This Circular guides on the list, quantity standards for equipping fire prevention and firefighting equipment for motorized roadway transport vehicles including: passenger cars with four seats or more, trailers or semi-trailers carrying passengers towed by passenger cars or tractors; motorized roadway transport vehicles transporting flammable and explosive materials; principles, inspection, funding assurance for equipping and responsibilities of relevant agencies, organizations, and individuals.Fire pumpsArticle 2. The equipping of fire prevention and firefighting equipment for the following types of motorized roadway transport vehicles shall be carried out in accordance with other related laws:Fire pumps and and rescue operations in the People's Public Security Force. a) Motorized roadway transport vehicles exclusively used for national defense and security purposes;;

Bb) Motorized roadway transport vehicles under the management of the Ministry of National Defense, except those serving economic and social purposes;- Agencies under the Ministry of Industry and Trade; c) Motorized roadway transport vehicles of foreign agencies, organizations, and individuals operating in Vietnam enjoying diplomatic or consular privileges and immunities as provided by law;on d) Motorized roadway transport vehicles serving the transportation of high-ranking Party and State leaders of Vietnam and international guests visiting and working in Vietnam as stipulated by the law on Security Guard.Fire pumps 1. PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 3. Principles for equipping fire prevention and firefighting equipment for motorized roadway transport vehicles

1. Compliance with the Fire Prevention and Fighting Law, Traffic Law on Roadways, provisions of this Circular, and other relevant legal regulations.

2. Suitability with operational requirements, nature, characteristics of the vehicle, and technical standards and norms for fire prevention and firefighting.

3. Ensuring economy, rationality, adherence to quotas, and purposefulness.

Article 4. Motorized roadway transport vehicles subject to equipping fire prevention and firefighting equipment

Article 2. Applicability

1. Passenger cars with four seats or more, trailers or semi-trailers carrying passengers towed by passenger cars or tractors as stipulated in Clause 18, Article 3 of the Traffic Law on Roadways and Technical Code VNC 6211:2003 Road Transport Vehicles - Types - Terminology and Definitions, Technical Code VNC 7271:2003 Road Transport Vehicles - Passenger Cars - Classification According to Purpose of Use.

2. Motorized roadway transport vehicles transporting flammable and explosive materials belonging to categories 1, 2, 3, 4, and 9 as stipulated in Clause 1, Article 4 of Decree No. 104/2009/NĐ-CP regardless of the number of seats.

Clause 3. Units and local public security agencies.

Article 4. Agencies, organizations, and individuals related to the equipping of firefighting equipment for motorized road traffic vehicles.

Article 3. Principles for equipping firefighting equipment for motorized road traffic vehicles

1. Comply with the provisions of the Fire Prevention and Combating Law, the Road Traffic Law, this Circular, and other relevant laws.

2. Be appropriate to the requirements, nature, characteristics of operation of the vehicle, and technical standards and regulations on fire prevention and combating.

3. Ensure economy, rationality, compliance with quotas, and purpose.

Article 4. Motorized road traffic vehicles subject to the equipping of firefighting equipment

Article 5. Funding for equipping fire prevention and firefighting equipment for motor vehicles

1. The owner of motor vehicles shall self-fund the cost of equipping fire prevention and firefighting equipment for vehicles under their management.

2. The funding for equipping fire prevention and firefighting equipment for motor vehicles under the management of agencies, organizations, and units benefiting from the state budget at central and local levels shall be guaranteed by the state budget and implemented according to the provisions of the State Budget Law and guiding documents.

Chapter II

LIST, QUOTA FOR EQUIPPING FIRE PREVENTION AND FIREFIGHTING EQUIPMENT

FOR MOTOR VEHICLESFOR VEHICLES

OF MOTOR VEHICLES ON ROADS

Article 6. List and quota for equipping fire prevention and firefighting equipment for motor vehicles

1. The list and quota for equipping fire prevention and firefighting equipment for motor vehicles are guided in Appendix I attached to this Circular.

2. The list and quota for equipping fire prevention and firefighting equipment for motor vehicles transporting dangerous goods shall be guided in Appendix II attached to this Circular.

3. Depending on the characteristics of the type of motor vehicle and the ability to fund, the owner of the vehicle or the agency, organization, or unit using the state budget may equip additional types of fire prevention and firefighting equipment for motor vehicles under their management such as fire extinguishers, rescue equipment, firefighting uniforms, firefighting helmets, firefighting boots, first aid kits with medical tools, and other necessary fire prevention and firefighting equipment.

4. Fire prevention and firefighting equipment equipped for motor vehicles shall be placed in easily visible and accessible locations for use during firefighting without affecting the driver's operation, vision, or safety of passengers on the vehicle.

Fire prevention and firefighting equipment equipped for motor vehicles shall be inspected for quality, type, and model according to the provisions of Clause 5, Article 38 of Decree No. 79/2014/ND-CP and Article 18 of Circular No. 66/2014/TT-BCA dated December 16, 2014, issued by the Minister of Public Security detailing the implementation of certain articles of Decree No. 79/2014/ND-CP dated July 31, 2014, detailing the implementation of certain articles of the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Articles of the Law on Fire Prevention and Fighting.

Chapter III

IMPLEMENTATION

Article 8. Effective Date

1. This Circular takes effect from January 6, 2016.

2. Motor vehicles that have been equipped with fire prevention and firefighting equipment equal to or higher than the guidance provided in this Circular before the date this Circular takes effect shall continue to be used; in cases where they have not been equipped or have been equipped lower than the guidance provided in this Circular, they shall comply with this Circular.

Article 9. Responsibility for implementation

1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department is responsible for guiding, inspecting, and urging the implementation of this Circular;

2. The Traffic Police Department within its assigned functions, tasks, and authorities shall be responsible for inspecting, handling, or guiding the correction of violations related to the equipping of fire prevention and firefighting equipment for motor vehicles according to the law.

3. Based on requirements and actual conditions, the Fire Prevention and Fighting, Rescue Department shall be responsible for leading and coordinating with relevant units to study amendments and supplements to the guidance on equipping fire prevention and firefighting equipment for motor vehicles as provided in this Circular, to submit to the Minister of Public Security for consideration and decision.

4. Provincial and municipal public security organs, fire prevention and firefighting departments directly under the central government shall be responsible for:

a) Guiding, inspecting, and annually reporting to the Ministry of Public Security (through the Fire Prevention and Fighting, Rescue Department) by December each year on the implementation of guidance on equipping fire prevention and firefighting equipment for motor vehicles under their management.

b) Summarizing suggestions and recommendations for amending and supplementing the list and quota for equipping fire prevention and firefighting equipment for motor vehicles under their management and reporting to the Ministry of Public Security (through the Fire Prevention and Fighting, Rescue Department).

5. Heads of General Departments, heads of units directly under the Ministry of Public Security, provincial and municipal public security directors, fire prevention and firefighting department directors, and relevant organizations and individuals shall be responsible for implementing this Circular.

6. It is requested that heads of ministries, ministerial-level agencies, agencies under the Government, and provincial and municipal people's committees directly under the central government within their functions, tasks, and authorities cooperate with the Ministry of Public Security in managing and inspecting the implementation of guidance on equipping fire prevention and firefighting equipment for motor vehicles under their management.

During the implementation of this Circular, if there are difficulties or obstacles, public security units, localities, agencies, organizations, and individuals concerned shall report to the Ministry of Public Security (through the Fire Prevention and Fighting, Rescue Department) for timely guidance.
