THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 184/CP dated November 30, 1994 of the Government on marriage procedures, recognition of children born out of wedlock, adoption, and guardianship between Vietnamese citizens and foreigners;
Pursuant to Decree No. 83/1998/ND-CP dated October 10, 1998 of the Government on household registration;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget;
After receiving opinions from the Ministry of Justice (Letter No. 163/TP-HT dated January 31, 2000), the Ministry of Foreign Affairs (Letter No. 06-CV/NG-LS-PL dated January 4, 2000), and in accordance with the proposal of the Director General of the General Tax Department,

DECISION:

Article 1.-

This Decision attaches the Table of Fees for Household Registration. The fees specified in the table include all related administrative costs associated with household management.

Article 2.-

The subjects required to pay the fees according to this Decision are those individuals whose household status matters are resolved by state agencies authorized under the law.

Article 3.-

State agencies responsible for managing household status, and simultaneously organizing the collection of household registration fees, include:

1. People's Committees of communes, wards, and towns collect fees at the rates specified in Section A of the fee table.

2. Provincial Departments of Justice of centrally governed cities collect fees at the rates specified in Section B of the fee table. 3. Diplomatic missions and consular offices of Vietnam abroad collect fees at the rates specified in Section C of the fee table.

People's Committees of communes, wards, and towns, and Provincial Departments of Justice of centrally governed cities collect household registration fees in Vietnamese Dong; diplomatic missions and consular offices of Vietnam abroad collect fees in US dollars or local currency based on the exchange rate published by the local bank at the time of collection.

The collecting agency is entitled to retain 30% of the actual collected fees temporarily, while the remaining 70% must be deposited into the state budget. The temporarily retained amount must be balanced against the annual budget and used in accordance with the prescribed regulations. At the end of the year, if not fully utilized, the remainder must be deposited into the state budget. The collecting agency is responsible for organizing the collection, depositing, and managing the fees in accordance with Decree No.

Article 4.-

04/1999/ND-CP dated January 30, 1999 of the Government on fees and charges belonging to the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding implementation.

This Decision takes effect 15 days after its issuance and replaces the provisions on household registration fees set forth in Joint Circular No. 33 TT/LB dated April 24, 1995 of the Ministry of Finance and the Ministry of Justice regarding the system of collection, management, and use of fees for registering marriages, recognizing marriages, registering children born out of wedlock, registering adoptions, and recognizing adoptions between Vietnamese citizens and foreigners, and in Joint Circular No. 83 TT/LB dated October 4, 1993 of the Ministry of Finance and the Ministry of Foreign Affairs regarding the collection of foreign consular fees and charges.

HOUSEHOLD REGISTRATION

Article 5.-

Organizations and individuals subject to payment of fees, and related agencies are responsible for implementing this Decision.
