DECISION OF THE MINISTER OF FINANCE

Regarding the issuance of the fee schedule for technical inspection fees and permitfees for the use of machinery, equipment, materials, and substances with strictsafety requirements

for the use of machinery, equipment, materials, and substances with strict safetyrequirements

 

THE MINISTER OF FINANCE

Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, authorities, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decree No. 178/CP dated October 28, 1994 of the Government onthe duties, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget;

After receiving comments from relevant ministries and at the proposal of the DirectorGeneral of the General Tax Department.

 

DECISION:

Article 1. This Decision attaches the fee schedule for technical inspection fees and permitfees for the use of machinery, equipment, materials, and substances with strictsafety requirements.

As for the technical inspection fees, they shall be collected as follows:

1. The initial inspection to issue a permit and periodic inspections to renew permitsshall be charged at 100% of the prescribed fee rate in the fee schedule.

2. Periodic inspections according to technical safety standards without permit renewalshall be charged at 50% of the prescribed fee rate in the fee schedule.

3. Unscheduled inspections as stipulated by technical safety standards or at therequest of the entity shall be charged at 100% of the prescribed fee rate in the feeschedule.

Article 2. The entities subject to payment of fees under this Decision are organizations andindividuals (including foreign organizations and individuals, defense units engaged ineconomic activities) when established by Safety Inspection Centers pursuant to theDecision of competent state authorities to conduct technical inspections onmachinery, equipment, materials, and substances with strict safety requirementsand issue permits for their use in accordance with the law.

Article 3. Safety Inspection Centers established pursuant to the Decision of competent stateauthorities shall collect technical inspection fees and permit fees for the use ofmachinery, equipment, materials, and substances with strict safety requirements(collectively referred to as the collecting agency) and manage and use them asfollows:

1. For technical inspection fees:

a) In cases where the collecting agency is provided with regular budget funding forinspection activities, it may temporarily retain up to 10% (ten percent) of thecollected fees to cover expenses for organizing the collection of fees in accordancewith point 5.b, Section III of Circular No. 54/1999/TT-BTC dated May 10, 1999,issued by the Ministry of Finance. The remaining amount (90%) must be depositedinto the state budget.

b) In cases where the collecting agency is not provided with regular budget fundingfor inspection activities, it may temporarily retain the amount of inspection feescollected before depositing them into the state budget to cover expenses fororganizing the collection and conducting technical inspections according to theapproved budget after obtaining written agreement from the Ministry of Finance.The maximum retention rate shall not exceed 90% of the collected fees; theremaining amount (at least 10%) must be deposited into the state budget.

2. For permit fees for the use of machinery, equipment, materials, and substancesthat have strict safety requirements, the collecting agency may retain 10% of thepermit fees collected before depositing them into the state budget to coverexpenses for organizing the collection. The remaining amount (90%) of the permitfees must be deposited into the state budget.

The collecting agency has the responsibility to organize the collection, deposit, andmanagement of fees in accordance with Government Decree No. 04/1999/NĐ-CPdated January 30, 1999, regarding fees and charges belonging to the state budgetand Circular No. 54/1999/TT-BTC dated May 10, 1999, issued by the Ministry ofFinance guiding implementation.

Article 4. This Decision takes effect 15 days after its date of signature. The attached fee schedulereplaces the fee schedule attached to Joint Circular No. 66 TT/LB dated August 29,1995, of the Ministry of Finance and the Ministry of Labor, Invalids, and SocialAffairs.

Article 5. Organizations and individuals subject to payment of fees; units responsible forcollecting technical inspection fees and permit fees for the use of machinery,equipment, materials, and substances that have strict safety requirements; andrelated agencies are responsible for implementing this Decision./.
