Pursuant to Decree No. 178/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/ND-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Considering the proposal of the Director of the Planning and Finance Department and the Director of the Organization and Cadres Department,
DECISION:
Article 1. Position and Functions
The Planning and Finance Department is a unit within the state management machinery of the Ministry of Finance, with the function of assisting the Minister of Finance in uniformly managing finance, assets, development investment, and construction in units under the Ministry of Finance; financial work and administrative management of the Ministry.
Article 2. Task
1. Take the lead and coordinate with units, organizations, and projects on borrowing, aid, and development investment and construction projects under the Ministry of Finance (collectively referred to as units under the Ministry) in formulating regulations on management, standards, and norms for finance, development investment and construction, equipment, and the use of state assets for submission to the Minister for promulgation in accordance with the law; provide specific guidance on financial management mechanisms and policies for uniform implementation in units under the Ministry. Lead and organize the implementation of internal audits of units under the Ministry regarding financial management, state asset management, development investment, and construction in accordance with the law and the delegation of the Ministry.
Submit to the Minister for approval the orientation, strategy, planning, and short-, medium-, and long-term plans on financial management, state asset management, development investment, and construction in units under the Ministry; analyze and evaluate the effectiveness of the use of the budget and state assets in the activities of units under the Ministry.
2. Regarding financial management:
a) Assist the Ministry in uniformly and comprehensively managing the financial affairs of units under the Ministry in accordance with the law;
b) Guide units under the Ministry in preparing budgets for revenue and expenditure in accordance with the law; review the budgets for revenue and expenditure of units under the Ministry in accordance with the State Budget Law and guiding documents of the Ministry of Finance; consolidate and submit to the competent authority for decision-making the annual budget for revenue and expenditure of the Ministry of Finance;
c) Submit to the Minister for approval the allocation plan for the annual budget for revenue and expenditure of the Ministry of Finance assigned to units under the Ministry in accordance with the law;
d) Implement the allocation of budgets for revenue and expenditure to units using the budget under the Ministry and programs, projects, and proposals under the management authority of the Ministry of Finance in accordance with regulations;
e) Take the lead and coordinate in reviewing and submitting to the Minister for approval programs, proposals, projects, and plans for modernizing facilities of units according to the delegation of the Ministry;
g) Review and submit to the Minister for approval the activities of purchasing and selling national reserve goods directly implemented by the National Reserve Administration; procurement activities of information technology goods and services directly implemented by the Information Technology and Financial Statistics Department; procurement activities of other units under the Ministry according to the delegation of the Minister of Finance;
h) Review and submit to the Minister for approval the annual plan for utilizing centralized financial resources of units under the Ministry;
i) Review and submit to the Minister for approval the financial plans for cooperation, borrowing, and aid programs, projects, and proposals implemented by units under the Ministry in accordance with the law;
Organize the settlement of administrative and public service expenses and other financial sources of the Ministry of Finance; implement the review, notification, and examination of annual settlements of units under the Ministry; consolidate the settlement of the Ministry of Finance and submit to the Minister for approval;
4. Regarding investment development and construction management:
a) Assist the Ministry in uniformly managing investment development and construction of the Ministry of Finance in accordance with the law;
b) Guide units under the Ministry in preparing short-, medium-, and long-term investment development and construction plans; review and consolidate for submission to the Minister for decision-making the investment development and construction plans of the Ministry;
c) Submit to the Minister for approval the plans for various sources of development investment and construction funds according to the project and works list of units and organizations under the Ministry;
d) Inspect and report to the Ministry on the management and use of investment capital by project sponsors in accordance with the law;
e) Review project files, designs, estimates, total estimates, plans, and tender results, final accounts of projects from financial sources of units under the Ministry according to the delegation for submission to the Minister for decision-making;
5. Regarding asset management:
a) Assist the Ministry in uniformly managing state assets allocated to units under the Ministry in accordance with the law;
b) Submit to the Minister for promulgation within his authority standards, norms, equipment, and usage of state assets in units under the Ministry;
c) Review and submit to the Minister for approval short-, medium-, and long-term plans for purchasing and major repairs of assets, equipment, and facilities serving the operations of units according to the delegation of the Ministry;
d) Submit to the Minister for approval disposal plans for state assets allocated at units according to the delegation of the Ministry;
e) Organize statistics, consolidation, and evaluation of the use of state assets allocated to the Ministry of Finance for management;
6. Regarding internal audit management:
a) Assist the Ministry in uniformly managing internal audit work in units under the Ministry in accordance with the law;
b) Guide internal audit work on finance, state asset management, development investment, and construction in units according to the delegation of the Ministry;
c) Conduct internal audits to ensure compliance with laws in the implementation of management tasks related to finance, state assets, development investment, and construction from financial sources of units under the Ministry;
d) Consolidate reports, propose solutions for handling the results of internal audit work in units under the Ministry;
e) Guide, organize implementation, and consolidate reports on sudden and periodic implementation of the Law on Thrift and Combating Wastefulness in units under the Ministry in accordance with the law and the Ministry's regulations.
7. Directly organize and implement modernization programs, projects, plans for material infrastructure of units under the Ministry according to the division of labor by the Ministry.
8. Regarding financial management and administrative management of the Ministry's agency:
a) Prepare annual revenue and expenditure budgets, organize the implementation of the budget, settle revenue and expenditure accounts of the Ministry's agency in accordance with the provisions of the law;
b) Manage and use existing assets and means safely and effectively; organize workplace services and health care for the Ministry's agency;
c) Implement regular security protection work and ensure office order and safety in accordance with the provisions of the law and the Ministry of Finance;
d) Organize the implementation of maintenance and repair work on the Ministry's agency's assets according to approved plans.
9. Carry out other tasks assigned by the Minister and as stipulated by law.
Article 3. Organizational Structure
The Planning and Finance Department has a Director and several Deputy Directors.
The Director of the Planning and Finance Department is responsible to the Minister of Finance for all activities of the Department; manages staff, civil servants, and assets allocated in accordance with regulations.
Deputy Directors have the duty to assist the Director and are responsible to the Director for the tasks assigned to them.
The Planning and Finance Department has the following divisions:
1. Financial Management Division.
2. Internal Audit and Review Division.
3. Investment and Construction Management Division.
4. Asset Management Division.
5. Treasury and Accounting Division.
6. Administrative Management Division.
7. Security Division.
Specific tasks of each division within the Department are defined by the Director of the Planning and Finance Department.
The Planning and Finance Department operates under a specialist system combined with divisional organization. For tasks carried out under the specialist system, the Director is responsible for organizing work and assigning tasks to each civil servant in accordance with their position standards, capabilities, and training in specialized fields to complete assigned tasks.
The staffing of the Planning and Finance Department is determined by the Minister of Finance.
Article 4. Powers of the Director
1. Request heads of units under the Ministry and related units within the Ministry to provide information, documents, and files to serve assigned work.
2. Require related units to temporarily suspend or stop payments for units under the Ministry that fail to comply with regulations on budget preparation, execution, settlement, and state asset management as stipulated by law, while reporting to the Minister for decision-making.
3. Stop construction and require related units to suspend investment capital payments for projects violating investment and construction management regulations, while reporting to the Minister for decision-making.
4. Sign decisions allocating budgets, notify investment and construction capital plans for units under the Ministry according to approved allocation schemes and capital plans reviewed by the Minister.
5. Sign notifications approving annual settlement statements of units under the Ministry; approve investment capital settlement statements for investment and construction projects; sign decisions on asset procurement and reallocation according to the Ministry's classification.
6. Sign guiding, explanatory, and specific operational documents regarding areas under the Department's functions and responsibilities.
7. Sign expenditure vouchers, budgets, and settlement statements of the Ministry's agency; sign labor contracts and service contracts for administrative management of the Ministry's agency as prescribed.
Article 5. Effectiveness and Responsibility for Implementation
This Decision takes effect from the date of signing. Abolish Decision No. 149/2003/QĐ-BTC dated September 12, 2003, of the Minister of Finance on the functions, tasks, powers, and organizational structure of the Treasury and Administrative Management Department.
The Director of the Planning and Finance Department, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry of Finance's Office, and the Heads of units and organizations under the Ministry are responsible for implementing this Decision./.
