Regarding the amendment and supplementation of the overall planning for the development of the Beer - Wine - Soft Drink Industry in Vietnam until 2010 - Wine - Beverages to 2010

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 125/QĐ-TTg dated January 28, 2003 of the Prime Minister approving the Overall Plan for the Restructuring and Modernization of State-owned Enterprises under the Ministry of Industry for the period 2003-2005;

Considering the proposal of the Ministry of Industry at the Memorandum No. 1243/TTr-KHĐT dated April 2, 2003 regarding the amendment and supplementation of the Overall Planning for the Development of the Beer - Wine - Soft Drink Industry in Vietnam until 2010.

DECISION:

Article 1. Approves the amendment and supplementation of the Overall Planning and some measures for the development of the Beer - Wine - Soft Drink Industry in Vietnam until 2010, with the main contents as follows:

1. Objectives:

- Building the Beer - Wine - Soft Drink Industry in Vietnam into a strong economic sector. Utilizing domestic raw materials to the maximum extent to develop high-quality products, diversify product types, improve packaging and design; strive to reduce production costs, enhance competitiveness, meet domestic demand, produce exportable products, increase state revenue, and integrate firmly into regional and global economies.

- Building the Hanoi Beer - Wine - Soft Drink Corporation and the Saigon Beer - Wine - Soft Drink Corporation into two strong corporations, playing a leading role in the beer and wine manufacturing industry; serving as the core in producing high-quality soft drinks.

- Encouraging various economic sectors to participate in the production of high-quality soft drinks from domestic raw materials to meet domestic consumption needs and for export.

2. Orientation for Development:

a) On technology and equipment: Modernize technology, gradually replace existing technology and equipment with advanced and modern technology and equipment from around the world, ensuring quality standards and food safety and environmental protection regulations according to Vietnamese and international standards to enhance the competitiveness of products on both domestic and international markets.

b) On investment: Focus on investing in large-scale factories; fully utilize the capacity of production facilities equipped with advanced technology; simultaneously expand the capacity of some existing factories. Diversify investment forms and capital mobilization methods, encourage the mobilization of capital from various domestic economic sectors, issue bonds and stocks; accelerate the process of shareholding for state-owned enterprises that do not need to hold 100% equity.

c) On scientific research and training: Plan and build laboratories and research centers; implement experimental applications of science and technology in production; at the same time plan and train a cadre of scientific and technical staff to meet the development requirements of the industry.

3. Main Indicators

a) On beer:

- Production volume:

In 2005: 1.2 billion liters;

In 2010: 1.5 billion liters.

- The Hanoi Beer - Wine - Soft Drink Corporation and the Saigon Beer - Wine - Soft Drink Corporation must strive to play a key role in enhancing the reputation of Vietnamese beer brands, ensuring production and sales account for 60% to 70% of the domestic market share and aiming for exports.

- Concentrate on investing in large-scale factories with efficient business operations, strictly manage food safety, ensure quality and cost levels acceptable to consumers, specifically:

+ Construct a new beer factory in Cu Chi belonging to the Saigon Beer - Wine - Soft Drink Corporation with a capacity of 100 million liters/year (for the period 2002-2005) and the potential to expand to 300 million liters/year in subsequent years.

+ Construct a new beer factory belonging to the Hanoi Beer - Wine - Soft Drink Corporation with a capacity of 100 million liters/year and the potential to expand to 200 million liters/year in subsequent years.

- For foreign-invested enterprises: comply strictly with investment permits, fully exploit the approved design capacity. In the coming years, no consideration will be given to issuing permits for new joint ventures or increasing the production capacity of existing facilities.

b) On wine:

- Production volume:

In 2005: 250 million liters;

In 2010: 300 million liters;

- The Hanoi Beer - Wine - Soft Drink Corporation and the Saigon Beer - Wine - Soft Drink Corporation play a key role in producing traditional specialty wines and high-quality wines to meet domestic demand and for export; appropriate measures should be taken to gradually reduce handcrafted wine production.

- Strengthen state management in wine production and consumption.

- Focus on investing in the modernization of equipment and technology, intensifying the production of high-quality industrial wine, and minimizing harmful components.

- Propose cooperation or joint ventures with foreign countries to produce certain high-quality wines using domestic raw materials, thereby reducing imports.

- From 2001 to 2005, the Hanoi Alcohol Company and the Western Vietnam Alcohol Company will invest in modernizing technology and equipment so that each company reaches a capacity of 5 million liters/year of alcohol and 10 million liters/year of various wines, doubling this capacity in the subsequent phase.

c) On soft drinks:

In 2005: 800 million liters;

In 2010: 1.1 billion liters.

- The Hanoi Beer - Wine - Soft Drink Corporation and the Saigon Beer - Wine - Soft Drink Corporation play a key role in improving product quality and reducing costs; at the same time, encourage various economic sectors to participate in the production of soft drinks from domestic raw materials, prioritizing the expansion of fruit juice production capacity; do not invest in increasing the production capacity of carbonated beverages made from imported flavorings.

Article 2. Implementation organization; responsibilities of relevant Ministries, Departments, the Hanoi Beer - Wine - Soft Drink Corporation, the Saigon Beer - Wine - Soft Drink Corporation, and related localities

- Propose to the Prime Minister to supplement additional members to the Board of Directors of Vietnam Coal-Mineral Industries Group.

- Chair and coordinate with relevant ministries, sectors, Hanoi Beer-Alcohol-Water Corporation, Saigon Beer-Alcohol-Water Corporation, and People's Committees of provinces and cities to develop a roadmap for shareholding reform; identify a list of state-owned enterprises that will retain controlling shares in the beer, alcohol, and beverage industry; at the same time, direct the reorganization of existing beer, alcohol, and beverage production facilities.

- Arrange new investment projects in accordance with the planning of each region and locality.

- Direct Hanoi Beer-Alcohol-Water Corporation and Saigon Beer-Alcohol-Water Corporation to cooperate with localities in reorganizing beer, alcohol, and beverage production facilities equipped with advanced technology but operating inefficiently, failing to meet hygiene and food safety standards, and not fulfilling annual budget obligations. For small-scale factories with outdated technology, research should be conducted on shifting their business direction or implementing shareholding reform, selling, leasing, dissolving, or declaring bankruptcy according to regulations.

- Coordinate with relevant ministries and sectors to issue documents related to the production and business activities of beer, alcohol, and beverages.

- Based on the goals and indicators in the Industry Plan, direct the implementation and organize periodic evaluations of the Plan's execution, and propose adjustments to the Plan in line with specific economic and social conditions nationwide.

2. Hanoi Beer-Alcohol-Water Corporation and Saigon Beer-Alcohol-Water Corporation:

- Chair and coordinate with localities to reorganize beer, alcohol, and beverage production and business operations throughout the industry; establish some core units to lead in technological innovation, equipment rationalization, cost reduction, product quality improvement, and efficiency enhancement in all provinces and cities.

- Cooperate with localities to study the cultivation of barley domestically to replace imported raw materials, gradually producing export products.

3. Ministries and sectors: Planning and Investment, Finance, Trade, Agriculture and Rural Development, Science and Technology, Natural Resources and Environment, Health, State Bank of Vietnam, and the Industrial Development Support Fund, within their respective functions, coordinate with the Ministry of Industry and Hanoi Beer-Alcohol-Water Corporation and Saigon Beer-Alcohol-Water Corporation:

- Study and propose support policies and capital sources for investment projects and raw material regions in the beer, alcohol, and beverage industry.

- Issue quality standards for beer, alcohol, and beverages and coordinate with localities to inspect product quality, ensuring food safety and environmental hygiene standards and industrial property laws.

- Develop anti-dumping, substandard goods, counterfeit goods, smuggling, and promotional advertising regulations for beer, alcohol, and beverage products circulating in the domestic market.

- Strengthen management through business registration, quality certification, and ensure full tax obligations for medium and small-scale alcohol production and business establishments.

- Examine and handle according to the Law on Foreign Investment for foreign joint ventures producing beer, alcohol, and beverages that have been suffering long-term losses.

4. People's Committees of provinces and centrally-administered cities:

- Direct local beer, alcohol, and beverage manufacturing enterprises to operate in accordance with industry development goals and orientations. Focus on stabilizing local raw material regions to ensure production materials; simultaneously increase employment and improve workers' living standards.

- Coordinate with the Ministry of Industry, relevant ministries and sectors, and Hanoi Beer-Alcohol-Water Corporation and Saigon Beer-Alcohol-Water Corporation to reorganize enterprises and manage production and business activities in the beer, alcohol, and beverage industry within their provincial and municipal jurisdictions.

Article 3. This Decision replaces Decision No. 28/2002/QĐ-TTg dated February 6, 2002, and takes effect fifteen days after its publication in the Official Gazette. Previous provisions contrary to this Decision are abolished.

Article 4. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairmen of People's Committees of centrally governed cities and provinces, and Hanoi Beer-Alcohol-Water Corporation and Saigon Beer-Alcohol-Water Corporation are responsible for implementing this Decision./.
