This Circular stipulates the authority to mobilize and assign responsibilities for patrols and controls; the duties and powers of officers and soldiers of the Mobile Police Force during patrols and controls; the objects, forms, procedures for conducting patrols and controls; handling violations of laws and equipping technical devices, service animals, weapons, and auxiliary tools during patrols and controls to ensure security, public order, and social safety of the Mobile Police Force.development2. The patrols and controls conducted by the Mobile Police Force when mobilized to cooperate with traffic police to patrol and control traffic order and safety are not within the scope regulated by this Circular.đượ This Circular applies to officers and soldiers of the Mobile Police Force when performing patrols and controls to ensure security, public order, and social safety; local public security units and organizations and individuals related to these activities.n l2. Timely detection, prevention, and handling of law violations; actively suppressing persons obstructing or resisting public officials in the performance of their duties.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

3. Officers and soldiers of the Mobile Police Force must wear insignia and uniforms in accordance with the law and regulations of the Ministry of Public Security when performing patrols and controls.

4. Strictly prohibited from exploiting patrols and controls to harass, inconvenience the people, infringe upon the interests of the State, lawful rights and interests of organizations and individuals, or engage in other acts contrary to the law.

Article 2. Applicability

AUTHORITY TO MOBILIZE AND ASSIGN RESPONSIBILITIES FOR PATROLS AND CONTROLS

Article 3. Principles of patrol and control activities

Clause 1. Comply with the provisions of this Circular, other relevant laws, and the Regulations of the People's Public Security; implement according to plans and schemes approved by competent authorities.

1. The Minister of Public Security has the authority to mobilize Mobile Police Force units to perform patrols and controls to ensure security, public order, and social safety throughout the country.

2. The Commander of the Mobile Police Force has the authority to mobilize Mobile Police Force units up to battalion level under his command to perform patrols and controls to ensure security, public order, and social safety throughout the country and promptly report to the Minister of Public Security. Within the scope of their duties and powers, the Commander of the Mobile Police Force and the Provincial Public Security Director (hereinafter referred to collectively as the Provincial Public Security) shall coordinate in mobilizing the Mobile Police Force to conduct patrols and controls to ensure security, public order, and social safety in their respective areas.

3. The Provincial Public Security Director has the authority to mobilize Mobile Police Force units under his command to perform patrols and controls to ensure security, public order, and social safety according to plans and schemes approved by competent authorities within the management area and promptly report to the Minister of Public Security.

Chapter II
SPECIFIC PROVISIONS

Section 1
1. Guide, inspect, and urge the Mobile Police Force to implement patrol and control work to ensure security, public order, and social safety throughout the country.

Article 4. Authority to Mobilize

2. Take the lead and coordinate with local public security units to organize patrol and control activities to ensure security, public order, and social safety in key areas, targets, routes, and complex regions as necessary.

3. Advise the leadership of the Ministry of Public Security on the use of the Mobile Police Force for patrols and controls to ensure security, public order, and social safety in key areas, targets, routes, and complex regions. Issue plans and schemes for patrols and controls to ensure security, public order, and social safety throughout the country within their authority or submit them to competent authorities for issuance.

4. Organize the forces of the Mobile Police Command to operate independently or take the lead and coordinate with local public security units and relevant forces to conduct patrols and controls to ensure security, public order, and social safety throughout the country as necessary.

Article 5. Responsibilities of the Mobile Police Command

1. Guide, inspect, urge the Mobile Police Force to carry out patrol and control work to ensure national security, public order, and social safety throughout the country.

2. Take the lead and coordinate with local public security units to organize patrol and control activities to ensure national security, public order, and social safety in key areas, targets, routes, and complex regions when necessary.

3. Advise the leadership of the Ministry of Public Security on the use of the Mobile Police Force for patrols and controls to ensure national security, public order, and social safety in key areas, targets, routes, and complex regions. Issue plans and schemes for patrols and controls to ensure national security, public order, and social safety throughout the country within their authority or submit them to competent authorities for issuance.

4. Organize the forces under the Command of the Mobile Police Force to independently implement or take the lead and coordinate with local public security units and related forces to conduct patrols and controls to ensure national security, public order, and social safety throughout the country when necessary.

Article 6. Responsibilities of Provincial Public Security

1. The Director of Provincial Public Security shall be responsible for:

a) Directing the Mobile Police force under his/her jurisdiction to patrol and control to ensure security, public order, and social safety within the managed area;

b) Assigning and organizing patrol and control activities of the Mobile Police Force under their authority.

2. The Protective Police Department, the Mobile Police Regiment of the Public Security of Hanoi City, Ho Chi Minh City, and the Protective and Mobile Police Department of Provincial Public Security shall be responsible for:

a) Advising the Director of Provincial Public Security on decisions regarding the deployment of Mobile Police units under their jurisdiction to organize patrols and controls to ensure security, public order, and social safety, and handle violations of the law within their authority;

b) Deploying forces and organizing patrol and control activities and handling violations of the law as prescribed;

c) Taking the lead and coordinating with District, County, Town, and City Public Security to patrol and control to ensure security, public order, and social safety in complex areas, targets, routes, and regions.

Section 2
DUTIES AND POWERS OF OFFICERS AND SOLDIERS PERFORMING PATROL AND CONTROL TASKS

Article 7. Tasks

1. Strictly executing the directives and instructions from superiors and the patrol and control plans and schemes approved by the competent authorities.

2. Ensuring security, public order, and social safety within the patrol and control areas, targets, routes, and regions; detecting, preventing, and handling or proposing competent authorities to promptly and strictly handle violations of the law.

3. Cooperating with specialized units of the People's Public Security to combat crime and other violations within the assigned patrol and control areas, targets, routes, and regions.

4. Reporting and proposing competent authorities to recommend relevant agencies and organizations to take timely measures to address weaknesses and shortcomings in state management of security, public order, and social safety.

5. Performing other tasks as prescribed by law and the Ministry of Public Security.

Article 8. Powers

1. Controlling persons, means of transport, objects, and documents according to the provisions of the law when performing patrol and control tasks.

2. Handling violations of the law concerning security, public order, and social safety within their authority.

3. Applying preventive measures as prescribed by the law.

4. Requesting agencies, units, organizations, and individuals to cooperate and support in resolving cases and matters related to security, public order, and social safety.

5. Using weapons, auxiliary tools, and technical equipment, service animals to serve patrol and control activities according to the provisions of the law and the Ministry of Public Security.

6. Exercising other powers as prescribed by the law and the Ministry of Public Security.

Section 3
OBJECTS, FORMS, PROCEDURES FOR PATROL AND CONTROL

Article 9. Objects of Patrol and Control

1. Objects of patrol include: areas, targets, routes, and regions assigned.

2. Objects of control include: persons, means of transport, objects, and documents.

Article 10. Open Patrol and Control

1. Open patrol and control includes:

a) Patrol and mobile control;

b) Controlling at checkpoints within the patrol and control areas, targets, routes, and regions.

2. In cases where control is conducted at a single point or checkpoint, there must be a plan and scheme approved by the competent authority.

3. When patrolling and controlling openly, they must use insignia and uniforms as prescribed; using means of transportation or walking to patrol and control within the assigned areas, targets, routes, and regions; using technical equipment, service animals, weapons, and auxiliary tools as prescribed by the law and the Ministry of Public Security.

Article 11. Public patrol and control combined with undercover operations

1. Public patrol and control combined with undercover operations shall be carried out in the following cases:

a) Serving the work of combating crime when required;

b) When there are complex developments concerning security and public order.

2. The Commander of Mobile Police Force and the Director of Provincial Police shall decide on the implementation of public patrol and control combined with undercover operations.

3. The implementation of open patrol and control combined with undercover operations must have plans and schemes approved by the Commander of Mobile Police and the Director of Provincial Public Security. The patrol and control team must arrange undercover officers (in civilian clothes) to gather information, promptly detect, combat, and prevent violations of the law concerning security, public order, and social safety within the assigned areas, targets, routes, and regions. Upon discovering violations of the law, they must immediately inform the open patrol and control team to proceed with control and handling according to the law.

Article 12. Surveying the Area

Before conducting patrols and controls, the Mobile Police unit must conduct basic investigations to understand the situation and characteristics related to ensuring security, public order, and social safety in the assigned areas, targets, routes, and regions, and develop plans and schemes for patrols and controls.

Article 13. Building and Approving Plans and Schemes for Patrol and Control

1. Units under the Command of Mobile Police from Battalion level and above shall perform patrols and controls with responsibilities:

a) Developing plans and schemes for patrols and controls within the protected targets as prescribed;

b) Developing independent plans and schemes for patrols and controls according to the directives of competent authorities or in necessary situations and informing local Public Security in the patrol and control areas, routes, and regions for coordination;

c) Developing plans and schemes for coordinated patrols and controls and reporting to competent authorities for decision-making when there is a request for coordinated patrols and controls from local Public Security units and regions where they are stationed.

2. The Mobile Police units of Provincial Public Security shall perform patrols and controls with responsibilities to develop regular monthly and quarterly plans and schemes for patrols and controls; special topic plans and schemes during peak periods;

3. The patrol and control plan includes the following main contents: purpose and requirements; tasks, methods, and approaches; command, task assignment, and coordination among forces; conditions for assurance; time and location of implementation. The patrol and control scheme includes the following main contents: general situation and forecast; principles and guidelines; determination of areas, targets, routes, and regions, anticipated scenarios, response measures, and organization and utilization of forces; command, communication, and assurance of necessary conditions; implementation organization.

4. Approving plans and schemes for patrols and controls

a) The Commander of Mobile Police approves plans and schemes for patrols and controls of the Command of Mobile Police; the Director of Provincial Public Security approves plans and schemes for patrols and controls of Provincial Public Security;

b) Heads of Mobile Police units approve plans and schemes for patrols and controls developed by their units;

c) Heads of higher-level units approve plans and schemes for patrols and controls when they involve multiple areas, targets, routes, and regions.

Article 14. Deployment of forces, means, technical equipment, service animals, weapons, and support tools for patrolling, inspection, and duties of the Shift Leader and Patrol Team Leader

1. Based on actual circumstances and patrol and inspection plans and schemes, the Head of the Mobile Police Unit assigns the Shift Leader, Team Leader, number of officers and soldiers in each team, and means, technical equipment, service animals, weapons, and support tools to carry out patrols and inspections.

2. The Shift Leader for patrols and controls shall be a Company-level commander or higher, responsible for performing the tasks stipulated in Article 7 of this Circular and shall have the responsibility to:

a) Assigning personnel, inspecting equipment, technical devices, service animals, weapons, and support tools, and assigning tasks to officers and soldiers in the patrol shift;

b) Inspecting preparations before performing tasks; issuing orders to move to the operational area according to the plan and scheme;

c) Receiving and processing information from patrol teams about situations occurring during patrols and inspections; reporting to competent authorities when complex situations arise.

2. The Patrol Team Leader is a police officer of the People's Public Security Force, implementing the tasks specified in Article 7 of this Circular and is responsible for:

a) Briefing the plan, scheme of patrols and inspections, posture, etiquette, and conduct to officers and soldiers performing patrol and inspection duties;

b) Urging officers and soldiers to prepare for the patrol and inspection shift, preparing means, technical equipment, service animals, weapons, and support tools and concentrating according to the Shift Leader's order;

c) Monitoring the situation, commanding, and managing the work of the patrol team, performing tasks within the designated areas, targets, routes, and regions, and assigning positions and tasks to each officer and soldier; controlling and handling violations within their authority;

d) Maintain communication with officers and soldiers, the Shift Leader for patrols and controls, and related agencies when necessary; promptly report to the Shift Leader in case of sudden and complex incidents;

d) Summarizing the situation, reporting the results of the patrol and inspection shift.

Article 15. Control of Persons, Means, Objects, and Documents

1. Control of persons, means, objects, and documents shall be carried out in the following cases:

a) When discovering acts violating laws on security and public order;

b) When there is evidence that objects, documents, or means are concealed in persons or means, which are used for administrative violations, and if not inspected immediately, these objects, documents, or means will be dispersed or destroyed;

c) When discovering a person committing a crime on the spot, a person being sought for arrest, or a person being searched for.

2. Upon discovering cases under Clause 1 of this Article, officers and soldiers performing patrol and inspection duties shall handle them according to the provisions of Articles 18 and 19 of this Circular.

Article 16. Orders for Implementing Control

Orders for implementing control by the Mobile Police are executed through the following forms:

1. Hand signals and baton commands are used when officers and soldiers of the Mobile Police patrol and inspect openly using transportation or walking.

2. Whistles, handheld radios, and loudspeakers mounted on patrol vehicles are used during daytime patrols and inspections using transportation.

3. Signal lights, warning signs, barriers, or barricades are used during patrols and inspections in complex areas, regions, or targets regarding security, public order, and social safety.

Article 17. Conclusion of patrol and control activities

1. Upon concluding patrol and control activities, the patrol team leader must compile and report on the results of the work and the handling of violations of laws related to national security, public order, and social safety during the patrol and control shift.

2. The patrol team leader must check all documents, equipment, technical devices, working animals, weapons, and support tools according to regulations and hand them over to the unit.

3. Compile relevant situations to supplement materials related to areas, targets, routes, and territories into the basic investigation file of the Mobile Police Force.

Section 4
HANDLING VIOLATIONS

Article 18. Handling Violations During Patrol and Control Activities

1. When discovering violations of laws related to national security, public order, and social safety, officers and soldiers conducting patrols and controls must immediately stop the violation and clearly inform the violator of the nature of the violation.

2. In cases where the violation is an administrative offense, officers and soldiers performing patrol and control duties must issue an administrative penalty decision within their authority; if it falls outside their authority, they must prepare a record, apply necessary preventive measures, and promptly transfer it to the competent authority for handling according to the law on administrative offenses.

3. In cases where a criminal act is discovered on the spot or a person wanted or sought is found, officers and soldiers performing patrol and control duties must immediately stop, apprehend, neutralize the violation, and report to the competent authority for resolution according to the law.

Article 19. Application of Preventive Measures Against Violations of Laws Related to National Security and Public Order

1. In cases where it is necessary to promptly prevent violations of laws related to national security, public order, and social safety or to ensure the handling of such violations, officers and soldiers performing patrol and control duties have the responsibility to apply preventive measures according to the law. The application of preventive measures must comply with the authority, objects, procedures, and formalities prescribed by law.

2. In cases where the violator engages in acts of resistance against law enforcement officials, preventive measures shall be applied as stipulated in Article 14 of Decree No. 208/2013/NĐ-CP dated December 17, 2013 of the Government on preventive, blocking, and handling measures against acts of resistance against law enforcement officials.

Section 5
EQUIPMENT OF MEANS, TECHNICAL DEVICES, WORKING ANIMALS, WEAPONS, AND SUPPORT TOOLS IN PATROL AND CONTROL ACTIVITIES

Article 20. Equipment of Means, Technical Devices, Working Animals, Weapons, and Support Tools in Patrol and Control Activities

1. Transportation means include: cars, motorcycles, boats, and other types of vehicles equipped with sirens and signal lights that are entitled to priority according to the law. Both sides of the car, boat, and patrol vessel must bear reflective Mobile Police Force insignia; both sides of the fuel tank or the rear side of the two-wheeled motorcycle patrol must bear reflective Mobile Police Force insignia.

2. Technical devices include:

a) Camera, photo, and audio recording devices;

b) Flashlights;

c) Other technical devices and means.

3. Communication means: Walkie-talkies.

4. Working animals.

5. Weapons and support tools provided to the Mobile Police Force.

6. Other technical devices and means as prescribed by the Ministry of Public Security.

Article 21. Use of technical means, equipment, service animals, weapons, and support tools

1. Priority signal lights shall be used continuously in the following cases:

a) Mobile patrols and public controls;

b) Controls at a point, checkpoint within a region, route, target, or area.

2. When using technical means, equipment, service animals, weapons, and support tools as prescribed in Article 20 of this Circular, they must be implemented in accordance with the legal provisions on the use of technical means, equipment, and service animals by the People's Public Security Forces in patrol and control activities, and the laws on the management and use of weapons and support tools.

Chapter III
IMPLEMENTING PROVISIONS

Article 22. Effectiveness

This Circular takes effect from December 20, 2015. Decision No. 910/2006/QĐ-BCA(C11) dated August 2, 2006, issued by the Minister of Public Security regarding the procedures for patrolling and controlling to ensure security and order by the Mobile Police Force, shall cease to be effective from the date this Circular takes effect.

Article 23. Responsibility for Implementation

Clause 1. The Commandant of the Mobile Police Force shall be responsible for:

a) Issue specific guidance documents on the contents of this Circular and direct, guide, inspect, and urge the implementation of this Circular and guidance documents for relevant units;

b) Compile training materials for patrol and control operations and handling violations of laws related to security, order, and social safety for the Mobile Police Force;

c) Organize training sessions, inspections, and evaluations of the results of patrol and control operations and handling violations of laws related to security, order, and social safety for subordinate units and leaders and commanders of Mobile Police Force units nationwide.

Clause 2. The Director of the provincial police force shall be responsible for:

a) Organize training for the patrol and control operations and handling of violations of laws related to security, order, and social safety for police officers under their jurisdiction according to the training materials compiled by the Mobile Police Force Command;

b) Direct and organize the implementation of patrol and control operations and handling of violations of laws related to security, order, and social safety as stipulated by law and this Circular.

3. The heads of the General Directorates, Commanders, and Unit Chiefs under the Ministry of Public Security, Directors of Public Security, Fire Prevention and Fighting in provinces and centrally-administered cities have the responsibility to implement this Circular. During the implementation of this Circular, if there are difficulties or obstacles, the Public Security units and localities shall report to the Ministry (through the Mobile Police Force Command) for timely guidance.
