Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government detailing the Law on Trade regarding the operation of commercial appraisal service businesses;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Finance;
After receiving the opinions of the Ministry of Trade in Circular No. 4340/BTM-PC dated July 13, 2006 and Circular No. 4743/BTM-PC dated August 1, 2006;
At the proposal of the Director of the Policy Department;
DECISION:
Article 1. A commercial trader conducting commercial appraisal services when registering a business seal with the Department of Trade (Department of Trade and Tourism) as stipulated in Article 9 of Decree No. 20/2006/NĐ-CP dated February 20, 2006 of the Government detailing the Law on Trade regarding the operation of commercial appraisal service businesses must pay a registration fee for the business seal at 20,000 VND per seal per registration.
Article 2. The revenue from the registration fees for business seals prescribed in this Decision shall be a state budget revenue item, managed and utilized as follows:
1. The fee collection agency (the Department of Trade or the Department of Trade and Tourism) is entitled to retain 35% (Thirty-five percent) of the collected registration fees to cover expenses for collecting the fees according to the prescribed regulations;
2. The total amount of collected registration fees, after deducting the retained amount according to the ratio specified in Clause 1 of this Article, the remaining amount (65%) shall be declared and submitted to the state budget by the fee collection agency according to the corresponding chapter, category, and item, sub-item 01 under item 049 of the current state budget classification.
Article 3.
1. This Decision shall take effect fifteen days after its publication in the Official Gazette.
2. Other contents related to the collection, submission, management, utilization, and public disclosure of the registration fee system and payment vouchers not mentioned in this Decision shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and charges and Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance amending and supplementing Circular No. 63/2002/TT-BTC.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
