JOINT CIRCULAR

Guidelines for implementing extracurricular teaching activities for teachers at public general education schools

4. Add Clause 9 after Clause 8 of Article 5 as follows:public establishment

Implementing Decision No. 242/TTg dated May 24, 1993 of the Prime Minister on extracurricular teaching activities for teachers at public general education schools, the Ministry of Education and Training and the Ministry of Finance provide guidelines for such extracurricular teaching activities and the fees for additional classes as follows:

I. REGULATIONS ON THE ORGANIZATION AND MANAGEMENT OF EXTRACURRICULAR TEACHING ACTIVITIES

1\. Extracurricular teaching activities for teachers at public general education schools are educational activities not included in the regular class hours prescribed by the professional regulations for each level/grade and subject.

2\. From now on, public general education schools shall not organize simultaneous extracurricular teaching activities for all students in a class. Teachers must fulfill the content of teaching according to the plan, curriculum, and textbooks prescribed during regular class hours. If it is necessary to organize supplementary teaching sessions (to ensure the completion of the program due to reasons from the school or teacher), these additional sessions shall not be charged.

3\. In public general education schools, extracurricular teaching activities may only be conducted for the following groups of students with a supplementary nature (studying for a certain period):

a\. Students who are underperforming (average score below 5 points in a subject), to help these students improve their academic performance to reach the average level.

b\. High-performing students (average score from 8 to 10 points), to identify and nurture talents, prepare for student excellence exams, and entrance exams to specialized schools and selective classes.

c\. Students in the final grade/level (fifth grade in primary school, ninth and twelfth grades in secondary school), to review and prepare for graduation exams.

4\. Principals of public general education schools are responsible for organizing and managing extracurricular teaching activities and fulfilling the following requirements:

a\. Extracurricular classes must be organized based on the voluntary participation of students and the agreement of their parents. It is strictly prohibited for teachers to use coercive measures against students (such as favoring students who attend extracurricular classes, discriminating against those who do not, withholding knowledge from regular class hours for extracurricular classes, leaking test questions for extracurricular classes...). Students and parents have the right to choose their tutors freely. Each student attending extracurricular classes must submit a request to study and a recommendation from their parents; when discontinuing classes, they must also submit a request.

b\. Primary school teachers or subject teachers (for secondary school) must collect requests for extracurricular classes from students and compile them into a list; the principal is responsible for reviewing the list and deciding to organize extracurricular classes.

c\. Teachers conducting extracurricular classes are responsible to the principal for managing the group/class, the content of the program, and the quality of extracurricular teaching.

d\. The number of extracurricular teaching sessions per week is defined as follows:

- For primary school students, not more than 2 sessions per week.

- For secondary school students (grades 6-9 and 10-12), not more than three sessions per week.

e\. The principal is responsible for inspecting and evaluating the results of teaching in extracurricular classes, promptly correcting negative behaviors, and commending teachers who perform well in extracurricular teaching.

II. REGULATIONS ON THE COLLECTION AND USE OF FEES FOR EXTRACURRICULAR CLASSES

1\. Regarding the fee collection for extracurricular classes

Schools are permitted to collect fees from the groups of students specified above as follows:

- Primary school students: the fee ranges from 4,000 to 6,000 dong per student per month.

- Secondary school students:

- Secondary school students: the fee ranges from 6,000 to 8,000 dong per student per month per subject.

- High school students: the fee ranges from 8,000 to 10,000 dong per student per month per subject.

2\. Methods of collecting and managing the use of extracurricular class fees:

a\. The collection of extracurricular class fees from students is organized by the school principal through teachers or the school's finance department and is used as follows:

- 80% for payment of remuneration to the direct instructors.

- 15% for management and organization of extracurricular classes, purchasing materials for extracurricular teaching.

- Five percent is allocated for electricity, water expenses, and depreciation of assets serving extracurricular teaching activities (considered as a supplement to the regular budget of the school).

b\. The school uniformly manages the collection and expenditure of the extracurricular class fund, publicly settling accounts before the parents of the students. The principal is responsible for reporting annually to the District Education Office and the Department of Education and Training for consolidation and reporting to the Ministry of Education and Training.
