Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister of Finance and the Minister of Agriculture and Rural Development,

DECISION:

Article 1. The state budget shall provide financial support for avian influenza prevention and control activities as follows:

1. Direct support to households, individuals, farms, cooperatives, and poultry breeding establishments at central and local levels where poultry (chickens, ducks, geese, swans) have been destroyed due to avian influenza infection, including those with positive serological reactions or detected avian influenza virus according to the regulations of the Ministry of Agriculture and Rural Development, as follows:

a) An average support level of VND 15,000 per destroyed poultry;

b) Support period from December 1, 2004 to December 31, 2005.

2. Financial support for avian influenza prevention and control work at a rate of VND 3,000 per destroyed poultry during the epidemic and post-epidemic period according to the veterinary work regulations of the Ministry of Agriculture and Rural Development, including costs for destroying poultry, purchasing equipment and supplies for disease detection, diagnosis, and prevention; disinfection chemicals for cleaning and sterilizing poultry houses and environments; protective clothing for personnel and allowances for veterinary staff and participants in disease prevention and control work or quarantine services...

Article 2. Principles and sources of funds for implementing the avian influenza prevention and control support policy:

1. The central government budget will cover 50% of the avian influenza prevention and control expenses.

2. For provinces newly adjusted administrative boundaries that receive additional balance transfers from the central government budget, they will be supported at 100%.

3. For provinces with a large number of poultry destroyed, if the provincial budget exceeds 50% of the provincial budget reserve for 2005 assigned by the Prime Minister, the central government budget will supplement the excess amount over 50% of the provincial budget reserve for 2005 to ensure sufficient funding for the province.

4. Hanoi City and Ho Chi Minh City shall proactively utilize their provincial budget reserves.

5. For provinces with low additional costs for avian influenza prevention and control work (less than VND 1 billion), the locality shall proactively use its provincial budget to address these costs, and the central government budget will not provide support.

Article 3. Implementation

1. The Ministry of Finance, in collaboration with the Ministry of Agriculture and Rural Development, based on the extent of damage in each locality, the actual expenditure of the provincial budget for avian influenza prevention and control work, and the provisions of this Decision, shall compile and report to the Prime Minister for consideration and decision on specific support levels from the central government budget for each province and centrally-administered city.

2. The Chairperson of the People's Committees of provinces and centrally-administered cities shall be responsible for:

a) Based on local conditions, actual costs for avian influenza prevention and control work, and current regulations, to decide on specific support levels for different types and ages of poultry destroyed and implement public disclosure at village and commune levels, ensuring direct support to poultry farmers; funds for avian influenza prevention and control work and allowances for forces participating in such work according to provincial directives (excluding allowances for disease control forces of enterprises).

b) Proactively utilize provincial budget reserves to serve avian influenza prevention and control work and support poultry farming entities affected by avian influenza. In cases where the provincial budget is strained, the locality shall report to the Ministry of Finance for advance funding (the central government budget will provide support).

c) At the end of the epidemic or year-end, report to the Ministry of Agriculture and Rural Development and the Ministry of Finance on the implementation results of avian influenza prevention and control work for compilation and reporting to the Prime Minister.

Article 4. This Decision shall take effect from the date of signing.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees under the central government are responsible for implementing this Decision.
