of Article 8 of this Circular to create task analysis forms according to Appendix 03 issued together with this Circular;

b) Refer to the standards and materials collected as stipulated in Clause 1 of Article 8 of this Circular (if available) to adjust the contents in the task analysis forms created under Point a of this Clause;

c) Organize the collection of opinions from experts in the profession not participating in the activities stipulated in Points a and b of this Clause through requesting comments on the contents in the task analysis forms created or adjusted (if applicable); complete the task analysis forms after receiving comments;

d) Conduct seminars to gather opinions from experts in the profession, relevant agencies, organizations, and enterprises employing workers for these tasks to provide direct feedback on the completed task analysis forms as stipulated in Point c of this Clause; finalize the task analysis forms after consolidating seminar feedback.

2. Based on the task analysis forms created and finalized in Clause 1 of this Article, carry out the following tasks:

a) Analyze the nature and level of tasks to be performed; scope, situations for performing tasks, as well as flexibility and creativity when performing tasks; coordination and responsibility in performing tasks for each job position to determine the skill level grade of the job position based on the framework of each skill level grade prescribed in Article 5 of this Circular;

b) Create a diagram of job positions of the profession according to Appendix 04 issued together with this Circular;

c) Refer to the standards and materials collected as stipulated in Clause 1 of Article 8 (if available) to adjust the diagram of job positions of the profession created under Point b of this Clause;

d) Organize the collection of opinions from experts in the profession not participating in the activities stipulated in Points a, b, and c of this Clause, relevant agencies, organizations, and enterprises employing workers for these tasks to provide feedback on the diagram of job positions of the profession created or adjusted (if applicable); finalize the diagram of job positions of the profession after receiving feedback.

Article 10. Determination of the list of competency units

1. Based on the job analysis forms that have been established and completed according to Clause 1 of Article 9 of this Circular, determine the competencies required to perform the job and establish the list of competency units as prescribed in Clause 2 of Article 6 of this Circular.

2. Organize the collection of opinions from experts in the profession who did not participate in the activities stipulated in Clause 1 of this Article, relevant agencies and organizations, and enterprises using labor for such jobs through requesting comments on the list of competency units that have been established; complete the list of competency units after receiving feedback.

Article 11. Compilation of National Occupational Skill Standards

1. Based on data collected from survey forms and the results of surveys conducted according to Clause 4 of Article 8, job analysis forms established and completed according to Article 9, and the list of competency units established according to Article 10 of this Circular, compile each competency unit as prescribed in Clause 3 of Article 6 and draft the National Occupational Skill Standards in the format structure prescribed in Clause 4 of Article 6 of this Circular.

2. In cases where foreign standards are transferred and used to revise and compile the draft National Occupational Skill Standards in the format structure prescribed in Clause 4 of Article 6 of this Circular, there is no need to implement the provisions of Articles 8, 9, and 10 of this Circular.

3. Organize the collection of opinions from experts in the profession who did not participate in the activities stipulated in Clause 1 or Clause 2 of this Article through requesting comments on the competency units and draft National Occupational Skill Standards compiled according to Clause 1 or the draft National Occupational Skill Standards compiled according to Clause 2 of this Article; complete after receiving feedback.

4. Conduct a workshop to collect opinions from experts in the profession and relevant agencies, organizations, and enterprises using labor for such jobs to directly provide feedback on the draft National Occupational Skill Standards completed according to Clause 3 of this Article; finalize the draft National Occupational Skill Standards after consolidating the feedback from the workshop.

Article 12. Preparation of the Application for Review of National Occupational Skill Standards

Immediately after completing the draft National Occupational Skill Standards according to Clause 4 of Article 11 of this Circular, the organization assisting in the development of occupational standards shall prepare the application for review of the draft National Occupational Skill Standards (hereinafter referred to as the application for review). The application includes the following documents:

1. One (01) report on the process of implementing the development of National Occupational Skill Standards. The outline of the report according to Appendix 5 issued together with this Circular;

2. One (01) copy of the draft National Occupational Skill Standards compiled and completed according to Article 11 of this Circular, including an electronic version;

3. Intermediate products used in drafting the National Occupational Skill Standards include:

a) A summary table of common job positions in the profession according to Clause 5 of Article 8;

b) Job analysis forms and diagrams of job positions in the profession established and completed according to Article 9 of this Circular;

c) Standards and related documents regarding the use of foreign-transferred standards (for cases where foreign standards are used to revise and compile the draft National Occupational Skill Standards).

Chapter III

ORGANIZATION OF REVIEW AND ANNOUNCEMENT

NATIONAL OCCUPATIONAL SKILL STANDARDS

Article 13. Acceptance of the Application for Review of Draft National Occupational Standards

1. After receiving the application for review prepared by the organization assisting in the development of occupational standards in accordance with Clause 1 of this Circular, the Leading Agency shall send one (01) set of such documents to the Ministry of Labor, Invalids and Social Affairs via postal service or directly.

2. Within no more than three (3) working days from the date of receipt of the application for review and related documents as stipulated in Clause 1 of this Article, the Ministry of Labor, Invalids and Social Affairs shall perform the following tasks:

a) Publish the draft national occupational skills standard contained in the application for review on the Ministry's electronic information website for thirty (30) working days to solicit opinions from individuals and organizations, enterprises nationwide.

b) Send a letter to relevant Ministries, agencies at the level of Ministries, government agencies, the Vietnam General Confederation of Labor, the Vietnam Farmers' Union, the Vietnam Chamber of Commerce and Industry, or the Vietnam Federation of Trade Unions, and central vocational associations for their written comments on the draft national occupational skills standard received in the application for review.

Article 14. Establishment of the Review Board

1. Within fifteen (15) working days from the date of receipt of the application for review and related documents sent by the Leading Agency in accordance with Clause 1 of Article 13 of this Circular, the Ministry of Labor, Invalids and Social Affairs shall establish the Review Board to assist the Minister in reviewing the received application for review.

2. The number of members, composition, and structure of the Review Board are as follows:

a) The number of Review Board members must be odd and range from seven (7) to eleven (11).

b) Participants in the Review Board include representatives from the Ministry of Labor, Invalids and Social Affairs, relevant agencies and organizations, and enterprises using labor in that occupation, including industry unions or trade guilds, vocational associations, and some enterprises. Among them, enterprise representatives must account for at least one-third (1/3) of the participants in the Review Board. These representatives must be experts in the field but not part of the organization assisting in the development of occupational standards or involved in the collaboration in developing the national occupational skills standards for that occupation, and they must be recommended by their respective agencies, organizations, or enterprises for selection by the Ministry of Labor, Invalids and Social Affairs.

c) The structure of the Review Board includes: Chairperson, Secretary, and other members. The Secretary of the Review Board is a representative from the Ministry of Labor, Invalids and Social Affairs, and the Chairperson is a person with prestige, experience, and capability in developing national occupational skills standards, elected by the Review Board among its members.

3. Principles of Operation of the Review Board:

a) The Review Board operates under the chairmanship of the Chairperson; meetings of the Review Board must have at least two-thirds (2/3) of its members present, and representatives from the Leading Agency and the organization assisting in the development of occupational standards must be invited to attend.

b) Meeting records of the Review Board must be recorded by the Secretary, and the meeting record must be signed by both the Chairperson and the Secretary.

c) The Review Board operates based on democratic centralism; each member must prepare written comments and evaluations on the contents of the documents in the received application for review and express their views at the Review Board meetings for discussion, analysis, and public evaluation by attending members; representatives from the Leading Agency and the organization assisting in the development of occupational standards who are invited to attend the meetings must explain the opinions of the Review Board members if requested; the Chairperson will synthesize and conclude according to the majority opinion of the attending members of the Review Board.

d) The Review Board evaluates the quality of the draft national occupational skills standard contained in the received application for review through secret ballots cast by its members. The quality assessment form for the draft national occupational skills standard is attached as Appendix 06 issued together with this Circular.

Article 15. Content and Time Limit for Review

1. The review focuses on the following contents:

a) Reviewing compliance with the provisions of Articles 7, 8, 9, 10, and 11 of this Circular during the process of developing the national occupational skill standards;

b) Reviewing the content and appropriateness of the draft national occupational skill standards contained in the application dossier received compared to the structural format prescribed in Article 6 of this Circular;

c) Reviewing the quality of the draft national occupational skill standards contained in the application dossier received according to the criteria in the evaluation form attached as Appendix No. 06 issued together with this Circular.

2. Time limit for review:

Within five (5) working days from the end of the period for publishing the draft national occupational skill standards on the Ministry of Labor, Invalids and Social Affairs' electronic information website as stipulated in Point a, Clause 2, Article 13 of this Circular, the Review Board must conduct the review work according to the contents prescribed in Clause 1 of this Article.

Article 16. Procedure for Review

1. Not later than three (3) working days from the date of establishment of the Review Board, the Secretary of the Board must send the draft national occupational skill standards contained in the application dossier received to the members of the Review Board for study and preparation of individual comments.

2. At least three (3) working days before the Review Board conducts the review work according to the contents prescribed in Clause 1, Article 15 of this Circular, the Ministry of Labor, Invalids and Social Affairs sends the summary of opinions received on the draft national occupational skill standards that were sent to relevant agencies and organizations as stipulated in Point b, Clause 2, Article 13 and published on the Ministry's electronic information website as stipulated in Point a, Clause 2, Article 13 of this Circular to the Review Board and the organization assisting in the development of standards for study and consideration.

3. The Review Board conducts the review in accordance with the working principles prescribed in Clause 3, Article 14 and focuses on the contents prescribed in Clause 1, Article 15 of this Circular.

4. Immediately upon completion of the review, the Chairman of the Board must report the results of the review in writing about the official opinion of the Review Board on the draft national occupational skill standards contained in the application dossier and attach the minutes of the Board's sessions, written comments and evaluations of each member of the Board to the Ministry of Labor, Invalids and Social Affairs; at the same time, send them to the organization assisting in the development of standards for study and consideration of the written opinion of the Review Board on the draft national occupational skill standards contained in the application dossier along with the written comments and evaluations of each member of the Board.

5. Not later than five (5) working days from the date of receipt of the documents sent by the Chairman of the Board as prescribed in Clause 4 of this Article, the organization assisting in the development of standards must report on the consideration of the received opinions and the improvement of the draft national occupational skill standards sent to the Review Board. In cases where there are issues not accepted or requiring clarification after consideration, the organization assisting in the development of standards will directly work with the Review Board to reach consensus on those issues before improving the draft national occupational skill standards sent to the Review Board.

6. Immediately upon receipt of the improved draft national occupational skill standards from the organization assisting in the development of standards as prescribed in Clause 5 of this Article, the Review Board organizes a session to re-examine the draft national occupational skill standards before the Chairman of the Board submits it to the Ministry of Labor, Invalids and Social Affairs.

Article 17. Announcement of National Occupational Skill Standards

Within five working days from the date of receipt of the national occupational skill standards sent for approval by the Chairman of the Council in accordance with Clause 6, Article 16 of this Circular, the Ministry of Labor - Invalids and Social Affairs shall issue a document to announce and publish the national occupational skill standards on the Ministry's electronic information website, while sending copies to the leading agency for monitoring and coordinating in managing the updating, supplementing, adjusting, and amending the contents of the national occupational skill standards to be consistent with changes in practical production and business activities.

Chapter IV

IMPLEMENTATION

Article 18. Responsibilities of the Ministry of Labor - Invalids and Social Affairs

1. To uniformly manage the organization of construction, examination, and announcement of national occupational skill standards for various occupations and the updating, supplementing, adjusting, and amending of announced national occupational skill standards.

2. To guide, inspect, and audit the construction of national occupational skill standards for each occupation under the management of Ministries, ministerial-level agencies, and government agencies in accordance with this Circular.

3. To guide and coordinate with Ministries, ministerial-level agencies, and government agencies in amending and supplementing the contents of national occupational skill standards and adjusting the format structure of national occupational skill standards issued before the effective date of this Circular to ensure compliance with the provisions of this Circular.

4. To perform the tasks stipulated in Articles 13, 14, 16, and 17 of this Circular.

Article 19. Responsibilities of Ministries, Ministerial-Level Agencies, and Government Agencies

1. To direct, guide, and inspect the implementation of this Circular by organizations assisting in the construction of occupational standards for occupations under their management.

2. To propose updates, supplements, adjustments, and amendments to announced national occupational skill standards to align with changes in production and business activities and regional and global integration requirements.

3. By December 15th each year, Ministries, ministerial-level agencies, and government agencies must submit periodic reports to the Ministry of Labor - Invalids and Social Affairs regarding the construction of new and updates, supplements, adjustments, and amendments to national occupational skill standards for occupations under their management.

4. To perform the tasks stipulated in Article 7 and Clause 1, Article 13, and Clause 2, Article 20 of this Circular.

Chapter V

IMPLEMENTING PROVISIONS

Article 20. Transitional Provisions

1. National occupational skill standards for occupations issued before the effective date of this Circular remain valid for application.

2. Within a maximum period of three years from the effective date of this Circular, Ministries, ministerial-level agencies, and government agencies that have issued national occupational skill standards for occupations under their management must amend and supplement the contents of these standards and adjust their format structure in accordance with this Circular and submit them to the Ministry of Labor - Invalids and Social Affairs for examination and announcement.

Article 21. Effective Date

This Circular takes effect from February 15, 2016.

Article 22. Responsibility for enforcement

The Director of the Vocational Training General Department, the Head of the Legal Affairs Department, and the Inspector General of the Ministry within their assigned functions, duties, and authorities shall be responsible for coordinating with units under the Ministry and related agencies to organize the implementation and inspect and audit organizations assisting in the construction of occupational standards for occupations under the management of Ministries, ministerial-level agencies, and government agencies in implementing and complying with the provisions of this Circular.

IF THERE ARE ANY DIFFICULTIES DURING THE IMPLEMENTATION, THEY ARE REQUESTED TO REPORT PROMPTLY TO THE MINISTRY OF LABOR, INVALIDS, AND SOCIAL AFFAIRS FOR REVIEW AND RESOLUTION./.
