Pursuant to the Maritime Code of Vietnam dated November 25, 2015; Pursuant to the Government's Decision No. 10 2018;

CFebruary 10, 2017 on the functions, tasks, powers, and responsibilities of the Ministry of Transport; Government Decree No. 12/2017/NĐ-CP Pursuant to the Government's Decree No. 58/2 7/ND-CP dated May 10, 2017 detailing certain provisions of the Maritime Code of Vietnam regarding maritime activities; BASED, Pursuant to the resolution of the Director of the Legal Department and the Director of the Vietnam Maritime Administration; structure organization The Minister of Transport hereby issues this Circular on the Quang Tri Port Water Area.For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. The Quang Tri Port Water Area under the jurisdiction of Quang Tri province is the port water area located at Cuu Viet area.

Article 2. Scope of the Quang Tri Port Water Area under the jurisdiction of Quang Tri province011. Pursuant to the proposal of the Director of the Department of Ethnic Affairs and Religion Propaganda;on b) Landward boundary of the Thach Han River area: delimited by a straight line connecting point CV1 with coordinates 16°54'15" N, 107°11'05" E to point CV7 with coordinates 16°53'58"N, 107°11'17"E, 150 meters downstream from the Cuu Viet road bridge, running along the Thach Han River bank and coast from point CV1 to point CV2; and running along the Thach Han River bank and coast from point CV7 to point CV6.policies 2. The boundaries of the Quang Tri Port Water Area specified in this Circular are determined on Map No. BDQTR01 published on September 9, 2016, at a scale of 1:10,000 by the Northern Marine Safety Assurance Corporation. The coordinates of the points specified in this Circular are based on the WGS-84 coordinate system and are converted to the VN-2000 coordinate system in the Appendix attached to this Circular.inThe Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception and delivery zones, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving the Quang Tri Port Water Area and other waters and zones as prescribed.

B||| Article 4. Responsibilities of the Quang Tri Maritime Port Authorityng1. To perform tasks and exercise powers as prescribed by the Maritime Code of Vietnam and related legal documents concerning maritime activities in the port and port water areas under the jurisdiction of Quang Tri province.n l2. State management responsibilities for maritime affairs in the sea area under the jurisdiction of Quang Tri province

Article 1. Announcement of port water areas belonging to the province of Quang Tri

Outside the scope of the water area defined in Article 2 of this Circular, the Quang Tri Maritime Port Authority also has state management responsibilities for maritime safety, maritime security, and prevention of environmental pollution in the sea area under the jurisdiction of Quang Tri province.

This Circular takes effect from February 1, 2019. The Decision No. 08/2007/QĐ-GTVT dated February 23, 2007 of the Minister of Transport announcing the Quang Tri Port Water Area and the management area of the Quang Tri Maritime Port Authority is hereby abolished.

The Head of the Ministry’s Office, the Inspector General, the Heads of Departments, the Directors of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Director of the Quang Tri Department of Transport, the Director of the Quang Tri Maritime Port Authority, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.

b) The landward boundary of the Thach Han River area: delimited by a straight line connecting point CV1 with coordinates 16°54'15" N, 107°11'05" E to point CV7 with coordinates 16°53'58"N, 107°11'17"E, located 150 meters downstream from the Cu Viet road bridge, running along the Thach Han River bank and coast to point CV2; and from point CV7 running along the Thach Han River bank and coast to point CV6.

2. The maritime boundaries of the seaport waters specified in this Circular are determined on Map BDQTR01 published on September 9, 2016, at a scale of 1:10,000 by the Northern Marine Safety Assurance Corporation. Coordinates of points specified in this Circular are based on the WGS-84 coordinate system and converted to the VN-2000 coordinate system as set forth in the Appendix attached to this Circular.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot reception areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Thai Binh seaport, Nam Dinh seaport, and other related water areas as prescribed.

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot pick-up and drop-off areas, quarantine zones, anchorage areas, cargo transfer zones, and storm shelters for vessels entering and leaving the Quang Tri Seaport and other water areas as prescribed.

Article 4. Responsibilities of the Quang Tri Maritime Port Office

1. Implement tasks and powers as stipulated in the Vietnam Maritime Code and related legal documents concerning maritime activities at the seaport and seaport waters within the jurisdiction of Quang Tri Province.

2. Based on actual weather conditions, wave and wind patterns, draft, tonnage of vessels, and nature of cargo, designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, anchor, transfer cargo, and seek shelter from storms in accordance with regulations, ensuring maritime safety, maritime security, and environmental pollution prevention.

Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Quang Tri Province

Outside the maritime areas defined in Article 2 of this Circular, the Quang Tri Maritime Port Office also has the responsibility to manage state affairs regarding maritime safety, maritime security, and environmental pollution prevention in the sea area within the jurisdiction of Quang Tri Province.

Article 6. Effectiveness

This Circular takes effect from February 1, 2019. Decree No. 08/2007/QĐ-GTVT dated February 23, 2007, promulgating the seaport waters within the jurisdiction of Quang Tri Province and the management area of the Quang Tri Maritime Port Office, is hereby repealed.

Article 7. Implementation Organization

The Head of the Ministry's General Office, the Inspector General, Heads of Departments, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterway Administration, Directors of the Quang Tri Department of Transport, Directors of the Quang Tri Maritime Port Office, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
