Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 170/2003/ND-CP dated December 25, 2003 of the Government detailing the implementation of certain provisions of the Price Ordinance;
Pursuant to Decree No. 75/2008/ND-CP dated June 9, 2008 of the Government amending and supplementing certain articles of Decree No. 170/2003/ND-CP;
Pursuant to Decree No. 55/2007/ND-CP dated April 6, 2007 of the Government on trading in gasoline and oil;
Pursuant to the Prime Minister's conclusion reported in Official Letter No. 147/TB-VPCP dated June 23, 2008 of the Government Office reporting the Prime Minister's conclusion on managing the trading of gasoline, oil, and some essential goods;
Pursuant to Official Letter No. 171/TB-VPCP dated July 18, 2008 of the Government Office reporting the Prime Minister's conclusion on the adjustment plan for gasoline and oil prices in the second half of 2008 and amendments to some provisions of Decision No. 289/QD-TTg dated March 18, 2008 of the Prime Minister;
After consultation with the Ministry of Industry and Trade.
DECISION:
Article 1. Permitting enterprises engaged in importing and trading gasoline and oil in the domestic market to adjust their retail prices of gasoline according to market prices within their distribution systems, specifically: the maximum retail price of unleaded gasoline RON 92 at actual temperature (including value-added tax) in areas near oil import ports (Zone 1) shall be as follows:
Unleaded gasoline RON 92: 19,000 VND/liter
- The retail prices of other types of gasoline shall be determined by enterprises engaged in importing and distributing gasoline based on differences in quality and actual selling prices of each type of gasoline on the same market.
- Retail prices in areas far from oil import ports (Zone 2) shall be implemented in accordance with current guidelines of the Ministry of Commerce (now the Ministry of Industry and Trade) as stipulated in Decision No. 0674/2004/QD-BTM dated May 31, 2004.
Article 2. The selling price (including value-added tax) of certain standard types of oil at actual temperature in areas near oil import ports (Zone 1) shall be uniformly regulated nationwide as follows:

- The prices of the above types of oil apply to direct users. For diesel and fuel oil sold to agents and major agents, the price shall be the same as that for direct consumers minus the agency fee stipulated by the Ministry of Commerce (now the Ministry of Industry and Trade) in Decision No. 0676/2004/QD-BTM dated May 31, 2004.
- The retail prices of diesel and fuel oil in areas far from oil import ports (Zone 2) shall not exceed 2% of the prices in Zone 1. Areas in Zones 1 and 2 shall follow current guidelines of the Ministry of Commerce (now the Ministry of Industry and Trade) as stipulated in Decision No. 0674/2004/QD-BTM dated May 31, 2004.
The prices of other types of diesel and fuel oil not specified above shall be determined by traders engaged in exporting, importing, producing, or processing gasoline based on the actual selling prices of the specified standard types of oil in the same market and the quality difference compared to those specified types.
Article 3. Following this decision's adjustment of gasoline and oil prices, the retail prices of gasoline, fuel oil, and boiler fuel by traders engaged in exporting, importing, producing, or processing gasoline shall be implemented according to the market price mechanism stipulated in Decree No. 55/2007/ND-CP dated April 6, 2007 of the Government on trading in gasoline and oil; Decree No. 75/2008/ND-CP dated June 9, 2008 of the Government amending and supplementing certain articles of Decree No. 170/2003/ND-CP detailing the implementation of certain provisions of the Price Ordinance; and Decision No. 1968/QD-BTC dated June 6, 2007 of the Ministry of Finance on the management and regulation of gasoline selling prices.
Article 4. Place of Sale:
- Wholesale: goods are delivered to the central warehouse of the province or city on the buyer's means of transport;
- Retail: goods are sold at gas stations and retail stores in provinces and cities on the buyer's means of transport.
Article 5. Responsibilities of Ministries, sectors, localities, and production and trading units:
- Enterprises engaged in production and trading must strictly comply with the Prime Minister's directives: implement measures to reduce costs, especially gasoline and oil costs, to lower product costs. Trading units of gasoline and oil must continue to reduce business management costs.
- Traders engaged in exporting, importing, or producing and processing gasoline and oil must conduct inventory checks in accordance with current regulations before adjusting prices, ensuring smooth business operations and preventing negative impacts.
- Traders engaged in exporting, importing, or producing and processing gasoline and oil must jointly bear legal responsibility for violations related to pricing and fraudulent trade practices in the trading of oil products within their distribution systems.
- Other traders engaged in exporting, importing, or producing and processing gasoline and oil have the responsibility to import gasoline and oil according to schedule, implement circulation reserves as prescribed to ensure sufficient supply of gasoline and oil for domestic market demand under all circumstances.
- Provincial Departments of Finance shall cooperate with Provincial Departments of Industry and Trade and Market Management Branches to inspect the selling prices of various types of oil in their respective localities, linking price inspections with quality assurance and measurement of goods corresponding to the selling price, promptly identifying and addressing any violations within their authority according to current regulations or reporting to competent authorities for handling in accordance with the law.
Article 6. This Decision takes effect from 10:00 on July 21, 2008, and replaces Decision No. 12/2008/QD-BTC dated February 25, 2008 of the Ministry of Finance on the selling price of gasoline and other oils./.
