Article 1. Announcing the waters of ports within the jurisdiction of Ba Ria - Vung Tau Province

The waters of ports within the jurisdiction of Ba Ria - Vung Tau Province include the following waters:

1. Waters of Vung Tau Port.

2. Waters of offshore oil port at Bach Ho field.

3. Waters of offshore oil port at Dragon field.

4. Waters of offshore oil port at Great Dragon field.

5. Waters of offshore oil port at Rang Dong field.

6. Waters of offshore oil port at Dragon Pair - Dragon Pair West field.

7. Waters of offshore oil port at White Deer field.

8. Waters of offshore oil port at Skylark field.

9. Waters of offshore oil port at Lan Tay field.

10. Waters of offshore oil port at East Sea field.

Article 2. Scope of the waters of ports within the jurisdiction of Ba Ria - Vung Tau Province

The scope of the waters of ports within the jurisdiction of Ba Ria - Vung Tau Province is defined according to the highest tidal level as follows:

1. Scope of Vung Tau Port waters:

a) Boundary towards the sea (South and Southwest of Ganh Rai Bay): delimited by straight lines connecting points GR1, GR2, GR3, GR4, GR5, and GR6 with the following coordinates: GR1: 10°19'15" N, 107°04'55" E (Vung Tau Cape); GR2: 10°14'00" N, 107°07'56" E; GR3: 10°11'00" N, 107°07'56" E; GR4: 10°11'00" N, 107°00'00" E; GR5: 10°24'00" N, 107°00'00" E; GR6: 10°25'10" N, 106°58'12" E (East North edge of Can Gio Cape).

b) Boundary towards the West shore of Ganh Rai Bay: from point GR6 running along the 106°58'12" E meridian (boundary with waters of ports within the jurisdiction of Ho Chi Minh City), connecting to the South edge of Phu Loi Island.
c) Boundary towards the North shore of Ganh Rai Bay: from the intersection of the 106°58'12" E meridian with the South edge of Phu Loi Island, running along the East shore of Phu Loi Island up to the farthest protruding point of the right bank of Ca Mau River mouth.

d) Boundary on Ca Mau River and Thi Vai River: From the two farthest protruding points of Ca Mau River mouth running along both banks of Ca Mau River to the confluence of Ca Mau River - Go Gia River - Thi Vai River. From the two farthest protruding points of Thi Vai River mouth (at the confluence of Thi Vai River - Go Gia River - Ca Mau River) running along both banks of Thi Vai River to the 10°38'24" N latitude line.

đ) Boundary towards the Northeast shore of Ganh Rai Bay: from the left bank of Ca Mau River mouth running along the shore of Ganh Rai Bay through the West South edge of Phu Lang Island, through Dong Channel, to Ben Bền Creek.

e) Boundary on Ben Bền Creek and Rang River: From the two farthest protruding points of Ben Bền Creek mouth running along both banks of Ben Bền Creek upstream to Rang River to the 107°03'30" E meridian crossing the river. From the farthest protruding point of the left bank of Ben Bền Creek mouth running along the West South shore of Long Son Commune, to points GR7 and GR8 with the following coordinates: GR7: 10°26'08" N, 107°06'00" E; GR8: 10°25'00" N, 107°07'00" E (South edge of Go Cong).

g) Boundary on Dinh River and Rach Ba Creek: From point GR8 running along the right bank of Dinh River through the Ha Long Company pier to the straight boundary line cutting across the river at the 10°26'33" N latitude line. From the intersection of the straight line cutting across the river at the 10°26'33" N latitude line with the left bank of Dinh River running along the Dinh River downstream to the farthest protruding point of the right bank of Rach Ba Creek mouth. From the two farthest protruding points of Rach Ba Creek mouth running along both banks of Rach Ba Creek to the straight line cutting across the river 100 meters upstream from the edge of Vungtau Shipyard dock (the boundary between Vungtau Shipyard dock and the dedicated port of Southern Maritime Safety Assurance Corporation). From the farthest protruding point of the left bank of Rach Ba Creek mouth running along the North shore of Ben Dinh Island to Ganh Rai Cape. From Ganh Rai Cape running along the coastline to point GR1.

h) Boundary in Con Dao area: Towards the sea: delimited by straight lines connecting points BD1, BD2, BD3, and BD4 with the following coordinates: BD1: 08°39'47" N, 106°32'23" E (Northwest tip - Hon Ba); BD2: 08°42'26" N, 106°32'08" E (Southwest tip - Hon Tre Lon); BD3: 08°41'08" N, 106°33'13" E (Southwest tip - Hon Trac); BD4: 08°41'01" N, 106°33'34" E. Towards the mainland: from point BD4 running along the shore to the South to the Northeast shore (Hon Ba) to point BD1.

2. Scope of offshore oil port waters at Bach Ho field: Delimited by three circles with a radius of 1 nautical mile, centered at positions BH1, BH2, and BH3 with the following coordinates: BH1: 09°46'31" N, 107°58'43" E; BH2: 09°48'54" N, 108°00'09" E; BH3: 09°43'51" N, 107°57'02" E.

3. Scope of offshore oil port waters at Dragon field: Delimited by a circle with a radius of 1 nautical mile, centered at position MR with the following coordinates: MR: 09°34'33" N, 107°52'52" E.

4. Scope of offshore oil port waters at Great Dragon field: Delimited by a circle with a radius of 1 nautical mile, centered at position DH with the following coordinates: DH: 08°28'36" N, 108°41'06" E.

5. Scope of offshore oil port waters at Rang Dong field: Delimited by a circle with a radius of 1 nautical mile, centered at position RD with the following coordinates: RD: 10°01'16" N, 108°16'01" E.

6. The scope of the offshore oil port waters for the Dragon Twin - Dragon Twin West field: Is limited by a circle with a radius of 01 nautical mile, with its center at the position of DR - DRT having the following coordinates: DR-DRT: 07°48'36" N, 108°11'01" E.

7. The scope of the offshore oil port waters for the White Deer field: Is limited by a circle with a radius of 01 nautical mile, with its center at the position of WDT having the following coordinates: WDT: 09°58'25" N, 107°58'10" E.

8. The scope of the offshore oil port waters for the Skylark field: Is limited by a circle with a radius of 01 nautical mile, with its center at the position of SK having the following coordinates: SK: 07°20'43" N, 108°18'36" E.

9. The scope of the offshore oil port waters for the Western Orchid field: Is limited by a circle with a radius of 01 nautical mile, with its center at the position of WT having the following coordinates: WT: 07°34'45" N, 108°52'03" E.

10. The scope of the offshore oil port waters for the East Sea field: Is limited by a circle with a radius of 0.5 nautical mile, with its center at the position of HT - MT having the following coordinates: HT-MT: 08°03'06" N, 108°54'24" E.

11. The scope of the sea ports defined in this Circular is determined on Chart IA - 100 - 23 reprinted in 2006 of the Vietnam People's Navy and related charts. The coordinates of the points specified in this Circular are applied according to the VN - 2000 Coordinate System and are converted to corresponding Coordinate Systems in the Appendix attached to this Circular.

Article 3. Pilot reception and delivery areas, quarantine zones, anchorage areas, transshipment areas, and storm shelters

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer zones, and storm avoidance zones for vessels entering and leaving sea ports within the jurisdiction of Bà Rịa - Vũng Tàu Province and other water areas as prescribed.

Article 4. Responsibilities of the Vũng Tàu Marine Port Control Office and related Marine Port Control Offices

1. The Vũng Tàu Marine Port Control Office is responsible for:

a) Implementing tasks and authorities as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities in the waters of sea ports within the jurisdiction of Bà Rịa - Vũng Tàu Province.

b) Based on actual conditions regarding meteorological and hydrological conditions, draft depth, tonnage of vessels, and nature of cargo, designate specific positions for vessels to receive and deliver pilots, undergo quarantine, anchor, transfer cargo, and avoid storms in the prescribed waters, ensuring maritime safety, maritime security, and prevention of environmental pollution.

2. Coordination responsibilities for management between the Vũng Tàu Marine Port Control Office and related Marine Port Control Offices: Hồ Chí Minh City, Đồng Nai, Mỹ Tho, Đồng Tháp, and Bình Thuận:

a) The Vũng Tàu Marine Port Control Office is responsible for: Based on actual conditions regarding meteorological and hydrological conditions, nature of cargo, draft depth, and tonnage of vessels entering and leaving sea ports managed by the Marine Port Control Offices of Hồ Chí Minh City, Đồng Nai, Mỹ Tho, Đồng Tháp, and Bình Thuận, designate specific positions for vessels to receive and deliver pilots, undergo quarantine, anchor, and avoid storms in the waters of sea ports within the jurisdiction of Bà Rịa - Vũng Tàu Province as prescribed in Article 3 of this Circular, ensuring maritime safety, maritime security, prevention of environmental pollution, and notifying the related Marine Port Control Office at least 01 hour before the vessel arrives at the pilot reception and delivery zone.

b) The Marine Port Control Offices of Hồ Chí Minh City, Đồng Nai, Mỹ Tho, Đồng Tháp, and Bình Thuận are responsible for: Notifying the Vũng Tàu Marine Port Control Office of the name, nationality, main technical parameters, and other necessary information of vessels at least 02 hours before the vessel arrives at the Vũng Tàu pilot reception and delivery zone. Notifying the Vũng Tàu Marine Port Control Office of the movement of vessels departing from the position designated by the Vũng Tàu Marine Port Control Office to enter the waters of sea ports under their management at least 01 hour before the vessel departs from that position. Processing procedures for vessels entering and leaving the port as prescribed for cases where vessels arrive at the waters of sea ports under their management. Cooperating with the Vũng Tàu Marine Port Control Office to resolve incidents involving vessels entering and leaving sea ports within the jurisdiction of Hồ Chí Minh City and the provinces of Đồng Nai, Bình Dương, Tiền Giang, Vĩnh Long, Bến Tre, Long An, Đồng Tháp, and Bình Thuận when such vessels operate in the waters of sea ports within the jurisdiction of Bà Rịa - Vũng Tàu Province.

Article 5. The State management responsibility for maritime affairs in the territorial waters belonging to the provinces of Bà Rịa - Vũng Tàu, Tiền Giang, Bến Tre, Trà Vinh, and Sóc Trăng.

Outside the scope of the maritime port areas specified in Article 2 of this Circular, the Vũng Tàu Maritime Branch shall be responsible for State management of maritime safety and maritime security in the territorial waters belonging to the provinces of Bà Rịa - Vũng Tàu, Tiền Giang, Bến Tre, Trà Vinh, and Sóc Trăng.

Article 6. Effectiveness

This Circular takes effect from January 1, 2016. The Decision No. 46/2007/QĐ-BGTVT dated September 5, 2007 of the Minister of Transport promulgating the maritime areas of ports belonging to the province of Bà Rịa - Vũng Tàu, the province of Bình Thuận, and the area under the jurisdiction of the Vũng Tàu Maritime Branch is hereby repealed.

Article 7. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Maritime Administration, the Directors of the Vietnam Inland Waterways Administration, the Director of the Vũng Tàu Maritime Branch, the Director of the Ho Chi Minh City Maritime Branch, the Director of the Đồng Nai Maritime Branch, the Director of the Mỹ Tho Maritime Branch, the Director of the Đồng Tháp Maritime Branch, the Director of the Bình Thuận Maritime Branch, the Director of the Ho Chi Minh City Department of Transport, the Director of the Bà Rịa - Vũng Tàu Province Department of Transport, the Director of the Đồng Nai Province Department of Transport, the Director of the Bình Dương Province Department of Transport, the Director of the Bình Thuận Province Department of Transport, the Director of the Trà Vinh Province Department of Transport, the Director of the Sóc Trăng Province Department of Transport, the Director of the Bến Tre Province Department of Transport, the Director of the Long An Province Department of Transport, the Director of the Tiền Giang Province Department of Transport, the Director of the Đồng Tháp Province Department of Transport, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
