DECISION

Regarding the issuance of the Regulation on the Organization and Operation of the National Lead Agency, Steering Committee, National Coordination Agency, and Implementing Agencies of the Project Components of the National Project under the Project "Preventing Environmental Degradation Trends in the East Sea and Gulf of Thailand." 

MINISTER OF THE MINISTRY OF SCIENCE AND TECHNOLOGY AND ENVIRONMENT

WHEREAS,Decree number 22/CP dated May 22, 1993 of the Government on tasks, powers, and organizational structure LIMITATION machinery of AND    On the basis of the Quality of Goods Ordinance dated December 24, 1999;

Pursuant to Circular No. 814/CP-QHQT dated 06/9/2001 of the Prime Minister regarding the assignment to the Ministry of Science Technology and Environment to serve as the lead agency for Vietnam's participation in the Project Preventing Environmental Degradation Trends in the East Sea and Gulf of Thailand;" subject, organization, unit under the People's Committee of the commune level At the proposal of the Director of the Environmental Protection Department, in This Decision hereby promulgates the Regulation on the Organization and Operation of the National Lead Agency, Steering Committee, Coordination Agency, and Implementing Agencies of the Project Components of the National Project under the Project "Preventing Environmental Degradation Trends in the East Sea and Gulf of Thailand" funded by the Global Environment Facility with the coordination of the United Nations Environment Programme.

This Regulation shall take effect fifteen days from the date of signature and shall cease to be effective upon completion of the Project.

DECISION:

Clause 4 of Article 6Members of the Steering Committee, Coordination Agency, Implementing Agencies of the Project Components, Director of the Environmental Protection Department, Director of the International Cooperation Department, and related units are responsible for implementing this Decision./.

 ON THE ORGANIZATION AND OPERATION OF THE NATIONAL LEAD AGENCY, STEERING COMMITTEE, NATIONAL COORDINATION AGENCY, AND IMPLEMENTING AGENCIES OF THE PROJECT COMPONENTS OF THE NATIONAL PROJECT UNDER THE PROJECT "PREVENTING ENVIRONMENTAL DEGRADATION TRENDS IN THE EAST SEA AND GULF OF THAILAND"

The Minister of Science, Technology and Environment)

This Regulation stipulates the organization and operation of the National Lead Agency, Steering Committee, Coordination Agency, and Implementing Agencies of the Project Components to implement Vietnam's participation in the Project "Preventing Environmental Degradation Trends in the East Sea and Gulf of Thailand" and ensure national security requirements and environmental protection cooperation for sustainable development in the region. . National Lead Agency.

Article 1. Scope of regulation.

The Ministry of Science, Technology and Environment has been assigned by the Government to be the National Lead Agency of the Regional Project.

Article 2To organize the implementation of the Project, the Ministry of Science, Technology and Environment establishes the Steering Committee, designates the Implementing Agencies of the Project Components, and appoints the Coordination Agency of the National Project.

The National Lead Agency is responsible for all activities of the Project related to Vietnam, reviews and coordinates activities between project components and other relevant agencies.

. National Project Steering Committee.

The National Project Steering Committee has the following responsibilities and authorities:

Article 3a) Is accountable to the Minister of Science, Technology and Environment for all activities of the National Project, directs the organization and implementation of the Project.

1. b) Reviews and approves the overall implementation plan of the Project for Vietnam, approves specific implementation plans for project components, reviews reports, information, and data before transferring them to the Regional Project Management Board.

c) Participates in inspection teams of the Project Implementation Agencies when proposed by the Project Coordination Agency.

d) Appoints representatives to participate in the Regional Project Steering Committee.

The Chairperson of the National Project Steering Committee is accountable to the Minister of Science, Technology and Environment for all activities of the Steering Committee. The Chairperson chairs meetings of the Steering Committee. In the absence of the Chairperson, the Deputy Chairperson may chair the meetings.

The Steering Committee will meet quarterly.

2. If necessary, the Chairperson of the Steering Committee may convene extraordinary meetings to address urgent issues.

3. The Steering Committee decides matters according to the majority principle at Steering Committee meetings or through written opinions.

For written opinions: Steering Committee members have the duty to review and provide opinions on matters requiring member opinions within five days from the date of receipt of the minutes requesting opinions.

4. The Steering Committee uses the National Project Coordination Agency as the Secretariat of the Steering Committee.

5. National Project Coordination Agency.

6. The National Project Coordination Agency is appointed by the Minister of Science, Technology and Environment.

Article 4. The National Project Coordination Agency assists the Minister of Science, Technology and Environment in coordinating Vietnam's activities in the Regional Project.

1. Responsibilities and authorities of the National Project Coordination Agency:

2. a) Point of contact with the Regional Project Management Board and Implementing Agencies of the Project in Vietnam.

3. b) Monitors and supervises the implementation of project components and reports to the Chairperson of the Steering Committee.

c) Establishes and coordinates the activities of the National Technical Expert Group to advise the Steering Committee on technical aspects of the Project.

d) Organizes meetings of the National Project Steering Committee, prepares documents and information for Steering Committee meetings.

e) Organizes the review of national reports submitted to the Steering Committee for approval before sending them to the Regional Project Management Board.

. Implementing Agencies of the National Project Components.

The Implementing Agencies of the National Project Components are designated by the Ministry of Science, Technology and Environment.

Article 5Responsibilities and authorities of the Implementing Agencies of the National Project Components:

1. a) Under the direction of the Steering Committee and coordination of the Project Coordination Agency, the Implementing Agencies of the Project carry out tasks agreed upon by UNEP, the Ministry of Science, Technology and Environment, and the Implementing Agencies of the Project.

2. b) Develops annual implementation plans and submits them to the National Project Coordination Agency for approval by the Project Steering Committee. After approval, the plan serves as the basis for implementing agreed-upon contents with UNEP and is the basis for the Project Steering Committee to direct and supervise the implementation of project components and coordinate the overall activities of the National Project.

c) Reports to the Project Coordination Agency on the progress of the Project every eight months, at the end of each quarter of the year.

b) Develop annual implementation plans to be submitted to the Project Coordination Agency for approval by the Project Steering Committee. After approval, these plans serve as the basis for implementing the agreed contents with UNEP and are the grounds for the Project Steering Committee to direct and oversee the execution of project components and coordinate the overall activities of the National Project.

c) Report to the Project Coordination Agency on the progress of the Project every 8 months once, at the end of each quarter of the year.

d) Report and submit project product reports, data, and information related to the implementation of project components to the National Project Coordination Agency for preliminary review before submitting to the Project Steering Committee for approval prior to sending to the Regional Project Management Board.

e) Report to the National Project Coordination Agency on activities related to which the implementing agency of the project component participates.

The implementing agency of the project component shall be responsible for allocating resources to ensure the maintenance of project activities./.
