RESOLUTION
On Simplifying Administrative Procedures within the Scope of Management Functions of the Ministry of Agriculture and Rural Development

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister, Chairman of the Government Office, Head of the Specialized Task Force for Administrative Procedure Reform under the Prime Minister,
RESOLUTION:
Article 1. Approves the plan to simplify administrative procedures within the scope of management functions of the Ministry of Agriculture and Rural Development attached to this Resolution.
Article 2. Assigns the Ministry of Agriculture and Rural Development and relevant ministries and sectors within their respective authorities to be responsible for implementing according to the content and deadlines specified in the Plan to Simplify Administrative Procedures approved by the Government in Article 1 and Article 3 of this Resolution.
During the implementation process, the Ministry of Agriculture and Rural Development shall proactively identify and promptly amend, supplement, replace, or abolish regulations within its authority, or submit written proposals to the Ministry of Justice and the Government Office regarding laws, ordinances, decrees of the Government, decisions of the Prime Minister concerning administrative procedures that need to be amended, supplemented, replaced, or abolished to implement the Plan to Simplify Administrative Procedures approved by the Government in Article 1 of this Resolution.
Article 3. For administrative procedures stipulated in laws and ordinances that must be amended, supplemented, replaced, or abolished according to the simplification plan set forth in Article 1 of this Resolution, assigns the Minister of Justice, acting on behalf of the Prime Minister, to report to the Standing Committee of the National Assembly before December 31, 2010, proposing the inclusion of projects for laws and ordinances to implement the simplified administrative procedure plans approved by the Government into the legislative program for 2011 and 2012 in the form of a single document amending multiple documents and applying the expedited procedures as prescribed by the Law on Legislative Documents in 2008.
Based on the legislative program adopted by the National Assembly, assigns the Government Office to take the lead and coordinate with the Ministry of Justice to present to the Prime Minister for deciding the deadline for the Ministry of Agriculture and Rural Development and relevant ministries and sectors to complete the drafting of the aforementioned law and ordinance projects to be sent to the Ministry of Justice for consolidation into a unified document to be submitted to the Government for consideration and decision.
Article 4. For administrative procedures stipulated in legislative documents within the authority to issue of the Government, the Prime Minister, Ministers, and Heads of Ministries and equivalent agencies that need to be amended, supplemented, replaced, or abolished according to the simplification plan set forth in Article 1 of this Resolution, assigns the Ministry of Agriculture and Rural Development to apply the form of a single document amending multiple documents through expedited procedures to issue within its authority or to submit to the Government and the Prime Minister for issuance. In cases where a single document is needed to amend another document, assigns the Minister of Agriculture and Rural Development to consider and decide.
Article 5. Assigns the People's Committees of provinces and centrally-administered cities, based on the content of legislative documents issued by central agencies to implement the simplification plan for administrative procedures set forth in Article 1 of this Resolution, to immediately amend, supplement, replace, or abolish related provisions in documents within their authority and issue them to ensure implementation when the aforementioned central documents come into effect.
Article 6. Assigns the Government Office to monitor, urge implementation, and compile difficulties encountered by the Ministry of Agriculture and Rural Development, relevant ministries, sectors, and localities during the execution of the simplified administrative procedure plans approved by the Government in this Resolution to promptly report to the Prime Minister for resolution.
Article 7. This Resolution takes effect from the date of signature.
The Ministers, Heads of Ministries and Equivalent Agencies, Heads of Government Agencies, Chairmen of the People's Committees of provinces and centrally-administered cities, and related agencies are responsible for enforcing this Resolution.
