Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and agencies at the ministerial level;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
After receiving comments from relevant ministries and at the proposal of the Director General of the Tax General Department,
DECISION:
Article 1:
Attached to this Decision is the scale of fees for technical inspection and license fees for using machinery, equipment, materials, and substances with strict requirements for safety.
The technical inspection fee shall be collected as follows:
1. For initial inspection to issue a license and periodic inspection to extend the validity of a license, collect 100% of the prescribed fee rate set out in the scale of fees.
2. For periodic inspection according to technical safety standards without extending the validity of a license, collect 50% of the prescribed fee rate set out in the scale of fees.
3. For extraordinary inspection as stipulated by technical safety standards or upon request of the entity, collect 100% of the prescribed fee rate set out in the scale of fees.
Article 2:
The subjects required to pay the fees under this Decision are organizations and individuals (including foreign organizations and individuals, defense units engaged in economic activities) when they are inspected by Safety Inspection Centers established pursuant to the Decision of competent state authorities for technical inspection of machinery, equipment, materials, and substances with strict requirements for safety and issued licenses by the State Labor Safety Inspectorate in accordance with the law.
Article 3:
Safety Inspection Centers established pursuant to the Decision of competent state authorities shall collect technical inspection fees and license fees for using machinery, equipment, materials, and substances with strict requirements for safety (referred to collectively as the collecting agency) and manage and use them as follows:
1. Regarding technical inspection fees:
a) In cases where the collecting agency is provided with regular budget funding for inspection activities, it may temporarily retain up to 10% (ten percent) of the actual fees collected to cover costs for organizing the collection of fees in accordance with point 5.b, Section III of Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance. The remaining amount (90%) must be remitted to the state budget.
b) In cases where the collecting agency is not provided with regular budget funding for inspection activities, it may temporarily retain the technical inspection fees collected before remitting them to the state budget to cover costs for organizing the collection and conducting technical inspections according to the approved budget after obtaining written agreement from the Ministry of Finance. However, the maximum retention rate cannot exceed 90% of the collected fees; the remaining amount (at least 10%) must be remitted to the state budget.
2. Regarding license fees for using machinery, equipment, materials, and substances with strict requirements for safety, the collecting agency may retain 10% of the license fees collected before remitting them to the state budget to cover costs for organizing the collection, while the remaining amount (90%) must be remitted to the state budget.
The collecting agency has the responsibility to organize the collection, remittance, and management of fees in accordance with Government Decree No. 04/1999/NĐ-CP dated January 30, 1999 on fees and charges belonging to the state budget and Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding implementation.
Article 4:
This Decision takes effect 15 days after its date of issuance. The scale of fees attached to this Decision replaces the scale of fees attached to Circular No. 66 TT/LB dated August 29, 1995 of the Joint Ministry of Finance-Labor, Invalids, and Social Affairs.
Article 5:
Organizations and individuals subject to payment of fees; units responsible for collecting technical inspection fees and license fees for using machinery, equipment, materials, and substances with strict requirements for safety, and related agencies are responsible for implementing this Decision.
